Parker that Columbia Electric located in Brockton, MA could engineer a solution for him.

conditions, and to submit a design proposal to install adequate lighting in that area. MBC would
later contact Walter Parker to coordinate work.

at QMS were not synchronized. Dick Carney indicated to the MBC Office that the Contractor

review and resolve this issue. `

and Jacobs) to review legal strategies of the ongoing window conflict claim.
MOTION to adjourn to Executive Session 8 :40 PM. W. Moore/K. Gay Passes: 5 -0.

General Update:
• Sue Jacobs held depositions of former Keyes' Employees Robert Vogel, Daniel Freeman,
and Ronald Ashton. Town Counsel was waiting for responses to procedural items and
presentation of documents from Keyes.
• Keyes' representatives indicated during depositions that the dimensions for windows to
be installed were very specific early in the project.
• Robert Vogel stamped final Shop Drawings. Discussion opened regarding responsibility
to verify window measurements in field as said to be indicated by Ron Ashton on the
shop drawings.
• Sue Jacobs suggested that the Town had no direct recourse of action against the window
manufacturer (Cheviot) because Cheviot was a subcontractor to J.T. Callahan and did not
have a contract with the Town of Mansfield. Town Counsel opinion at that point was not
to bring a claim against J.T. Callahan. MBC members questioned why the General
Contractor would not be held accountable for the work performed by subcontractors.
MBC members felt the only way to make the manufacturer (Cheviot) responsible for
field verification was by including J.T. Callahan in the window claim. Sue to investigate
( further.
• Town Counsel plans to schedule depositions of representatives from J.T. Callahan &
Sons (General Contractor) and Cheviot (Manufacturer), who were determined by those
firms to be the most knowledgeable about the QMS Project.
• Town Counsel issued a formal request to Keyes to provide shop drawings said to be
endorsed "Verify in Field" by Ronald Ashton. These documents were previously
requested by the MBC on numerous occasions. Neither the Architect nor Contractor had
provided the approved shop drawings as of that date.
• August 10, 1999 — It was reported that JTC initially wanted to reject windows after
installing them in one classroom. Rich Feeley commented that windows were pre
manufactured and already stored on site while waiting for the asbestos contractor to
complete their work. Architect forced a hardship on the Town because school needed to
open on time in September.
• Pre -Trial Conference — Town Counsel planned to meet with Keyes' Attorney (David
Corkum) at a future date to discuss mediation options vs. trial.
• Window Investigation Report — Gale Associates incorporated comments from MBC and
Town Counsel. Waiting for Gale Associates to submit copies of the final report to MBC.
• Sue Jacobs needs to schedule a time with the MBC Office to further review project files.
MOTION to adjourn from Executive Session at 9:10 PM. JL/WM Passes 5 -0.
