He has great pride in Mansfield and loves the direction it is moving. Mr. Kozlowski thanked Mr. Cerretani for volunteering and noted his impressive background. He explained to Mr. Cerretani that the Board encourages its members to attend Town Meeting. Mr. Annino noted how much the Board appreciates the work done by its Boards /Committee members as they are residents and have vested interest in the Town. He noted the Planning Board has a tremendous amount of experience of guiding growth with which he can learn from. Mr. DelVecchio noted in his review of the application Mr. Cerretani had applied for the Industrial Development Conunittee and felt that since it was full this would be a great fit for him as that board meets more regularly and would be a great vehicle for him to channel any suggestions to the IDC, especially with his background in development. Mr. Aptowitz thanked Mr. Cerretani for stepping up and volunteering time to the community. Chairman Dentino thanked Mr. Cerretani for coming forward and found his application to be excellent. Motion: To appoint Joseph Cerretani as an associate member to a five year term to the Planning Board to expire January 1, 2020 (Annino /DelVecchio)PASSES 5:0 Michael Feck, an associate member of the Planning Board, is present before the Board. Mr. Feck noted he has been on the Planning board as an associate member for the past three years and felt it was a great way to learn and get his footing and would now like to play a bigger role. He also noted he is a member of CIP Committee. Mr. DelVecchio has worked with Mr. Feck on the CIP Committee and felt him to be a great asset to both groups. Mr. Annino noted this is the way it is supposed to work where an associate member gains experience, learns and then moves up. Mr. Kozlowski thanked Mr. Feck for taking on more and his willingness to continue. Mr. Kozlowski asked where Mr. Feck is currently employed to which he noted Monarch Realty here in Mansfield as well as with his family business Christian, Feck Development. Chairman Dentino noted Mr. Feck has done a great job. Motion: To appoint Michael Feck to an unexpired five year term to the Planning Board to expire on January 1, 2016 (Annino/Kozlowski) PASSES 5:0 At this time Chairman Dentino asked the Boy Scouts in the audience to approach the Board to introduce themselves and the badge they are seeking. Board Of Selectmen's Meeting January 14, 2015 Page 2 of 8 • Noah Griffin is here for his Communications and Citizenship badge. He is a troop leader for Bacon Patrol for Troop 17. • Josh Griffin is also from Troop 17 and is looking to obtain his Citizenship badge in hopes of achieving an Eagle Scout rank. • Trevor Amador is getting his Citizenship in the Community badge for his Eagle Scout rank and noted he is here to observe a government meeting. • Ethan Ham has addressed the Board previously regarding the Christmas Tree sales for the Boy Scouts. He is a representative of Troop 17 and felt the meeting to be interesting. I-Ie too is seeking his Citizenship badge which requires attendance at a Board of Selectmen's meeting, which he will then discuss with his representative. His is also reaching for the Eagle Scout rank. Present before the Board are Nancy Wall and Scott Brigante from the Mural Committee. Mr. Ross noted that Ms. Wall and Mr. Brigante had met with Mr. Ross regarding the status of the mural and issues the group is having with the artist. Mr. Ross then met with Ms. Wall, Mr. Brigante and the artist to work out an end date for the completion of the mural. Mr. Ross reported that there has been an amendment made to the original contract stating the mural will be completed by June 30, 2015. If that is not met the artist will forfeit the contract with a remaining balance of approximately $12,000. Mr. Ross also explained that if the artist does not sign the amendment then the contract because void and the Mural Committee will find another artist to complete the project. At this time Mr. Ross was unsure whether the artist will sign. Mr. Brigante noted that what transpired with the regards to the mural over the fall was that the Committee expressed a determination to finish the project with or without the artist they originally hired. Mr. Annino asked how much more was left to be completed. Mr. Brigante reported that he and Ms. Wall determined that 85% has been completed and there is a list of 15 -18 design elements remaining to complete the project. Mr. Armino noted that now that a deadline has been given, how much time is needed to which Mr. Brigante felt the remaining work could reasonably be completed 3 -4 weeks to which the artist agreed. Ms. Wall noted it depended on weather but that the completion date is June 30, 2015 and that if the weather allows lie could begin as soon as lie wants. Mr. Armino asked how the mural has been holding up to which Mr. Brigante referenced there was a "bubbling" issue but that the Mural Committee is well prepared to handle that. Mr. Aptowitz noted there has been two cycles (years) of this and asked what the original agreement was. Mr. Brigante reported the original agreement stated the project should be completed by May, 2014 (which was two years from the Town Meeting vote). Mr. Aptowitz's concern, as layperson, is once it was started it should have been finished in that year and now it has been two years and that work needs to be protected. He would like to see the work finished, sealed and done. Mr. Aptowitz asked if the Committee has other options if the artist does not sign the amendment. Mr. Brigante noted that although they would love to have the original artist finish the mural, the Committee feels it should have been done already. Mr. Brigante noted in retrospect they wished they had communicated with the Town Manager earlier but they were holding out hope it would be completed. The Conuuittee is prepared to move forward with another artist if necessary as they have the funds available. Board Of Selectmen's Meeting January 14, 2015 Page 3 of 8 Mr. Kozlowski reminded that the Committee has a contract with the artist and hoped there were termination provisions within that. He asked if the design is finished and it is a matter of painting to which Mr. Ross noted the issue is the artist is creative and has adjusted elements that he "felt" could be done better. Mr. DelVecchio felt the mural to be an asset to the Town and is glad there is a plan in place to complete it. Chairman Dentino was concerned about paint being left outside in colder temperatures and felt that could be an issue in the future. The Chairman asked for the reasoning of the names (residents) on the mural as he thought that was not to be allowed. Mr. Annino reminded that the Board would not allow for corporate sponsorships but that if residents contributed as a fundraiser that would be fine. Mr. Brigante appreciated the Board's support, especially Mr. Ross'. assistance. nsi tin t` s/ riautlesD'vis one Mr. Kozlowski noted as his house is a direct abutter to the property and this project he is recusing himself from the discussion. Mr. Annino broke down the grant as follows: FAA: $605,556 for 86.51% MassDOT /AD: $55,370 for 7.91% Airport Enterprise: $39,074 for 5.58% Mr. Ross noted this is a Standard Grant Assurance with common language that the Board has seen previously. Motion: To grant the Chairman of the Board of Selectmen to authorize the Grant Assurance for Phase I Obstruction Removal by MassDOT /Aeronautics Division Grant Assurance (Aptowitz/Armino) PASSES 4:0 Mr. Ross commented that the Conservation Agent, Katelyn Merrill was not notified that work had begun. Ms. Merrill will visit the site to ensure proper markings of the wetlands. IN 64 —av 9zy ;I Mr. Ross explained that Town Counsel has advised that because Mr. Kozlowski is member of the Board of Selectmen and Mr. Ross is the Town Manager that they should each file, under the State Ethics law, the disclosure and ask that the Board find there is no financial conflict of interest on their part, serving on the MEN Board as there is no compensation with the position. Mr. Ross noted Betty Peter will also be filing paperwork as she is still a part -time employee of the Town. Motion: The Board of Selectmen has determined that the financial interest is not so substantial as to be deemed likely to affect the integrity of the services which the municipality may expect from the emnlovee (Annino /DelVecchio) PASSES 4:0 Board Of Selectmen's Meeting January 14, 2015 Page 4 of 8 Mr. Ross felt his current contract to be acceptable and that he is not looking for a change other than to extend the contract three years. Chairman Dentino felt it to be good of Mr. Ross to take a level route to his agreement and felt it to display great management skills. He felt Mr. Ross to be a great example since day one and appreciated what Mr. Ross does. Motion: To agree to enter into negotiations with Mr. Ross for a three year contract extension (Aptowitz/Kozlowski) PASSES 5:0 The Town Manager evaluation forms were distributed to the Board where Chairman Dentino asked for the return no later than two weeks time. Ethan Ham, Troop 17 of the Boy Scouts, asked if there were any projects that the Town could suggest for those members looking to work towards their Eagle Scout rank. Mr. Kozlowski suggested the property on South Main Street. Mr. Ross would send the information to Ethan as well as Katelvn Merrill, Conservation Agent. a. Land Corp., Map 14, Lit 20 —Land On South Main Street Letter from Governor Charles Baker Regarding Release of Remaining Chapter 90 Transportation Aid Mr. Armin read the letter into the record. Mr. Ross noted this was one of Governor Baker's campaign promises where the original Legislature passed $300 million but the former Governor only released $200 million. The result is an additional $372,399 towards the Town's street improvements. Mr. Ross distributed to the Board the design for the Conceptual Traffic Pattern for North Main and Oakland Street. The changes stem from the results of meetings with residents, legislative representatives and Town Staff: • with regards to Pratt Street — concluded to leave as two way as well as Fuller Place • realigned the entrance to small parking lot across from Pratt Street • tried to reverse Mansfield Avenue but cannot provide enough room for left turns between Chauncy and Crocker • retiming traffic signal on Chauncy Street as well as two westbound lanes and protected left turn lane which will move traffic better • running simulations to see if a situation similar to 140 /106 would work better — working with SRPED on this • one issue with Pratt Street is Fire Department access — not any worse than current Mr. Ross noted that another meeting will be needed with planning Board but wanted the Selectmen to see what has been done with the major concerns and that the Town is being responsive. Mr. Ross restated that the parking that is being created along Crocker and North Main will be two hour and specifically set up for businesses. Mr. Ross believed this to give a spark of rejuvenation of the area. Mr. Anino felt the Town is gaining a green corridor and there are a lot of "pluses" to this scheme. Mr. Aptowitz asked if the cost was known to which Mr. Ross felt it to be around a million. Chairman Dentin noted that when parking is increased the traffic is increased. He would like to see some type of visualization of this process before committing dollars. Mr. Ross noted the best thing to do is the simulation with SRPED. Mr. Ross reported that the Industrial Development Committee is full. FIe has scheduled a reorganizational meeting for January 28t" and will appoint a member to the TIF Board as well as the Communications Committee. Mr. Ross reminded that Town Hall will be closed on Monday due to the Martin Luther King holiday. Mr. Ross is looking forward to MMA Conference and noted that Governor Baker will be a one of the speakers. Mr. DelVecchio asked about the Chocolate Factory progress. Mr. Ross noted the Chocolate Factory LLC will be seeking an amendment to the Development Agreement to increase the number of two bedroom units by 15 and reduce the number of one bedroom units by 15. Mr. DelVecchio asked about the Town revisiting the Strategic Plan to which Mr. Ross noted that is planned for late winter between Shaun Burke and Dr. Mullen. Mr. DelVecchio had a previous discussion with Mr. Ross with respect to time use available from SRPED and if he had any ideas. Mr. Ross did not at this time but would research but is open to suggestions. Mr. DelVecchio explained that the SRPED representative, Daniel Horowitz, reported that SRPED provides 40 hours of free consulting to each community. Mr. Annino noted the Town did get traffic counts for North Main from them. Mr. Ross noted the Town will be using them as well for the simulations. Mr. Kozlowski reminded everyone he will be participating in the Polar Plunge benefitting the Special Olympics as coordinated by Sergeant Crosman. The event will take place on Valentine's Day. Mr. Aptowitz asked for a status on the agreement between the Board and the Montessori School with regards to the use of land. Mr. Ross will report back later to the Board. Mr. Aptowitz reminded that an RFP would need to be conducted with regards the Town's auditor as we have to conduct due diligence. Mr. Aptowitz loved the concept of the Visual Budget. Mr. Aptowitz was concerned with the conditions at the underpass at North Main Street over the weekend. Mr. Ross would speak with Mark Cook but noted it is ground water. Mr. Aptowitz noted that the MMED will be meeting next week after the Board of Selectmen's meeting. Board Of selectmen's Meeting January 14, 2015 Page 7 of 8 Mr. Aptowitz would like to see more information communicated to the public with regards to the new Public Safety/DPW building. Mr. Annino noted there was a presentation for the Public Safety building with State Representatives where Fire Chief Neal Boldrighini and Police Chief Sellon presented. Chairman Dentino was looking for clarification on the towing discussion for the train station. Mr. Annino reminded of the motion from the January 7t" meeting to place a Denver Boot at the third parking violation. Mr. Aptowitz stated it was his intent to dissuade non- residents from parking in resident spots. It was clarified that there will be no towing. None.
