Resident Engineer Sewiees:
Manhour Summary:
• Resident Engineer's time cards currently on file are up -to -date through January 28, 2005.
• Based on time cards submitted through January 31, 2005, there have been 931 hours of "
Resident Engineer services provided to the WTF Project at a cost of $78,511.00.
• MBC previously reported a discrepancy between the numbers of hours worked by Ralph
Cunningham vs. the number of hours recorded on the time sheets. The discrepancy was
due to copies of time sheets not up -to -date. This issue is resolved. Bob Chapell indicated
that due to a separate error discovered in Vaidya's billing to W &C, Ralph Cunningham
would be able to dedicate additional hours of Resident Engineer Services to the project.
Daily Field Log Reports•
• As of this date, the MBC is missing copies of Daily Field Log Reports for the month of
January through February 8, 2005. Woodard & Curran and /or Ralph Cunningham need
to provide this documentation to the MBC Office.
• The Daily Field Log Reports previously submitted to the MBC by Woodard & Curran for
the months of November 2004 and December 2004 are not signed by the Resident
Engineer. W &C will obtain signed Field Reports from Ralph Cunningham and forward
copies to the MBC.
State Revolving Fund Loan:
• Requisition No. 8 -The Town Treasurer contacted the MBC Office earlier that day and
advised that the payment for Requisition No. 8 in the amount of $406,794.91 was
received.
• Requisition No. 9 - W &C prepared BMF Form 1000 as required by the Department of
Environmental Protection to process Payment Requisition No. 9. Copies were submitted
to the MBC for Town Manager's signature approval.
• Constnction Photos - W &C provided photo documentation of ongoing construction
activity.
Project Schedide - The MBC rejected Hart Engineering's up -to -date project construction
schedule (dated 1/17/05) because the Contractor added task items (i.e. mobilizations etc.)
to original approved schedule instead of showing the "actual" timeline of progression of
work. MBC directed Woodard & Curran to direct Hart to submit a revised schedule to
the MBC for approval and remind Hart that no changes of any kind, other than the status
of approved activities, may be made to the approved schedule without the written
permission of the Engineer.
• Applicationfor Payment No. 9— Review /Approval
Motion to recommend payment to Hart Engineering in the amount of $393,577.12
for construction services provided through January 31, 2005 as recommended by
Woodard & Curran. R. Feeley/W. Moore; 5 -0 Passes.
Potential Change items:
HYAC;
• Based on discussion about the HVAC system during the January 11, 2005 MBC Meeting,
Sid Greenleaf (AEI) was asked to develop a Sequence of Operation and submit a copy to
the MBC for review. Item is incomplete. Woodard & Curran needs to follow up with
AEI.
MBC was previously waiting for a response from New England Piping the Mechanical
Subcontractor, as to whether an air - handling unit could be purchased from Metawre vs.
Titus. A response received from Mike Harrison (New England Piping) indicated that
MetalAire does not make an air - handling unit. W&C needs to issue written notification
to New England Piping to proceed with work per specifications.
Rooflnstallation,
• In response to a concern regarding roof material exposed to freezing temperatures, the
MBC requested written confirmation from Woodard & Curran and the roof installer
(Coro Construction), to confirm that the roof shingle application is being done in
compliance with the manufacturer's requirements.
• Letters from both parties indicate that the MBC's concern regarding the roof installation
is a non - issue. MBC decided not to pursue further documentation from the manufacturer.
Change Order Proposal Log — Review
COP #1 Extension of contract time only (31 calendar days). Status: Approved in Change
Order No. 1.
COP #2 Excavation and disposal of rock/ledge in excess of 100 CY ($94.00 /CY) in the
amount of $62,098.00. States: Approved in Change Order No. 2.
COP #3 Excavation and disposal of excess rock over 100 CY (final count of 860 CY) in the
amount of $86,000. Based on review of the claim submitted November 3, 2004, it
appears that Hart Engineering is requesting payment for removing rock-material from
the site which was less than one cubic yard and without drilling, blasting or special
equipment involved in the process. Based on the specifications, Woodard & Curran
denied the claim for lack of documentation justifying the Claim. In a letter dated
January 7, 2005 from Daly Cavanaugh LLP, Hart indicating their intention to pursue
the claim through mediation as outlined in the Contract Documents. The MBC Office
received an e-mail (Feb. 2, 2005) front Thomas Frothingham of Daly Cavanaugh
LLP requesting contact information be provided Fixture communications regarding
this issue will be addressed to Chairman Liddick and mailed to the ABC Office at
Town Hall. Status: The COP is rejected by owner and currently disputed by Hart.
Chairman Liddick asked Woodard & Curran to forward a letter to the ABC to
support W &C position that Hart's claim has no merit.
COP #4 Add'l. cost to include 3`d color mortar. Status: Closed/Withdrawn by owner.
COP #5 Hart has furnished a cost proposal in the amount of $9,089.10 to reroute the 16 -inch
treated water transmission line around an unmarked buried electrical manhole. This
cost proposal is included in Status: Approved in Change Order No. 3.

Status: Approved in Change Order No. 3 /Cost amount is combined with COP #7.
COP #7 Furnish and install 15 tactile devices at doorways specified by the Architect to meet
ADA requirements. Total cost of COP #6 & COP #7 is in the amount of $782.10.
Status: Approved in Change Order No. 3 1Cost is combined with approved COP #6

with the south wall of the garage and the office area for a cost of $866.25. Status:

Status: Approved in Change Order No. 4/DPW to purchase at a fidure date.
COP #11 Furnish and install additional sprinklers in the attic area in the amount of $17,472.00
to meet NFPA -13 code requirements. Woodard & Curran originally rejected the
proposal submitted by Hart in a letter dated November 29, 2004. Bristol Fire
Protection has since submitted a formal claim for the additional sprinklers (letter dated
December 22, 2004). Bob Chapell noted the Contractor did riot request clarification
regarding the scope of work in the contract documents prior to bidding. Status:
W &C denied/Disputed.
COP #12 Modifications to install electric hand hole for DPW connection to new WTF plant for
an added cost of $1,197.00. Status, DPW agreed to pay for the handhole themselves
and not use project fluids.
COP #13 The Contract Documents specify a split face on all exposed faces of the split face
block, including the corner blocks used at the window jambs. The unevenness of the
split face block will inhibit a good seal between the block and the window frames. An
original cost proposal in the amount of $6,001.65 is denied because the cost amount
does not reflect an actual cost to complete the work. Status: (218105) Bostonian
Masonry submitted a revised cost proposal in the amount of $566.86 for the cost
associated with per forming cuts to the 4 -inch veneer units at the (10) window opening
jam conditions.
Motion: To recommend approval of COP #13 in the amount of $566. 86 as
recommended by Woodard & Curran for additional work necessary to cut block
to ensure proper window seal. Change Order Proposal COP #13 to be included in
Change Order No. 5. K. Gay/R. Feeley: 5 -0 Passes.
COP #14 Furnish and install 16 additional bollards around transformer and switch as requested
by the Mansfield Municipal Electric Department for an additional cost of $7,073.00.
Status: As a result of W &C's follow up discussion with Gary D'Ambra at the
Mansfield Electric Dept., the number of bollards required is reduced to five. Existing
bollards will be relocated on site to meet the requirements of the Electric Dept. at no
cost to the Project. This item will be withdrawn.
COP #15 Furnish and install a double aluminum J channel at the transition between the solid
and vented soffit for a cost of $2,139.50. Status: Approved in Change Order No. 4.
COP #16 Additional plumbing work associated with the oil and gas interceptor in the amount of
$1,085.63. Status: W &C denied/W &C needs to confirm proposal is withdrawn.
COP #17 Excavation and disposal of an additional 241 cubic yards of rock material over and
above what was previously paid in COP #2 in the amount of $24,100.00. Bob Chapell
reported this COP would include the final cost of rock material removed from the site.
W &C recommends the MBC approve the proposal to be included in Change Order
No. 5. Status: Pending receipt of written documentation and MBC Approval.
COP #18 Request for extension of contract time. Hart put the MBC on notice of their intention
to submit a claim (received 1127105) for an extension of contract time due to harsh
weather conditions. W &C was asked to clarify. Chairman Liddick commented that
the Contractor could include a potential request for extended General Conditions,
which would impact the project budget. Status: Based on preliminary investigation
by W &C and the MBC, weather conditions in December 2004 are not a factor that
could have caused a delay to Hart's approved schedule's critical path. W &C will
issue a letter to Hart rejecting this claim noting that based on their original approved
project schedule the overall completion of the project remains on schedule at this
time.
Project Budget Review; Chairman Liddick reviewed an up -to -date project budget with members
of the Committee. At this time, the MBC anticipates the project will be complete within the
budget appropriated by the Town. The MBC will track and prioritize additional cost items with
input from the Water Operations Manager for future consideration should there be funds
available at the end of the project.
Motion to recommend the Town approve Hart /Change Order No. 2 to include COP #2 for
an additional contract amount of $62,098.00 as recommended by Woodard & Curran.
