WATER TREATMENT FACILITY PROJECT
Status of Inspections
1. Electrical: The permanent back -up generator was load tested by the contractor and
passed final inspection by Electrical Inspector David Connelly, earlier today.
2. Building: Woodard & Curran submitted all required Affidavits to Building Inspector
Nick Riccio on August 8, 2005.
3. Certificate of Temporary Occupancy: The Building Inspector issued a Temporary
Certificate of Occupancy for the new Water Treatment Facility on August 8, 2005. Hart
Engineering has 30 days from this date to complete and/or correct all remaining work
items to the owner's satisfaction. The Building Inspector has the authority to withdraw
the Occupancy Permit if essential work items are not complete by the 30 -day period.
4. Conservation Order of Conditions: In order to receive a Certificate of Compliance from
the Town; Conservation Agent Michelle Grenier needs to receive a copy of the Final As-
Built Drawings, inspect the site, and hold a public hearing at a future Conservation
Commission Meeting. At that point, the Conservation Commission would need to take a
vote to approve the Certificate of Compliance for the Water Treatment Facility. Bob to
walk site with Michelle Grenier Thursday, August 11, 2005.
5. Department ofEnvironnrental Protection (DEP) —Bob Chapell indicated that DEP gave
Woodard &Curran verbal approval to operate the water system. Written certification
from the DEP is expected to follow.
6. Mechanical: (AEU)
• Bob Chapell reported air balancing is complete as of this date.
• MBC Member Ken Gay attended a final mechanical walk -thru with Sid Greenleaf of AEI
on Monday, August 8, 2005. Public Building Manager Mike Ahern indicated to the
MBC that he could not attend the walk -thru due to other work commitments.
• Member Gay reported that the building could not be balanced at that time of inspection,
due to a lack of water in the HVAC system.
• Certified Balancing Reports need to be completed and submitted to AEI for review and a
copy to the MBC.
• Sid Greenleaf expressed frustration to Member Gay on site that the Contractor had again
requested an inspection before his contract work is complete.
• MBC questioned why Joel Goodmonson (AEI) submitted a signed Affidavit for
mechanical, electrical and plumbing work (dated July 29, 2005), when, as of today, the
HVAC system is still not tested or balanced.
• An automatic air vent needs to be installed at the high point in the garage bay. Ken Gay
questioned the contractor's method of leak testing without having water in the system.
• AEI is expected to submit a written report to Woodard & Curran with the findings of this
inspection.
• Air gaps were observed around the return ductwork. Contractor needs to seal these areas
completely.
• Ken Gay reported the remaining areas of the mechanical systems are working properly.
Monetized Punch List — MBC members reviewed a consolidated Punch List submitted by
Woodard & Curran (as of Aug. 9, 2005), as well as a draft of the monetized punch list.
• MBC members agreed in many instances that the monetary value assigned to a particular
punch list item was too low. MBC requested that the Project Engineer re- evaluate the
proposed dollar values to ensure sufficient funds are set aside, should the Town need to
hire an outside contractor to complete the work.
• Rich Feeley requested Bob Chapell distinguish the items on'the Punch List between
contract work that is incomplete, and punch list items (i.e. contract work not completed to
the owner's satisfaction).
• In comparing an original punch list submitted by Public Buildings Manager Mike Ahern
(dated 7/15/05) with the final Punch List prepared by Bob Chapell, the MBC found that
two items from Mr. Aherns's list were not included on the final punch list issued to Hart
Engineering. Chairman Liddick instructed Bob Chapell to notify the General Contractor
immediately of the two additional punch list items.
• As of this date Bob Chapell has not responded to the MBC's previous directive asking
Woodard & Curran to issue a written response with a status update of each item noted on
Mike Ahern's Punch List.
Follow up regarding concerns raised last week (August 3, 2005):
• Relocate exterior heat sensor to north wall — Sid Greenleaf (AEI) saw the current location
of the heat sensor during a recent walk -thru and agrees that the heat sensor needs to be
moved to the north wall of the building to follow industry standards.
• Painting — Office doors are painted on 6 sides per contract to prevent potential moisture
and /or mold issues.
• Interior Building Signage — Installation of interior building signage is incomplete.
o Bob Chapell confirmed that tactile warnings are not required for the storage room
sign.
• Dedication Plaque — MBC is still waiting for Hart Engineering to provide a proof of the
text layout for approval. Bob Chapell was urged to follow up on this item as soon as
possible.
Follow up regarding concerns raised last week (August 3, 2005) continued
• Laboratory Floor —Due to the bad floor seam and substantial dimpling, the installation
of the floor is unsatisfactory. Per Bob Chapell, West Floor Coverings has been contacted
by Hart Engineering to correct the poor floor installation.
Boilers — The Town recently purchased 3 high- efficiency boilers for the new Water Treatment
Facility. Rich Feeley advised Kurt Gaffney of a rebate offered for the boilers and suggested he
contact Rise Engineering for further details.
Substantial Completion — After lengthy discussion, a unanimous decision was reached to
recommend the Town accept the new Water Treatment facility as substantially complete. With
this acceptance, Hart Engineering would have 30 days (or until Sept. 9, 2005) to complete all
remaining work items. MBC needs to notify the Cuddy Insurance Company to add the new
building to the Town's current policy.
MOTION to recommend the Town issue a Certificate of Substantial Completion to Hart
Engineering with the final punch list. R Feeley/W. Moore: Passes 5 -0.
Operation Start-up - Training is ongoing.
Warranties /Operation & MantenanceMaintenance Manuals — Hart needs to provide all warranties
and Operation and Maintenance Manuals to owner upon completion of the project.
Release of Liens — Hart Engineering needs to provide Release of Liens prior to receiving final
payment.
Change Order Proposals Log;
COP# 18 Re: Revised Request for Extension of Contract time — Weather
Ltr. from Hart reduced request from 45 to 30 calendar days.
Status: Not Accepted by MBC as of this date.
COP #19 Revised: Request for time extension to July 8 "' (52 days) due to Generator shipping
delay. Status: Not Accepted by MBC as of this date.
COP #22 Re: Miscellaneous Electrical Wiring - $12,325.66.
• Kurt Gaffney questioned the status of a credit due for installation of single -phase wiring
vs. three -phase wire in garage overhead doors.
• Fall River Electric contends that the dollar amount of the proposed T &M Change Order
is justified.
• MBC confirmed with Bob Chapell that evening that Fall River Electric had not
performed any contract work prior to installing the single -phase wiring. In light of this
fact, the MBC contends that the cost of labor is owned per contract and the Town should
not be charged additional labor to install the wiring.
• MBC members discussed intentions to exercise a unilateral Deduct Change Order should
the Contractor not submit a reduced cost for this COP.
Status: Pending.
COP #24 (New) Re: Final excavation & removal of 18CY of rock material during
installation of gas line and communication conduit - $18,000.
Status: Not Accepted by MBC as of this date.
COP #25 Re: Office Furnishings (Internal Request by Water Dept.) $15,000.00
• WB Mason delivered a partial order of office furnishings to the new facility earlier this
month.
• MBC needs to process two invoices for material & installation for a total amount of
$15,000.00. Kurt Gaffney verified the order and recommends the MBC process both
invoices at this time.
• WB Mason agreed to pay any costs incurred by the Town to replace approximately 5 new
floor tiles which were damaged during delivery of office furnishings and also to correct
poor installation of workstation shelving in the administration area.
• Hart replaced the damaged tiles in the admin area, but has not yet provided a cost
amount.
COP #26 Re: Credit due to owner for deletion of Gas Solenoid Valve ($256.32). W &C was
previously asked by the MBC (7/19/05 MBC Meeting) to increase labor to 3 hours and resubmit
for approval. Status: Revised paperwork is not received as of this date.
COP #28 Re: Modification in vehicle truck wash area to install keypad access instead of card
reader. Internal request by DPW Director.

to be complete Friday, August 19, 2005.
COP #30 Re: Contract reduced by $50K — Manufacturer to provide warranty on radiant heat
tubing repair.
Certificate offinal Occupancy Nick Riccio needs site plan As -Built Drawing for final
Certificate of Final OccupanyOccupancy. Bob Chapell indicated Hart Engineering completed
the Site Plan As -Built Drawing and was to mail the plan to Woodard & Curran that day. A
complete set of As -Built Drawings need to be provided to owner.
Mediation Hearing - Brief discussion was held regarding future strategy regarding the Mediation
Hearing that occurred earlier that day (8- 16 -05) regarding COP #3 Re: Excavation and disposal
of Rock Material and COP #11 Re: Add Sprinkler devices Mediation.
Phones — Kurt Gaffney advised the MBC that DPW Office Manager Betty Amicone is
coordinating the purchase and installation of the telephone service for the new facility.
Outstanding Issues
Mechanical Room Drain — MBC discovered last week that the air handling unit height is not
per design and is too low to facilitate operation of condensate drain. The current drain trap
installed is approximately 2- inches short. Previous options discussed with the Contractor on
site to address this concern were rejected by the MBC this evening. Woodard & Curran
needs to notify Hart immediately to raise the air - handling unit to 8" as noted per
specifications. Work needs to be done prior to balancing the unit.
Notice to Complete Outstanding Work — In response to a prior MBC request, Bob Chapell
distributed a draft copy of written notice to Hart Engineering advising the Contractor to
complete outstanding contract work past deadline. MBC members advised Woodard &
Curran to issue the notice and include a copy of an up -to -date Final Punch List.
Radiant Floor Heating Tubing — Hart Engineering recently reported to W &C that the
manufacturer would not warranty splice repairs to the floor heat tubing at the Water
Treatment Facility. Hart Engineering submitted a revised proposal to the MBC offering an
extended 5 -year warranty on the floor - tubing repair along with a bond for $30,000 per year
to satisfy MBC warranty concerns. Jim Liddick suggests that W &C needs to check the flow
rate, measured in GPM (gallons per minute), at elbows to see if it is sufficient. If GPM rate
is not acceptable, then elbows located in this area (possibly two) may need to be replaced.
Due to potential future concern with flow and heat loss, Lee Azinheira had previously
requested Hart include 4 elbows in the warranty.
Hart En ing Bering /Application for Payment No. 15 — Water Treatment Facility
• A previous Pencil Requisition submitted by Bob last week is out of sequence and needs
to be re- numbered.
• Asa result of this MBC Meeting, Hart will also revise the dollar amount reducing
retainage to the value of monetized punch list value.
