WATER TREATMENT FACILITY PROJECT
Hart Mediation
• Earlier this week, MBC Chairman Liddick contacted Bob Mulligan, President of Hart
Engineering on behalf of the MBC to discuss possible options to settle disputed claims
that were not resolved at a prior Mediation Hearing held on August 16, 2005.
• The action to contact Hart was discussed and supported by all Committee members and
the DPW Director at a previous MBC Meeting. MBC advised Town Counsel Bob
Mangiaratti of the Committee's intentions prior to making contact with Hart.
• A verbal agreement was reached with Hart Engineering as a result of the Chairman's
follow up conversation with Mr. Mulligan.
• Hart Engineering agreed to pay the Town of Mansfield a total amount of $45,000 to settle
both disputed claims in Change Order No. 7.
• In addition to the settlement agreement, Bob Mulligan also agreed that Hart Engineering
would provide a 5 -year maintenance bond to warranty radiant floor tube repairs for an
amount of $30K with Change Order No. 7. The bond provided by Hart Engineering with
CO #7 indicated a renewable option after a two -year period. MBC asked Bob Chapell to
hold the original bond, and obtain proof from Hart Engineering that a maintenance bond
will be in place for 5 -years as agreed.
Hart /Change Order No. 7
• Woodard & Curran presented Hart/Change Order No. 7 in the amount of $45,000 for
approval. Change Order Number 7 will void and replace the following C.O. Proposals:
o COP #03 Re: rock excavation & removal /$86K
o COP #11 Re: sprinkler modifications /$16K
o COP #28 Re: contract deduct of $50K
Up -to Date Punch List - W &C provided an up -to -date punch list to MBC members for review.
Regarding the Mechanical System:
• Bob Chapell reported the system is now balanced. MBC members disagreed that the
building is balanced based on the their review of the air /water balancing reports provided
by Regional Air Balancing Co., Inc. (dated August 15, 2005) this evening. Accuracy of
balancing report is in question since New England Piping is still working to complete
components of the system. MBC requested W &C provide a response from AEI with
their input regarding Certified Balancing Reports.
• Instrument certification needs to be provided.
• AC -1 is set too low. Committee agreed to accept this installation based on the unit's
satisfactory performance during the first year of installation. MBC needs to issue a letter
to Hart to notify them of this condition. W &C needs to determine what cycle the unit
was in when testing was done to confirm the unit will perform efficiently.
• AEI and member Ken Gay agreed that HV -1 (located in the filter room), needs to be
adjusted to slow down fan.
• AEI reported three diffusers (located in Corridor No. I, No. 7, and 106) are still loud.
• Wash Bay Floor — Only 1 reading provided for 5 circuits. Check if reading is available
for individual groups.
• New England Piping needs to provide a circuit setter for No. 15.
• Add air relief valve to high point in hot water heat piping.
Product Warranties — W &C to verify that all product warranty information is provided
Operation & Maintenance Manuals — W &C needs to verify that Operation and Maintenance
manuals shipped to the Water Treatment Facility are complete.
Release of Liens — Hart needs to provide a Release of Liens upon final completion of the project.
As -Built Drawings — Hart needs to provide architectural, electrical, and mechanical drawings to
Woodard & Curran. Bob Chapell noted that Woodard & Curran continues to generate as -built
drawings in digital format for the Town at this time.
Certificate of Compliance /Conservation — Woodard & Curran needs to follow up on the status
of this item.
Siege — Interior and exterior building signage is incomplete.
Floor Installation/Laboratoty —NBC members were not totally pleased with the esthetic
appearance of the floor repairs, however they did agree, reluctantly, to accept the installation of
flooring in the laboratory at this point. Acceptance is conditional upon receipt of a letter from
Armstrong Floor with a written guarantee that the floor, as originally installed, would not fail.
Men's /Women's Restroom -
• Hot Water issue - It appears the recirculation pump does not reach the area of the
building where the restrooms are located and as a result, the timing to receive hot (or
warm) water in the restroom sinks is extremely lengthy. Montle Plumbing was on site
last week and reported their work was completed per AEI's specifications.
• Shower curtains are still too short. Hart to provide 42" versus 36" wide.
Room 125 — Chemical leak repairs continue to be an ongoing maintenance issue.
Card Access Reader - Replacement of a key access unit to a card access reader is in progress.
InControl has the card reader unit on order and will install upon delivery.
Landscaping — W &C recommended that the MBC not release money to Hart for this item until
the lawn is germinated and replacement scrubs take. The crab apple tree needs to be pruned to
fix a split branch. Kurt Gaffney informed the MBC that the Conservation Agent has no
objection to leaving hay bales in place.
Li htin - Ken Gay questioned whether lighting would be required in the rear of building. This
item does not appear to be noted in specifications, but could be added at a future date.
Door Sweeps - Exterior door sweeps in the Chemical Room and Filter Room need to be adjusted
to close air gap.
Jim Liddick requested that Bob Chapell respond to each punch list item identified by Mike
Ahern in writing.
Pending Change Orders - MBC members discussed including the following items for approval in
Change Order No. 8.
COP #22 Re: Miscellaneous elecb•ical wiring - $12,325.66
Due to a dispute regarding the value of credit due to the Town for wiring of garage door openers,
the MBC decided split the original proposal submitted into two separate proposals.
• Chairman Liddick directed Bob Chapel to prepare Revised Change Order Proposal #22A
to include the costs associated with the air compressor, sprinkler, and eyewash only.
• COP #22B would be generated when a credit is agreed to for the cost difference to install
three -phase wiring vs. single phase for the garage doors.
COP #24 (Neu) Re: Final excavation & remoral of 18 cubic yards of additional rock - $1,800.
Hart removed rock material during installation of gas line and communication conduit. Based on
Woodard & Curran's recommendation, MBC members agreed that payment to Hart is warranted.
COP #26 Credit to delete gas solenoid valve and associated work — Bob Chapell was previously
instructed by the MBC to increase the dollar value noted for labor on this item by 3 man -hours to
make the proposed credit acceptable. Paperwork from W &C was not available this evening.
