FY08 Budget Update Bill Moore met with the Town Manager and members of the Finance Committee on Saturday, April 28, 2007 to discuss the MBC's proposed department budget for FY08. There were no objections to any of the line item amounts requested by the MBC at that time. ROLE OF OWNERS PROJECT MANAGER (OPM) At the Chairman's request, Maureen Doherty and Eleanor McCarter, as Massachusetts Certified Public Purchasing Officials, gave a presentation regarding the role of "Owners Project Manager" as it relates to municipal construction. The purpose of the presentation given this evening was to help familiarize MBC members with the Owners Project Manager role, and the actions that would be required to take place when future MBC projects become funded. Highlights: • From this point forward the State of Massachusetts Construction Reform Laws requires municipalities to hire an independent "Owners Project Manager" to represent the "Town's" interest on all building construction projects estimated over $1.5 million dollars. This hiring process needs to take place prior to hiring the Project Architect. • Based on the MBC's current scope of responsibility, the current tasks performed by its members collectively are very much the same as the tasks that an Owners Project Manager would perform. Although Mansfield has been fortunate over the past 10+ years having a standing Building Committee who's individual members meet the qualifications criteria outlined by the State for the Owner's Project Manager position, at this point, the MBC may not act as the Town's Owner's Project Manager. We may not always have professional engineers with construction experience and licensed tradesman on the Committee as we have in past years. Attorney General's office was questioned as to whether the MBC could legally perform the tasks of the Owner's Project Manager. Response received from that office indicated that there is a "gray" area as far as the interpretation of the law. If the Town feels that its MBC combined meet the qualifications criteria of the OPM, the Town could petition to challenge the State law and possibly receive a waiver to appoint the MBC as the Owners Project Representative. • Departments should be aware that requiring cities /towns to hire an Owner's Project Manager will bring an added cost to building projects however, it could result in cost savings on possible errors not in the Town's best interest. • Maureen Doherty explained the current outlook on Construction Management and the benefit to hiring an Owner's Project Manager. The trend is moving away from depending on inexperienced Building Committees, and going toward hiring a professional who has the necessary expertise to properly evaluate construction related matters. COMMITTEE UPDATE Capital Improvements Committee — Ken Gay reported that a large number of items did not receive CIP financial support.
