School Administrators and representatives of the School Committee were present at a breakfast on Tuesday, February 26`h at 7:30 AM at the Jordan Jackson Multi Purpose Room. Mrs. Hodges asked Mrs. Linda Fernando of the Mansfield Educators Foundation to update us on what they are currently doing to revamp it and what it is all about. Mrs. Fernando noted that the Foundation is still going to give out grants to the teachers as in the past but they now are going to do it in a more collaborative way with the schools and the town to create this partnership to better understand what the schools need. The MEF will still focus on trying to get the larger businesses to help us where we have not had a lot of success with this in the past, and by partnering as a community that possibly some of those doors will be opened to us. The mission of our group is still to help the schools give our children what they need when the schools may not be able to get in a budgetary perspective. Mrs. Hodges noted that she felt that the breakfast they had that morning went very well and that they were excited with the approach they were taking. The brainstorming session went very well and we saw where we thought we would be able to go by making it a partnership with the schools, the town and community. Mr. Trowbridge noted that the big discussion today was about the steering committee and that they invited anyone from the School Committee that wanted to, to participate, but that the amount of their time would be minimal but the meetings would be held in the morning. Mrs. Losiewicz said that both she and Mr. Trowbridge were on board and excited to be there. Mr. Trowbridge 11— explained that what you were trying to explain was that you did not want to compete with the MESA or the QMS PAC but that you were trying to go to the larger corporations such as Midline Covidien or the Craft Group as examples, so that if anyone had a way to open those doors please feel free to contact the Mansfield Education Foundation and their website at mansfieldeducatiogfoundation .org. NEW BUSINESS QMS School Improvement Plan Mr. Zeff Gianetti, QMS Principal, presented the QMS School Improvement Plan to the School Committee. The QMS School Improvement Plan is on the district website. 2013 —14 Calendar Mr. Trowbridge moved the calendar up to the top of the meeting to accommodate the group of people present at the meeting. Chairman, Mr. Michael Trowbridge, read a statement to the public before he began the discussion of the calendar with the School Committee. Each year the School Committee struggles to establish a school calendar for the following year that is both beneficial to our students while also mindful of the varying demands of the residents of the town. Over the past few years our calendar has had many variations as we have attempted to accommodate the diverse growing population of Mansfield. While we would like to take into account the traditions of all of the residents of our town, it has become apparent that we cannot do so through our school calendar while also meeting the needs of our student population. 13- During the past few years, Labor Day has been later in September and we have had a few instances of major storms that challenged our ability to meet the minimum number of school days before the end of June. In developing our school calendar for the 2013 -2014 school year we have consulted with legal counsel to provide us with guidance on what we may and may not take into account when establishing our calendar. This year we developed our calendar to accomplish educating the students of Mansfield, while allowing for holidays that are legal holidays and either serve a secular purpose or would be a day of low attendance. That is the legal criteria we are bound to use. The Jewish Holidays, do not meet any of those criteria. That is basically set by the law. While the calendar may not please everyone, residents should understand that the School Committee put a great deal of thought and consideration into developing the 2013 -2014 calendar. Mr. Trowbridge stated that he knew that there was a lot of interest and emotion regarding this so he asked that the group designate one person to come up and talk for a couple of minutes. Please state your name and address when you come up please. Mr. Louis Levine of 15 Matthew Lane, has been a resident of Mansfield for the past 20 years. I stand before you tonight not only as a concerned parent and citizen of this town, but also as current co- president of Temple Chayai Shalom, a reform Jewish Temple in neighboring Easton, Ma. Our Rabbi will hopefully join us tonight, she couldn't be here, at this time. I would first like to thank the Superintendent, Mrs. Brenda Hodges, for notifying us about this meeting tonight that the 2013 — 2014 School Calendar was going to be covered at tonight's School Committee Meeting. As I am sure you are aware that over the past seven years, the Mansfield School Committee has voted to have the Jewish holidays of Rosh Hashanah and or Yom Kippur slated as No School Days for our district, and for that we thank you. Last year, our then Temple President and Mansfield resident, Jen Faber, came up before the School Committee to explain why not scheduling school during these holidays is so important to the Jewish Community at large. Rosh Hashanah and Yom Kippur are the two most sacred holidays on the Jewish calendar. To hold school on those two days would be the same for Christian's as if we held school on Christmas and Easter, it just would not be done. Since the Jewish holidays go off a different calendar, we understand this possess some scheduling concerns. We respectfully ask that Committee that you not make the Jewish families in Mansfield between celebrating one of their most sacred holidays with their families verses sending their children to schools those days. Unlike last year when both Rosh Hashanah and Yom Kippur were celebrated on weekdays, this year Yom Kippur falls on a weekend so school scheduling concerns should be less of an impact. WE are only asking the School Committee not to schedule school on Rosh Hashanah which falls on Thursday, September 5th , 2013. To give you some type of demographics, approximately 45% of our Temple membership comes from Mansfield. That is about 8o families and over 13o school age children from Mansfield. That does not include the many other Jewish families which are not affiliated with their Temple that live in town. One other note is that we know that many of the surrounding towns consistently do not schedule school on either of these Jewish holidays, Easton being one of those, Stoughton, Sharon, Brockton, Canton, just to name a few. So this is not something that ( is out of the ordinary, we have done this for the past seven years. It's unfortunate that we have to come to the Committee yearly to explain the significance of these Jewish holidays to our community. We respectfully ask that you embrace the cultural and religious diversity in the —4— Town of Mansfield and that you treat the holidays of Rosh Hashanah and Yom Kippur as you would Christmas and Easter. ( Mr. Trowbridge thanked Mr. Levine and said that he did not think that there was anyone up there who doesn't realize that these are important days for you, but you also have to realize that we are bound by certain laws what days and how we set our calendar and that was the guidance we took this year from our school attorney. Mr. Levine noted that his one question was, and he knows this comes up yearly, and I know some is contractually bound, I'm not sure when the contracts can be changed, we start so late in the year and it effects not only Jewish holidays but because we get out so late that it also affects summer camps, but just to say we are so different from so many towns in the area, every other town in the area seems to be able to take these holidays off consistently. I am not clear why we have to keep coming up here year after year. Mr. Trowbridge interjected by saying that he could not say what their legal council has said to them or not. I can tell you we did seek out legal council on our opinion on developing days for the calendar. Mr. Levine commented that he did not see this as a legal issue but more like a diversity and respect issue. Mr. Trowbridge replied that it was a legal issue as far as the days you can set as religious holidays. Mr. Levine asked why we were able to do this before and that he did not see it as a legal issue. Mr. Trowbridge announced that they would actually vote on the calendar and that once the vote is taken, he hoped that the group would understand that whatever the vote is; please understand our position and that we will not be discussing that topic any further tonight. Ms. Molly Miller came to the podium and asked to address the Committee. Mr. Trowbridge noted that Ms. Miller could address the Committee as long as it was very brief and was different from what Mr. Levine had already discussed. Ms. Miller went on to say that she was a tax paying resident of the Town of Mansfield and that she was a little offended how you had lumped the Jewish Community together tonight and asked for one person to speak as if we only speak with one voice. It offends her as well that you felt you had to seek legal counsel in order to address an issue that any of our neighboring towns have offered as a holiday out of courtesy and respect for their residents. No one here is threatening a suit or claiming legal discrimination, it's a matter of respect of diversity and other religions and days that are of highest importance of that religion. It really bothered me when I heard that you sought legal council to find out how to not to provide the Jewish residents of Mansfield the high holidays as a day off. Mr. Trowbridge stated that he respectfully disagreed; and stated that he didn't believe that what he said was that we sought legal council to determine how to not grant the Jewish holidays. Ms. Miller noted that was how it came across. Mr. Trowbridge continued that just so that we were clear, we sought guidance from our attorney on how to establish our calendar. That being said, Mr. Trowbridge returned to his meeting agenda. There was a slight interruption and Mr. Trowbridge moved the meeting forward and stated that they had the calendar in front of them that has been provided; it has the start time and the ending time. Mrs. Hodges mentioned that they had calculated the number of days from the beginning of the school year, the earliest start that we can begin, and then we calculated the 182 days required and added the five additional snow days that the state requires us to included in that calendar, so the official ending date is actually the 182 days plus the five snow day. The Superintendent did note that she and the leadership team were going over future dates for Professional Development to be added to the calendar. Mr. Trowbridge said that generally we approve the skeleton calendar. Mrs. Hodges did say that she would be most likely asking for 15— some additional time for Professional Development for this year early release times or possibly another full day because we have so many mandates that we have to provide training for our staff so that it will be necessary that we have at least the same development we have had in the past and she felt they may need additional time. Mrs. O'Neil stated that she would like to know what other towns are doing before we agree to, because this is one of the big concerns that a lot of parents have is the number of early release days and what some of the other alternatives are. Mrs. Hodges said she would be happy to provide those many districts are increasing their times because there are so many state mandates and initiatives that are occurring for all the districts in the state so we will provide those to you before you establish the final calendar. Mr. Trowbridge asked for a motion to approve. Mrs. Lisa Losiewicz made the ist motion to approve the calendar, 2nd by Mr. Wayne Smith. Mr. Trowbridge asked for any discussion. Mrs. O'Neil made a statement that this has obviously been a very difficult as I look at this calendar, and knowing that we were not going to be allowed to do the Jewish holidays, obviously Good Friday comes to mind of what we should do with that and currently we do have it scheduled as a day off because it does satisfy a day of low attendance. But, I would like to take this off the calendar. Mrs. Hodges added that maybe a clarification day for low attendance serving a secular purpose just as an explanation for what that means might be helpful to people. The superintendent went on to say that regulations do state for a religious holiday to fall under the legal guidelines of when you can actually release school it has to serve what is legally referred to as a secular purpose. Meaning, that if you had held school on that date they would expect that there would be low attendance of your student population and or low attendance of your teaching population and it would put a hardship on the school to be able to provide substitutes on those days. Schools really are required, if asked to show how any holiday would serve that secular purpose, how by having school on that day that you would expect low attendance of either students or staff. So, that when we talk about low attendance and serving a secular purpose; they are really referring to the same thing: Low attendance of students or teachers or both. Mrs. Losiewicz said that just to be clear, you want to take it off why? Mrs. O'Neil went on to say she did not even know if it has been definitely proven to be a day of low attendance. Mrs. Hodges explained that it has been a long time, a number of years, since that has occurred in Mansfield, so she really did not think she could give you accurate guidance on it, she would be speculating. Chairman, Michael Trowbridge said that he had googled trying to find that and the only thing he could find was in Holliston in 2007 had 80% out. Mrs. O'Neil said that we were guessing it was a day of low attendance. I am proposing we take it off. Mr. Trowbridge noted that we were guessing based on what history, back with King Philip, that's where it all started. First it started the teachers were not feeling well then it went on from one district to another, so it is something that has happened. Mrs. O'Neil went onto say she was familiar with that and that this is Mansfield and we are choosing to do it, it's up to us to make the decision. Mrs. Losiewicz said that she did not have a problem with it but wanted to say that it does not make it any better for the Jewish Community, so she was not sure that it fixed the problem. We could try it again to find out if there is an issue with attendance. Mrs. O'Neil then said that also given it is the Friday before April vacation. Mrs. Hodges stated that she did not have any statistics or information to guide you there; I don't believe you will have that kind of information unless you have tested the waters there. Mr. Smith asked when we started doing this. Mrs. Miller noted that we had done this before when former superintendent, John Moretti, was here. Mrs. Hodges noted that as a principal, there was one year since she has been here that we went to 16~ school on Good Friday, Mrs. Miller added that there had been significant staff that stayed out and it was very expensive, and that is why we went back to having the day of low attendance. We went back because of the significant cost to the district. Mrs. Hodges said she believed it was a change from the established calendar because of days missed for weather and I believe that Good Friday may have been put in to help out. Mrs. Miller did state that they did try it because of this issue, and it was prohibitively expensive so we went back. Mrs. Hodges did say that there had been a lot of absences. Mrs. Miller said she believed that it it was not the students at that time it was the staff. There was scrambling to get substitutes and she thought it was about 8 — io years ago. Mrs. Losiewicz stated that her biggest concern actually was the fact it was on the Friday before vacation. We could give it ago but if it's the Friday before vacation; Mr. Smith noted that you're going to have a lot of people taking it off. Mrs. Losiewicz noted it would be costly, I just don't know if this is the year to try it, and again I believe it doesn't fix their problem. Mr. Trowbridge said that if we were certain that people would show up for school, at least a high percentage, he would be in favor of it, but history has proven that's not the case. A person from the audience asked to speak and Mr. Trowbridge asked them to come to the microphone although they were not supposed to be taking any questions, we are in the middle of a motion we are not supposed to be taking any questions. The woman at the podium asked if they had the opportunity to vote no, correctly, then this would go back for further discussion, just a question, you have this opportunity? To vote no on this calendar and then this calendar would not exist then you would have to revote on it at a different time. Mr. Trowbridge said yes we could. So if you vote no on this calendar then it does not exist, then you would have to go back to the drawing board, correct? OK Mr. Trowbridge asked the Committee if there was any further discussion and Mr. Smith asked if we were going to be adding days later like half days and stuff so that the calendar is basically a skeleton anyway, and we can change it at anytime we just have to bring it up. Mrs. Hodges said that it would not change the beginning and ending. Mr. Trowbridge said that the holidays are set. Mrs. O'Neil stated that at any time given an extenuating circumstance. The Good Friday one still comes around because in past years we have had so many snow days, parents have said can't we just get rid of Good Friday? Good Friday is the day one is willing to toss out so why not, we're going by secular holidays only so even though it may constitute secular because of low attendance, it's only a guess. Mrs. Losiewicz noted that we have to keep it in mind that their willing to throw it out because they don't honor the holiday but our job is to remember the fiscal responsibility that we have. Mrs. Miller said that this was the piece she was concerned about because she remembered that it was a lot of money and that with all the substitutes there was a lot of scrambling and because of other districts that had done it were having difficulty finding substitutes, it was a costly endeavor. Mr. Smith asked if there were records for that year and if we could go back and look at it and even if it's this year or even next year. Mr. Trowbridge addressed someone in the audience that there was a motion on the floor and we cannot take comments. He then asked the rest of the committee if they wanted to withdraw the motion to ask their question. Mrs. Losiewicz withdrew the motion in order to hear the question but stated that after that, please let us do our job! Even if you don't like what we are doing, please just let us do our job. Mr. Andy Sternberg thanked Mr. Trowbridge for answering his email and Ms. Hodges as well. My question is, you mentioned in consultation with legal counsel, I actually would not support not having Good Friday off. It is important to anyone in the Christian faith in our community; I want to go on record saying that. That does not solve the problem for us —7— because we still do not have our day off, it just punishes other people. I appreciate you Kiera for suggesting that but I would not support that. With respect to legal counsel, hews confused by the fact that we were able to comply with state law in all of the recent years with two days off for Yom Kippur and Rosh Hashanah, so my question is, what specifically did is different from other years. Mr. Trowbridge stated that he would give the most round about answer he can give. Unfortunately I can't give you a direct answer, but certain circumstances that have occurred this year that have asked us to include our counsel on our school calendar, we received guidance and we are going strictly by their guidance. Mr. Trowbridge stated he could not get any further into than that. Mrs. Hodges added that nothing has changed as to the law or meeting legal obligations; we weren't in compliance before nor would any school district, who granted any religious holidays, for purposes other than secular purposes, be in compliance. As communities become more diverse all over our country, schools must look more & more look towards the legal letter of the law on how you establish calendars and these compliance regulations. We were not in Compliance if you looked at the law before. Mrs. Losiewicz then asked where we are. Do we need another motion? Mr. Trowbridge then called for a motion to approve the calendar. Chairman, Mr. Michael Trowbridge called for a motion to approve the 2013 — 2014 School Calendars. A motion was made to approve theist by Mrs. Lisa Losiewicz, 2nd by Mrs. Jean Miller. Mrs. Miller reiterated what Mrs. Hodges had said that this is nothing personal and that we are trying to follow the law. That's our responsibility. It can't be about religion because we are a public school, although it personally pains me to do this, we are following what our legal counsel told us we need to do. Mrs. Losiewicz then stated that she was all for finding out if this was truly a day of low attendance. She just didn't know if this is the year, because it piggybacks a vacation, I want to say, yeah let's do it, but let's do it next year, I think we would increase the amount of people that are absent, because of that. Mrs. O'Neil agreed and felt that people who may not be observing Good Friday, may take it off. Because they can get a cheap air fare flying out on Thursday, so it would not be a true test. Mrs. O'Neil wanted to keep it out there and do some additional research for the following year when it's not the Friday before vacation. Mrs. O'Neil stated that we have this calendar, not as what we want, but what we legally have to do. Motion U. C. 5-0 Mr. Trowbridge said that truthfully, it is not our intent to punish anyone; it is not our intent to be disrespectful to anybody, but that there are certain laws and rules we have to follow and that is what we have gone by.
