He reminded everyone the meeting is being broadcast live and taped for firture broadcast. Martha O'Connell, 270 North Main Street, is present before the Board seeking appointment to a vacated seat on the Keep Mansfield Beautiful Committee. Ms. O'Connell is originally from Walpole and now resides in Mansfield and has six grandchildren in the school system. She would like to give back to the community and noted she became familiar with the Committee from the Adopt A Spot program where she has adopted the island on the corner of Old Colony and Rumsford Avenue. Ms. O'Connell would love to contribute to the revitalization of the Downtown area. Mr. Annino thanked Ms. O'Connell for coming fonxtird as this is such a valuable committee and felt Ms. O'Connell to be a welcome addition. Mr. DelVecchio thanked Ms. O'Connell for applying and noted her enthusiasm for the position is duly noted. Ms. O'Connell felt it is important to encourage the upcoming generations on the importance of volunteering within the community. Mr. Kozlowski also thanked Ms. O'Connell and asked if she was currently working to which she noted she is not. Ms. O'Connell gave a brief work history which included an extensive background in information systems, medical device and banking industries as well as teaching in the Boston Public school system. Mr. Aptowitz was appreciative of Ms. O'Connell applying. Chairman Dentino thanked Ms. O'Connell and noted the Town is always in need of good people. Motion: To approve Martha O'Connell to the Keep Mansfield Beautiful Committee for an unexpired three year term to expire January 1, 2016 (Annino/Kozlowski) PASSES 5:0 Each Selectman submitted to Chairman Dentino their top five goals and objectives for FY15. There was a discussion as to how to rate the submissions as there are some that are of a "30,000 foot view" that Mr. Ross felt are more general and broad topics while others that are specific in nature. It was decided by the Board that Mr. Ross would take the submissions and formalize into defined categories with specific objectives to complete within the fiscal year. Board Of Selectmen's Meeting December 3, 2014 Page I of 6 Jeffrey Churchill, 18 South Main Street (a tenant over Tasty Ray's), is present before the Board and is disappointed with the Board's decision to grant an Entertainment License to Tasty Ray's. Her disappointment stems from the fact there was no notification to the tenants residing at the location and therefore was not given a chance to dispute the issuance of the license. She stated to the Board that given the small space of the venue, lack of soundproofing and use of amplifiers it has made her residence of 11 years unlivable. Ms. Churchill felt the issuance of the license to be illegal based on violation of real estate and elder law. Ms. Churchill stated this is a disruptive situation. Chairman Dentin asked if Mr. Ross could have Building Inspector, Nick Riccio, investigate the situation in regards to the sound. Mr. Ross explained that the terms of the license are for a singer with a guitar to perform one night a week and ending at 9:00pm. He further noted it is a commercially zoned building and to his knowledge there are no laws prohibiting live entertainment in a restaurant in a commercially zoned area. Mr. Annino noted this is a tenant /landlord issue and not an issue for the Board of Selectmen. Ms. Churchill insisted this is a Massachusetts General Law issue to which the Board and Mr. Ross denied. Mr. Ross explained that this is a mixed use building and a license of this nature is acceptable. Mr. Annino reiterated this is a tenant/landlord and for Ms. Churchill to speak with her landlord. Mr. Aptowitz noted it is not normal practice to notify residents when issuing this type of license and will all due respect pointed out that when Ms. Churchill chose to reside /rent at the location she was aware that it is a mixed use building. Mr. Aptowitz agreed with Mr. Arurino that this is a tenant /landlord issue. What bothers Mr. Aptowitz is that there is absolutely no malcontent on the part of the Board when licenses and permits are issued and he takes offense to the tone of Ms. Churchill's accusation. Ms. Churchill stated "not thinking is harming ". Mr. Aptowitz stated that every decision the Board makes as Selectmen not everyone will be happy with and reiterated that it is Ms. Churchill's issue that she chose to reside at a location zoned for mixed use. Mr. Ross explained that if a business meets the requirements for an Entertainment License it is tough for the Board to deny it. Mr. Kozlowski stated that what it comes down to is what is the building zoned for and in this case the location is zoned commercial and mixed use. Mi•. Kozlowski explained to Ms. Churchill that this issue is with her landlord as the license issued by the Board is meeting the requirements. Ms. Churchill compared this evening's solar discussion with residents to hers to which Mr. Annino stated it is a different situation. Mr. Aptowitz explained it is different due to the fact that the Town has to agree to purchase power from the proposed solar facility in order for the facility to be installed. Chairman Dentino advised Ms. Churchill to visit with her landlord as the issue is beyond the Board's responsibility. A. Board of Selectmen Minutes November 19, 2014 B.
