Mr. Broderick has been working with a community planner, a Mr. Peter Wells, in researching cluster zoning by -laws in other towns. Mr. Broderick showed the Commission a plan of a particu- lar development in Westford which he used as an example to MANSFIELD CONSERVATION COMMISSION MONDAY, JANUARY 6, 1986 MINUTES PAGE TWO describe cluster zoning. He pointed out that by clustering the homes on the site, more trees are saved and there is a - balance between the privacy of the -homes and the-natural--- elements of the site. You are able to pull the houses away from the streams, wetlands, aquifers and /or wells more so than in conventional developments. Mr. Broderick also pointed out how you are able to incorporate trails through the clusters for recreational uses not only for the residents of the development, but also for the townspeople in general He recommended Guiding Growth and Change in Massachusetts by the Audubon Society as general reading in favor of cluster zoning. Mr. Broderick said that he had asked the Planning Board and the Board of Selectmen to view the site in Westford and had received support from both groups as far as a by -law for Mansfield. He asked for the Commission's support and input as well. Mr. Broderick said he hoped to be able to have a draft of a by -law ready for presentation at the Board of Selectmen's meeting on Wednesday, January 15, 1986. Acting Chairman Sweet thanked him for his presentation and said that someone from the Commission would probably attend the meeting on the 15th. Wetland Protection Act Hearing - SE211 -150 Brown's Quality Building, Lot 4, Otis Street The Wetland Protection Act Hearing on the Notice of Intent dated December 16, 1985 opened at 8:05 p.m. Mr. Alan Brown was in attendance. Mr. Brown stated that the site is on Otis Street near Sweet's Pond. He pointed out that Lot 4 is away from the pond, but is near a brook on the northeasterly side of the property. He said he would not be filling in any wetlands, but is within 100 feet of the wetlands. The septic system is 90 feet away and there is a culvert another 50 feet away. When asked if there were any problems with the culvert, Mr. Brown stated that he thought the water table was pretty close to what the water level is in the culvert. Commissioner Mahoney asked whether there would be any problem with putting hay bales down the edge matching up with the edge of the leaching field. Mr. Brown stated that he had no problem with putting the hay bales along the edge, but questioned whether they would be necessary. After he was finished filling the property in and building it up, he thought the pitch would blend in with the edge of the wetlands. Acting Chairman Sweet asked if anyone in the audience would like to be heard, at which time Mrs. Joan Doiron of 205 Otis Street asked to be heard. Mrs. Doiron has lived at this address for 22 years and said that during this time she has seen the water from the MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JANUARY 6, 1986 PAGE THREE swamp come right onto her property. She stated that her property -- -- - - -is-lower-than-the-lot in-question,--and-that even - -on a -dry day,- -. - there will be bubbling from the hundred year drain. Mrs. Doiron maintains that there are two springs there. She is concerned that if the land in question is disturbed in any way, she will have more water on her property. She invited members of the Commission to come and walk her property. Mr. Brown stated that he would not be disturbing any wetland area and that, what he was putting in would not effect the water elevations in the neighbor- hood. Acting Chairman Sweet suggested that members of the Com- mission take a look at the property. He advised those present that the Commission would be writing its Orders of Condition on January 27, 1986 and pointed out that the Orders could be appealed to the DEQE within 10 days by any abutter or any ten residents. The hearing closed at 8:24 p.m. All fees have been paid. 5. Letter of December 30, 1985 from DEQE to Garen M. Bresnick, Esq. re File No. SE211 -126 (Javitch) suggesting that the applicant investigate the feasibility of modifying the configuration of the access roadway and thereby minimize wetlands loss for the project. A minor modification could decrease wetlands loss by approximately 5000 square feet. 6. Memorandum of December 30, 1985 from the Town Accountant to all departments regarding the Single Audit Act of 1984. It asked that all departments notify the Town Accountant of all federal funds received or expended. The Commission did not receive any federal monies last year. Wetland Protection Act Hearing - SE211 -149 Susan Brown, Lot 1, Otis Street The Wetland Protection Act Hearing on the Notice of Intent dated December 16, 1985 opened at 8:30 p.m. Mr. Alan Brown was in at- tendance. Mr. Brown stated that this particular lot abuts the road leading into the ball park on Sweet's Pond. This is an existing dirt roadway which is 27 feet from the property. Mr. Brown stated that the leaching field is 75 feet away. Hay bales have been set up to limit siltation. Commissioner Mahoney asked if the driveway would slope to the street. Mr. Brown stated that the back of the land is where it floods and that the flood plan level is 123. He stated that he would be filling in around the house and putting in retaining walls. He stated that the basement floor is at 125.5 and he would probably be putting in floater fuses. Acting Chairman Sweet asked if there were any comments from the audience. A Mr. James Betts of Otis Street in- MANSFIELD CONSERVATION COMMISSION MONDAY, JANUARY 6, 1986 MINUTES PAGE FOUR troduced himself and asked what the waste disposal system was going to be for this house. Mr. Brown replied that it would — - " "- probably be a cesspool, but that that was a- matter to be .taken - up with the Board of Health. Acting Chairman Sweet asked that members of the Commission look at this site prior to writing the Orders of Condition on January 27, 1986. The hearing was closed at 8:42 p.m. All fees have been paid. Wetland Protection Act Hearing - SE211 -152 M. R. Keefe - 252 -258 West Street The Wetland Protection Act Hearing on the Notice of Intent dated December 23, 1985 opened at 8:46 p.m. Mr. Michael Keefe appeared. Mr. Keefe proposes to fill a ponding area which is subject to flooding and is within 100 feet of a wetland. Mr. Keefe pointed out that the property is located on the old West Street which was dead -ended by Route 140. He stated that there is a ponding area in the middle of the property and a running brook on Lot 1 which is an unbuildable lot with one area subject to periodic flooding. Mr. Keefe would like to add 400 yards of fill to fill the sink- hole and to insure positive runoff to the brook. Natural runoff is from West Street to the brook, but the sinkhole is subject to periodic flooding. Hay bales are in place at the edge of the wetland for erosion control. After examining the plans, Acting Chairman Sweet suggested that members of the Commission inspect the site prior to writing the Orders of Condition on January 27, 1986. After an on -site inspection, Commissioner Mahoney noted that there was a pit in the back of Lot 4 which was filled with water at the time of his inspection. Mr. Folkman replied that it was a leaching field that was being excavated at the time Commissioner Mahoney was there. Mr. Folkman stated that it was now filled and there was no water there. Commissioner Mahoney said he also noted that there appeared to be runoff from Lot 8 onto Lot 9 and that there had been quite a bit of water there at the time of his inspection. Mr. Folkman explained that they had MANSFIELD CONSERVATION COMMISSION MONDAY, JANUARY 6, 1986 ,> MINUTES PAGE FIVE been doing some dozer and grading work in that area and that the existing_ftay bales_.may -have been disturbed and may need to be replaced.
