(O'Neill - Barr; all in favor) VOTED Commissioner Sweet will write a letter regarding same. Mr. Michael Keefe - SE211 -152 Re: Project at 252 -258 West Street Mr. Michael Keefe and Mr. David Lukens, the site engineer for the project, appeared before the Commission to discuss the action taken at the Commission's meeting on January 27, 1986 in denying the project. Mr. Sweet explained that during an on- site inspection it was determined that what was being referred to as an isolated area was in fact part of the wetland itself. He stated that during the inspection there was water in the area and that even without much rain there was subsurface water and that the whole area was subject to flooding any- time the brook rose more than a foot or so. He also pointed out that prior to the "isolated" area being filled at some time in the past, it was the Commission's feeling that the entire area was wet. Commissioner Ouellette also had a con- cern with a trough of cement between the two lots that was channeling water down the hill. Discussion was held as to how compensation could be made if the area were to be filled and if it would be necessary to hold another hearing if the plans were changed or if the Commission could simply issue an amended Order of Conditions. It was decided that Commissioner Sweet would check with the DEQE and advise Mr. Keefe before the next meeting. Mr. Keefe questioned whether he could continue to work at the site and he was advised that he could not until Orders were issued. Orders of Condition - SE211 -148 Robert Morrison 1.
