The Wetland Protection Act Hearing on the Notice of Intent dated March 10,
1986 opened at 8:00 p.m. Mr. Robert Turner of Turner Brothers Construction
made the presentation.
Chairman Sweet advised that the DEQE had not assigned a file number to the
project and that the Orders of Condition could not be written until a file
number was assigned.
By way of background, Mr. Turner stated they had filed for their original
permits in August, 1985. At that time, no wetland was delineated on the
plans originally prepared by Mr. Southwick. During the normal course of in-
spections during construction, Scott Leite pointed out that he thought they
might be encroaching on a wetland. At that time, Turner Brothers retained
Hayward - Boynton & Williams who located the wetlands and delineated them on
the new plans. The leaching field serving Building I is within 75 feet of a
wetland and they are asking to move it 75 feet away. In connection with the
field serving Building IV, he stated that after approval of the original plans,
- a series of perk tests were done which- indicated the -water table was such that
the field was raised and a retaining wall was added on the new plan. Chairman
Sweet expressed a concern that this field would be leaching into the wetland
and eventually, the groundwater.
Abutters present at the hearing maintained that the building closest to the
isolated wetland had been built in the middle of a pond. Another abutter,
Mrs. Falotico, who lives at the corner of Erick Road and Stearns Avenue,
stated that she had had to replace her leaching field because of all of the
water in her backyard. The abutters maintained that the area in question was
always a wetland and that the project should never have been approved in the
first place. Chairman Sweet stated that the hearing was limited to the
leaching fields.
Commissioner Barr stated that he would like to have another site inspection
of the project. Chairman Sweet suggested that the hearing be extended to the
31st to allow for another site inspection and the assignment of a file number
