2. Letter from Mr. and Mrs. Owens of 6 Paula Lane officially requesting a
Certificate of Compliance. It was noted that the law states that such
requests must be made in writing, and the 21 -day period for action on such
requests dates from receipt of the written request.
3. Copy of letter from Army Corps of Engineers to Mr. Broderick regarding
Camelot Estates. The letter noted that work has been done on site which
properly falls under Corps jurisdiction. Discussion took place among the
Commissioners regarding the Commission's responsibility with regard to
notification of the Corps. Directions to file with the Corps are included
on the Notice of Intent form. Commissioner Graham noted that a request to
include either a permit or a waiver from the Corps could become
boilerplate on the Order of Conditions. She also noted that Corps
jurisdiction seems to be broader than that of the Wetlands Protection Act;
it doesn't apply to intermittent streams, natural lakes under 10 acres,
isolated wetlands, etc. Commissioner Sweet will write the Army Corps of
Engineers a note requesting additional information pertaining to the
issues raised by this particular matter [of Camelot Estates] as well as
general information regarding the Commission's responsibilities with
regard to the Corps.
Apropos of this discussion, and on general principle, Commissioners
requested that each member of the Board be given a copy of Massachusetts
laws and the regulations pertaining to wetlands. Ten of these will be
ordered, as will five copies of the Environmental Handbook from the MACC.
4. Copy of letter from DEQE to Turner Brothers, file SE211 -158, requesting
additional information including revised site and sewer plans, etc. At a
minimum, it was noted, the current plans do not comply with Title V
regulations.

r from Mr. Wieczorek to DEQE stating that the Conservation
snaed the terms of the Order of Conditions without a public
izi ty. Currivan to Atty. O'Brien regarding file number
that Mr. Franey contact the municipal authorities
ts about the drainage problem, since the culvert in
solaced in service and is maintained by the town.
7. Letter requesting Certificate of Compliance for Lots 20 and 28 Old
Elm St. According the the law, Commissioners need to see a certified
as -built plan, or a written statement that work was completed as ordered
and planned, issued by a qualified person, before the property can be
released. Chairman Sweet will call regarding the as -built plans for this
location.
MOTION: To issue the Certificate of Compliance pending receipt of
as -built plan. (Barr - Ouellette; all in favor) VOTED
The suggestion was made that this law be followed to the letter
henceforth, which would also apply to a certificate of compliance
requested by M. R. Keefe (SE211 -152). Commissioners in general feel that
they are not expert enough to judge elevations and so forth, and must have
confirmation from a professional in the field.
8. Note from Town Manager suggesting that the Commission consider sharing a
conservation agent with the town of Sharon, since they are also
advertising a similar position. Chairman Sweet will follow up this matter
with Sharon officials.
ORDER OF CONDITIONS

DEQE Sign Posting
Commissioner Graham and Chairman Sweet noted that this sign requirement could
become part of all Orders of Conditions, with Commissioner Graham noting that
neither Van Koert Farms nor Green Acres currently have a visibly posted sign.
The decision was made to create a form letter to send out in such cases.
CORRESPONDENCE (continued)
9, Correspondence from Mr. Callinan regarding the Master Plan. IEP Services
has been retained to work on the Master Plan, and Mr. Callinan feels that
with proper planning, the Conservation Commission might be able to use
their services also to work out an Open Space Plan. Commissioner Graham
has information from Conservation Services and will prepare a brief report
for distribution to the Commissioners at a future meeting. A
representative from the Conservation Commission would have to be appointed
to deal with IEP.
At this point, Commissioner Graham expressed a preference for being on the
Water Protection Committee, and in conjunction with this desire, would
like to be relieved of her responsibilities on the Growth Committee, which
she now shares with Commissioner Mahoney.
10, Planning Board minutes of last week regarding Balcom Ridge Estates. An
abutter voiced concern about the drains in the area.
NEW BUSINESS
No new action has been taken regarding filling at Erick Road. Commissioner
Sweet will check with Town Counsel regarding the letter received from Ring,
Grefe, etc, which was read at the June 9th meeting.
Commissioner Mandell suggested officially inviting persons to provide proof of
work which has been done in this problem area. Stearns Avenue residents are
suggesting that the Planning Board rescind the bond for the construction of
Erick Road and its drainage system. Commissioner Ouellette felt that the
Conservation Commission should issue a letter expressing its concerns
regarding this project and requesting that in the process of issuing a new
bond, the project henceforth be required to conform to all current rules and
regulations - including those governing wetland protection - and that the
drainage system be redesigned, with particular attention to the area from
Stearns Ave, up to and including the swamp on the southeasterly side of the
project.
MOTION; To issue such a letter.
