(OUELLETTE - GRAHAM; all in favor) PHILIP BEATTY. SHILOH DRIVE - SE211 -169 MINUTES After receiving the order of conditions issued for file SE211 -169, Mr. Beatty appeared before the commission to state that one of the lots, lot 12, was not owned by him, but by his parents. It was explained that the Order was placed to indicate to any people who might purchase or build on one of the lots in question their responsibility with respect to wetlands. The Orders are valid for three years. MARK AUDET. BIRD ROAD - WETLANDS HEARING CONTINUATION The hearing resumed at 7:53. Mr. Audet presented plans with additional notation about wetlands. Commissioners explained that DEQE has not yet issued a file number, probably because the required signed, stamped blueprint copies of plans have not been submitted. Plans show the closest wetlands 77 feet away from the septic system. Commissioner Barr noted that the contours are shown as requested, but wetlands are shown on a separate, as -built plan. There was discussion as to where the wetlands actually began. There was still no indication of wetlands on either side of the property, and the wetlands vegetation on the sides of the property is of potential concern. There is also a well in question. It was decided that wetlands and elevations must be shown on the septic disposal plan, and on the sides of the lot. MOTION: To meet on August 4. MYLES FRANEY, West St. Mr. Franey appeared before the Commissioners hoping to resolve the problem of water being discharged onto his land since the culvert was unclogged by the Town. He distributed copies of laws of the Commonwealth, as well as copies of case law, relevant to this issue. Commissioners noted that wetlands vegetation in the area is well- established and not new, that the town has the right to maintain the culvert, and that there is an additional issue of a dirt pile on the property which is causing the illegal filling of a wetland. MOTION: To speak with the Town Manager and Engineer, as well as Town Counsel, to determine whether to request that the Church hold off construction. (BARR - OUELLETTE; all in favor) VOTED Mr. Franey maintains that the culvert was abandoned. Commissioner Barr asked whether Air. Franey would be willing to sell to the town for green belt purposes. Mr. Franey mentioned that his son might want to eventually build on that property. Commissioner Ouellette advised that he consult the Commission before anything is built there.
