HomeMy WebLinkAboutConservation Minutes 8/11/1986MANSFIELD CONSERVATION COMMMISSION MINUTES MONDAY, AUGUST 11, 1986 PAGE ONE Members Present: Chairman Sweet, Commissioners Barr, Graham, O'Neill, Ouellette The meeting was called to order at 7:37 p.m. PHILIP BEATTY. SHILOH DRIVE - SE211 -169 In response to the order of conditions issued for file SE211 -169, special condition no. 2 (see minutes, 07- 07 -86), Mr. Beatty appeared before the commission to request the Commission's opinion as to whether a Determination hearing was necessary for lot 6. Mr. Beatty indicated that the plans have changed so that no wetlands will be affected. MOTION: To waive a Determination of Applicability hearing on lot 6, with the understanding that if there are any further changes on the plans (dated July 25), Mr. Beatty will have to bring them before the Commission. (OUELLETTE - O'NEILL; all in favor VOTED The Commission requested that Mr. Beatty submit a copy of the revised plan dated July 25. GRAY'S LOT - CAR PARKING NEAR GREAT WOODS The town has stopped Mr. Gray from parking approximately two hundred cars on his property during performances at Great Woods. The Town Counsel, who will be in court Wednesday morning regarding this issue, has requested a letter from the Commission to support its case against Mr. Gray. Mr. Sweet read aloud a letter which he had drafted, as follows: It has come to our attention that automobiles in large quantity are being parked for performances at the Great Woods Performing Arts Center in close proximity to the Norton Reservoir, this part of which is in Mansfield. A large part of the area of parking lies within 100 feet of and borders the reservoir or its river entrance. Drainage from the area flows directly into the lake. For both of these reasons, the Mansfield Conservation Commission is seriously concerned about this practice and potential violation of the state wetlands laws. The main issue is pollution from runoff of this unpaved parking area, and some erosion has already occurred in the bare areas. If parking is to be permitted, a wetlands hearing must be held and, at a minimum, the area should be paved, provided with oil /water separators, and controls such as berms, etc. should be installed to properly control runoff. Should this violation continue, the Mansfield Conservation Commission has no alternative but to issue a cease and desist order and require that a Notice of Intent be filed. MOTION: To send letter as written. (OUELLETTE - O'NEILL; all in favor) VOTED MANSFIELD CONSERVATION COMMMISSION MINUTES MONDAY, AUGUST 11, 1986 PAGE TWO STEVE BENOIT, WILLIAMS ST. - SE211 -154 Mr. Benoit has requested a release on another Williams St. lot. (' Commissioners will review the site Wed. evening at 6:00, Aug. 13. CLEAN LAKES GUIDELINES Chairman Sweet and Commissioner O'Neill will meet with Gary Bogue on Wednesday morning at 10:00 to discuss the program guidelines. One requirement of the program is public access, which raises some potential difficulties. The deadline for submission is October 1. Letters of support from organizations, individuals, etc. would be included as part of the submission. WETLAND PROTECTION ACT HEARING - File Number not received CWB Contractors, Inc., Plymouth St., Lot 866 The hearing opened at 8:01. A file number has not yet been issued by DEQE, which has requested additional information regarding depth of ground water and delineation of border vegetated wetland within 100 feet of the site. The engineer for Hayward, Boynton and Williams represented CWB, a manufacturer of fiber drums used as bulk packaging. The only change indicated in the latest plans (revision date of 08- 04 -86) were: (1) soil logs - "all wetlands vegetation confined to flowing water in drainage ditch "; (2) one outlet added. There are two detention areas for handling runoff, one in front, and one to the side, which can handle a 25 -year storm. There are also outlets to avoid standing water. No rip rap was shown; some already exists for the whole length from Route 495 to Plymouth St., and this can be added to if necessary. There is piping for the downspouts for roof runoff, which goes into a detention area. There are no catch basins. Commissioner Ouellette asked whether any location for the diesel fuel tank could be considered that would be further away from the drainage area. It was noted by CWB representatives that perhaps there were places closer to the building which could be considered. The tank itself will hold fuel for filling trucks and will be double - walled steel with a fiberglass coating to prevent rusting. Commissioner Ouellette expressed concerns about possible above - ground spilling during the filling process. The pad where the pump is will be on a concrete pad, as will the filling area. The edge of all pavement is bermed to alleviate potential surface spills. Paved swale accommodates runoff; there is no real access for a spill to get to the street. There were no questions from the audience. The hearing was closed at 8:25. Commissioners noted that they have no problems with work proceeding on the site, with the exception of the area within 100 feet of wetlands. The siltation control is already in place. WETLAND PROTECTION ACT HEARING - File Number SE211 -174 Folkman Co., Inc., Maple St, on northerly side Road and utility construction only The hearing opened at 8 :34. Mr. Ralph Maloon, representing the Folkman Company, explained the watershed design process. He noted that the scope of MANSFIELD CONSERVATION COMMMISSION MONDAY, AUGUST 11, 1986 MINUTES PAGE THREE the subdivision has been reduced to avoid any filling of wetlands. Lot 100 is non - buildable and will go back to the family which now owns it. Five lots have been selected and reserved by the Planning Board, for three years, for conservation purposes. The watershed design has three components: 1. Some lots will drain to detention areas. 2. Other lots will drain to a natural hollow (in one case a dam will be put up). 3. One lot has no detention area, but is made up for by overcompensation in other areas. Most land sheds to the west of the ridge shown on the plans; some to the east. Oil /water separators will be used. On the Easton side, because of contours, there is no opportunity to collect, so water will be put into three small retention areas. The original directive was to honor the natural watershed line; however, the position of the Planning Board changed as it became harder to adhere to that condition. The watershed demarcation line shows that the general rule was mostly followed. The detention areas are spread out among property lines, rather than in one large area. There is a discharge into wetland (with a 15" pipe). into catch basin, to reduce flow, with a large drop in elevation. Commissioner Sweet raised the possibility of using a channel, with a wier at the top, instead of a pipe, to spread the flow out, noting that drains become clogged with vegetation and cease functioning. Mr. Maloon responded that he had considered this possibility, but maintained that because of the need for verifiable numbers regarding water flow, this alternative was not selected. Commissioner O'Neill raised the question of securing written permission from the landowners for a drainage easement, or a letter stating the owner's awareness of the drainage plan, in order to avoid future difficulties. Mr. Folkman noted that when the Order of Conditions is written, the siltation control should be indicated. In some areas, in addition to hay bales, a no -work line could be marked. On steep banks, storm fence with hay bales uphill could be used. A suggestion was made to use a continuous ribbon, perhaps color- coded, to mark no -work areas for heavy equipment operators. Mr. Folkman offered to return on the night the Commission writes orders for this file, to help with the markers, due to the complexity of the plans. The hearing closed at 9:24. WETLAND PROTECTION ACT HEARING - File Number not received Nicholas C. Harris Balcom Street The hearing opened at 9 :30. DEQE has requested additional information and therefore has not yet issued a file number. According to Mr. Harris' representative, the botanist's report included with the Notice of Intent states that there are no wetlands affected. Detention areas are shown on plans; there is no outflow. There are depressed areas, shown on lots 17 and 18. The center line of the road is staked. MANSFIELD CONSERVATION COMMMISSION MINUTES MONDAY, AUGUST 11, 1986 PAGE FOU$' Commissioners reviewed the botanist's report. The Commission requested a set of plans with the latest revision date. Abutters Bill Lewis and Pat Gagnon of Plantingfield Road expressed their concerns about water flow from the high to low points, which at times constitutes a stream. The Commissioners will walk the site at Saturday morning, 9:00 a.m., August 16, beginning at the Balcom St. end. The hearing closed at 9 :59. MANSFIELD ASSOCIATES REALTY TRUST - Preliminary meeting on new plans for File SE211 -161 Mr. Malcom Post appeared before the Commission to present preliminary plans (i.e., not stamped plans) which would address the Commission's concerns for Lot 2 on Erick Road. The delineation of the wetlands has been changed and is now more in agreement with the Commission's and DEQE's view of the wetlands. A retaining wall has been placed at the rear corner of the lot, and the septic system has been moved. Drainage will be handled by street catch basins. The Commission needs construction details on Lot 2 and the drainage proposal because these had originally been filed together. A full set of road and drainage calculations will be filed. Commissioner Ouellette indicated that the agreed -upon wetlands should be marked on the stamped plans. She noted that there is now one entrance on the road, no longer a common entrance for lots 2 and 3. A railroad tie retaining wall for the leaching system was indicated at elevation 147 to 143; this is also the "no- work" line recommended by DEQE representative Joel Hartley. No wetlands are being filled according to the new plans presented, though work is being done within the 100 -foot buffer zone. Ms. Connie Pietrafetta, an abutter, raised questions regarding the retaining wall as a solution to a water problem. No construction details were available regarding this wall, but it was noted that it would have to be stronger than an existing wall referred to by Ms. Pietrafetta, because it will be holding back earth. Representatives of Mansfield Associates Realty Trust declined to answer further questions from the audience. Commissioner Ouellette noted that the retaining wall was necessary because there wasn't enough room to grade the earth. She noted that elevation numbers should be one the stamped plans. There were no further questions. [Commissioner Graham left at 10 :41.] ORDER OF CONDITIONS - File SE211 -173 Cabot, Cabot & Forbes 1.
