HomeMy WebLinkAboutConservation Minutes 9/8/1986MANSFIELD CONSERVATION COMMMISSION MONDAY, SEPTEMBER 8, 1986 Members Present: Chairman Sweet, Ouellette The meeting was called to order at 7:42. TIM BOSWELL MINUTES PAGE ONE O'Neill, Mr. Boswell appeared in order to discuss his filling of a pond behind his home on Elm St. According to Mr. Boswell, this pond was the result of his excavation, fifteen years ago, of a natural bowl which was always wet and which contained a large amount of peat. About one quarter of the pond has been filled; a neighbor called the Commission regarding the work. Commissioner Sweet suggested that he have DEQE look at it; were Mr. Boswell to file a Notice of Intent for the work, the Commissioners in general felt they would have to deny it. The Commission will wait to hear DEQE's opinion as to what should be done; in the meantime, no work can be done in the area. DETERMINATION OF APLICABILITY: Applicant: The Folkman Company Location of Project: 239 Winter Street Purpose of Project: Excavation of foundation holes, pouring of garage foundation, backfilling and grading of foundation, construction of garage, loam and seed of disturbed areas. The meeting opened at 8:08 p.m. Mr. Ralph Maloon of Rim Engineering represented the Folkman Co. The septic system is shown in front of the house. A garage is proposed. Commissioners, who walked the site on Wednesday, Sept. 3, asked whether the driveway will be moved, as they recalled the driveway being parallel to the lot line. They also mentioned that a hay bale barrier will be needed, because work will be done within the 50'ft. limit; however, due to the grade, runoff would have to go uphill to affect the wetlands. MOTION: To issue a negative determination, with the added notation as follows: Siltation devices shall be installed to prevent pollution of wetlands; work is to be done no closer to wetlands than plans indicate, or a return before the Commission will be necessary; and no work shall be done beyond or above the present natural ridge which exists between the proposed grading and the wetland area. (0'NEILL - MANDELL; Barr abstained) VOTED ORDER OF CONDITIONS: Kenneth I, and Patricia A. Blackman - SE211 -171 1. Hay bales shall be placed along front of existing stone wall to prevent siltation of wetlands. 2. A "no work" area limit shall be staked on the property 10 feet on the street side of the stone wall. No grading or alteration shall occur beyond this line. 3. The applicant will submit revised plan combining information on both plans now on file and showing driveway detail in addition. MANSFIELD CONSERVATION COkMKISSION MONDAY, SEPTEMBER 8, 1986 MINUTES PAGE TWO 4. The sign required by General Condition 9 shall be visible from and next to the road and shall not be nailed to a tree. No work shall be done until the sign is posted. 5. Any changes to plans made by any other boards shall necessitate a review by the Commission. MOTION: To issue the Order as written by Chairman Sweet. (OUELLETTE - O'NEILL; Barr opposed) VOTED Commissioner Barr was against issuing this Order because of soil limitations of the area and because of a pond lying within 100 feet of a dwelling. TREETOPS SUBDIVISION Representative Ralph Maloon came before the Commission to seek its opinions, before filing the Notice of Intent. The subdivision will be on sewer; a few homes at the extremities will have to be pumped to the sewer lines. There is a large storage area capacity in the existing wetlands, which already constitutes a large natural retention area. Mr. Maloon proposed lowering it three feet to create a small ponding area. Chairman Sweet stated his opinion that if a pond will be made, it might as well be a real pond which can be aesthetically pleasing. The Commission noted that construction details should be included in the filing. ORDER OF CONDITIONS, The Folkman Co., Inc., Maple St. - File SE211 -174 A letter from Mr. Bonvie regarding the drainage waiver was read, and will be placed in the file. Chairman Sweet will request the Town Counsel's opinion as to the legal validity of the letter. (O'NEILL; not seconded) Commissioners noted that the results of the site walk on Wed., Sept. 3 were that conditions were as indicated on the plans. 1. All graded slopes into wetlands shall be planted with suitable quick - growing vegetation and be protected from degradation and gullying by the use of biodegradable filter fabric. 2. With reference to sheet 13 of 20, revision of June 9, 1986, the limit -of- construction line shall be visibly marked on site and remain in place until the certificate of compliance has been issued. 3. Any lot within 100 feet of wetlands shall be submitted for a preliminary review of applicability. 4. The applicable plans are dated Feb. 12, 1986 and revised June 9, 1986, except for sheet 14, revised Aug. 25, 1986. 5.
