File SE211 -57 - Wind Chimes. Building is taking place in a very wet
area. This project is under a Superseding Order of Conditions issued by
DEQE. File SE211 -137 covers only lot 3, and it was the opinion of some of the
Commissioners that lot 3 was not the lot in question. The order issued Sept.
'85 allowed filling of 2300 square feet, with appropriate siltation controls.
Commissioner Mandell will take the plans and verify the locus; he will also
call Mr. Folkman, the developer and ask about the Order of Conditions.
Conservation Agent. Mr. Roger Laferriere was interviewed on Friday,
September 5; Mr. Lewis and Ms. Graf will be interviewed on Tuesday, Sept. 16.
Legality of Mr. Bonvie's letter re Massapoag Estates. The letter from Mr.
Bonvie (releasing the Conservation Commission from responsibility regarding
drainage resulting from the development of this property) at very least would
have to be notarized, according to Town Counsel. A legal document will be
drafted by the Town Counsel.
Mr. Tim Boswell, Elm Street. Chairman Sweet spoke with Mr. Gary Makuch of
DEQE, who opposed filling of the pond in question and advocated removing the
fill. A pond is subject to protection when vegetation is established.
MOTION: That Chairman Sweet discuss with Tim Boswell the opinion of
DEQE and the Commission regarding his filling of the pond.
(0'NEILL - OUELLETTE; all in favor) VOTED
Erick Road. Aerial photographs will be taken of the area, according to
Mr. Gary Makuch of DEQE, who said that in all likelihood the project will be
denied. The case regarding Lot 3 has been turned over to the Attorney
General's office. The developer does not meet Title V, and water pollution
controls have become involved. Lot 4 is also involved. Commissioners hope to
meet with DEQE, the Attorney General's office, Army Corps staff, Water
Pollution staff, and Town Counsel to discuss the matter.
Site plan reviews. It was determined that the following plans would not
require a filing before the Commission:
East Street (rear of Wallpaper City)
28 Court Street (Plan B)
28 Court Street (Plan A)
North Main Street site - Planning Bd. memo of 9/15
Clean Lakes Program. The deadline for submission of a formal application
is October 1. Filing an application would begin the official process of
requesting a feasibility study, the cost of which would be around
$50,000- 60,000 (70% paid for). The program would last about three years.
Blake's and Robinson's Ponds present problems, since there is no town -owned
