1. Notification from DEQE of an on -site inspection relative to the appeal of
the positive determination of applicability for the Balcom Ridge project
(Wed., Nov. 5, 11:30, Elizabeth Koulaheras).
2. Notification from DEQE of an on -site inspection relative to a request for
a Certificate of Compliance on File SE211 -57 (Wed., Nov. 5, 1:30,
Elizabeth Koulaheras).
3. MACC memorandum outlining their outreach services in the form of informal
meetings. The consensus of the Commission was that an agenda for such a
meeting should be developed, and then the meeting be held.
4. Brochure outlining Falmouth's wetlands regulations - Dick Lewis offered
this as a sample of one way in which the public could be informed.
5. Letter from Peter O'Brien, attorney for ABC Trust, responding to request
for state permission to fill the culvert. A copy of the state form
granting permission for a curb cut was enclosed.
MOTION: To request that ABC Trust file a Notice of Intent, including
plans showing ditches, drainage, and contours as they existed
prior to the work in progress as well as in their current state.

-- The grading of lot 32 has not been completed.
-- A road has been bulldozed through wetlands. This work was not

Lots 4 -10 all have some wetlands on them and will require a wetland review
before being built on. Questions were raised about whether small, separate
filings could be regarded as a single wetland resource for the purposes of
filling the 5000 square feet permitted by the regulations. Commissioners will
consult DEQE for clarification on this point.
HATHEWAY AND PATTERSON
Commissioner Ouellette indicated her desire to request the company's plans
for monitoring and suggested that this be included in any Order of
Conditions. Any plans for repair of the man -made waterfall could also be
requested. There are no wet processes involved in the facility under review.
Commissioner Barr will check to see what chemicals are being used; Dick Lewis
will then follow up as to any questions of safety, use and location of such
chemicals.
CLEAN LAKES
Additional information has been submitted to accompany the Clean Lakes
application. Indicating an intent to create a dirt boat ramp would be worth
more points in the application.
MOTION: To locate a dirt boat ramp leading into Sweet's Pond, on the
Little League parcel, while work is in progress on the cleanup
of the pond.
(OUELLETTE - BARR; all in favor) VOTED
CAMERA
MOTION: To purchase a Polaroid camera as well as film for both a Polaroid and
35 mm camera.
(MANDELL - O'NEILL; all in favor) VOTED
Commissioner Ouellette will determine where the camera can best be bought and
what the model and price will be.
ISSUES RAISED BY CONSERVATION AGENT RICHARD LEWIS
-- Dick will be meeting with Marydee Flynn about the potential land
transfer of about 80 acres from the 495 project.
-- He has already met with Chairman Sweet and Brian Dolan to discuss an
Open Space plan as a component of the Master Plan; he will talk with Paul
Split and begin putting together an Open Space plan, which is essential for
funding. Much inventory material already exists.
-- The warrant closes some time in January for articles; Dick has looked
into previously proposed by -laws and will use them to write a draft.
-- He raised the idea of a comprehensive order of conditions established
by some communities and will review such comprehensive orders with the idea of
developing a list of special conditions which could be used by the Commission.
-- He proposed the idea of a map showing where in the town various
projects are taking place.

NEW BUSINESS
-- Discussion took place on the idea of getting aerial pictures of the
whole town. It was noted that the season and year would have to be specified
for any given picture desired.
-- Commissioner Mandell raised the possibility of securing a couple of
acres, as part of the Green Belt, which abut York Conservation land on Ware
St. The owner of the land is Mrs. Larsen.
-- Status of Erick Road File SB211 -161: the appeal on this file has not
been withdrawn, according to Chairman Sweet; therefore, rather than issue an
Order of Conditions, the Commission will write recommendations to DEQE.
-- While on the Nov. 1 site walks, Commissioners noticed a foundation
behind Mrs. Sandra Franey's house. She told Commissioners Ouellette and
O'Neill that she would be coming before the Commission.
MOTION: To send a letter to the present owner of lot 3 on Old Elm St.
on which the foundation is being constructed, requesting an
explanation.
(OUELLETTE - MANDELL; Graham abstaining) VOTED
MOTION: To meet on November 17 for a work session. VOTED
(OUELLETTE - BARR; all in favor)
[Commissioner Graham left at 10:54.]
HOPE STREET LOTS 237 -246
There is a 98 ft. frontage on Lot 3; during the site walk the possibility
was discussed of moving the driveway to avoid filling any wetlands. The
applicants would need time to return to Dunn Engineering for plans. Lots 1
and 2 would be moved over to accommodate the driveway on the southerly side
and avoid wetlands filling.
HOPE STREET LOTS 25 -30
Commissioner Ouellette discussed the plans with the Town Engineer, a
Planning Board member and the Planning Director. In their minds, the wetland
in one area was not appropriate frontage. In addition, an alternative access
to buildable land is available via a Kingman Avenue right of way. Kingman
Avenue has been taken by the town but not accepted by the town. Commissioner
Ouellette suggested that it was appropriate to deny filling of wetlands in
this case because an alternative exists. Before Orders are written, more
information is needed from town officials about their views as to whether the
right of way on Kingman Avenue is a legally viable alternative.
The meeting adjourned at 11:30 p.m.
