E (Mandell - Graham; all in favor) CAMELOT ESTATES - File SE211 -138 Representatives for developers who have purchased lots 4 - 11 in Camelot Estates appeared before the board, as requested by the Certificate of Compliance issued for File SE211 -138. Lot 11 is owned by the Broderick Corporation; plans show a 26 x 38' house with a garage 142 feet from wetlands. Grading to 30 feet beyond the house will still be outside of any wetland areas. Plans for buildings on lots 9 and 10, presented by Mr. Trowbridge on behalf of Kevin Delaney, were shown 165 feet and 187 feet from the wetlands, respectively. The closest houses were 41 and 43 feet from wetlands, and hay bales were proposed as siltation control. Commissioners had some questions about buildings on lots 5 and 6 and will look at the site. MOTION: To release lots 4, 7, 8, 9, 10, and 11. (Graham - Ouellette; all in favor, Smith and Barr abstaining) VOTED The letter of release shall state that hay bales shall be placed according to the plans presented on December 8, 1986 for review. DETERMINATION OF APPLICABILITY: Applicant: Mr. Samuel Talavera Location of Project: 561 -563 Ware St. Mr. Talaverais proposing to replace an existing failed septic system. A large amount of fill will be placed on the site to raise the leaching field, and a dual alternating pump system will be installed. This project was reviewed for the Board of Health by DEQE and was approved. The Board of Health granted a waiver, as the system will be within 51 feet of wetlands and would therefore comply with state but not town regulations. MOTION: To make a negative determination no. 3, with the condition . that siltation controls be in place according to the plans submitted and that a copy of the waiver granted by the Board of Health be submitted to the Commission. (Graham - Ouellette; Barr opposed) VOTED WETLANDS PROTECTION ACT HEARING. Applicant: Sandra Franey Location of Project: Old Elm /School Street, Map 6, Parcel 57 Purpose of Project: Proposed work impacting land under water bodies and waterways Abutters present: Karen Carpenter, 223 Old Elm St. This project proposes to relocate part of a brook (mosquito control ditch) and to construct a 24 x 32 foot barn for the purposes of keeping horses. Ten MANSFIELD CONSERVATION GUIZIMISSION MINUTES MONDAY, DECEMBER 8, 1986 PAGE TkD and 100- year,jt9;mcalculations were included in the plan. No zoning variance is required, or};the; -barn. The lot is 15,000 square feet; 840 square feet of ,,,the brook wi 3'be x6located. There are no driveways proposed. The relocated _ 1 'brook .would have atgtavel base with loamed and seeded 4 -ft. sloping sides. Some Commissiot0is have already reviewed this site. Commissioner Graham will. coptact the, mosquito control authorities about any potential difficulties with relocatngtfe ditch. Commissioners Barr and Mandell will look at the site. Karen Carpenter asked what constituted a wetland, since there were certain depressed areas on the property which seemed to hold water after periods of rain, and since much of the area is so close to the brook. It was explained that about 10,000 square feet of land is within the buffer zone. None of the land falls within the 100 -year storm; it may be isolated land subject to flooding or bordering vegetated wetland. She also voiced concerns about whether the property would in fact remain a barn; Ms. Franey maintained that there were no plans to do anything other than keep two horses there. The hearing closed at 9:10. WETLANDS PROTECTION ACT HEARING. Applicant: Robert Brugliera Location of Project: Lot 166, Dean Street Purpose of Project. Construction of single family dwelling within bordering vegetative wetlands and 100 foot discretionary buffer zone The hearing opened at 9.15. Mr. John Parmentier of Dunn Engineering described the site as a "borderline" wetland near Kingman Pond, with shallow groundwater (approximately 2 1/2 feet), with coarse and bony gravel present, and not directly connected to a channel or stream that flows. At the moment, a crushed stone driveway is proposed for the site. The distance from the corner of the proposed house to the edge of the pond is 100 feet. The area to be disturbed, according to Mr. Parmentier, will be compensated for by an area of about 2200 square feet; filling is proposed for the foundation area, which will be a slab. The house will be on town sewer, water, with gas service. Minor grading around the house is proposed. Commissioner Barr asked about the brook which runs between the pond and this lot. Commissioner Ouellette added that a well- defined drainage ditch can be seen two lots away. Mr. Parmentier was unaware of the brook. The applicants requested a decision tonight if possible so construction can begin before the ground freezes. It was noted that the Commission would first need to walk the site, and would do so on Saturday, Dec. 14, at 9:00 a.m. (and would then proceed to review lots 5 and 6 at Camelot Estates). MOTION: To close the hearing at 9:32. (O'Neill - Ouellette; all in favor) DECEMBER MEETING TIMES VOTED The Commission decided to meet on December 15 if space were available, and to cancel the regularly scheduled December 22 meeting. Chairman Sweet read the letter which he had drafted, for the approval of the Commission. MOTION: To send as written. (Mandell - O'Neill; all in favor) VOTED ORDER OF CONDITIONS - Erick Rd. /Bonney Lane - File SE211 -180 Commissioners were divided over the issue of whether an Order of Conditions could be issued on this file, since part of the work was originally included in a previous filing (161) which is currently under appeal with DEQE. MOTION. To write Order of Conditions at next week's meeting, after further information is obtained from DEQE. (O'Neill - Mandell; all in favor) VOTED ORDER OF CONDITIONS - File SE211 -182 Keith Properties Inc., Francis Avenue Commissioners raised questions of possible discrepancies regarding certain wetlands areas shown on the plans submitted vs. plans originally done by Merrikan Associates for a Foxboro Terminals proposal for the same area. Mr. Phil Corbett, project manager for Keith Properties, felt that Gale Engineering's botanist would not agree with the conservative delineation done for Foxboro Terminals; some Commissioners felt the truth may well lie between the two plans and would like work to be delayed in several areas to allow the Commission a final review of the area. Consequently, orders were written as follows: 1. Project shall be built according to plan except that no work shall be done on building no. 3 or the related parking lots, or on the easterly side of building 3, or on the pool area behind building 9, until the Commission I makes a complete assessment of these areas. 2. Appropriate siltation controls shall be in place, subject to review by the Conservation Agent. 3. Drainage system as specified by plans for that area shall be in and functioning prior to construction of any building. 4. The sign required by General Condition 9 shall be visible from and next to the road and shall not be nailed to a tree. No work shall be done until the sign is posted.
