whole area comes under "severe wetness" soil limitation for homesites.
Commissioner Mandell. added that he found the area significantly wetter this
time than on a previous site walk. Chairman Sweet agreed that the amount of
water was a significant drawback.
MOTION: To deny because of the Commission's consensus that the lot is not
buildable because of the large amount of wetlands.

Erick Rd. Bonney Lane, Mansfield Associates Realty Trust
Dick Lewis contacted Gary Makuch at DEQE. The orders can be written for
this area despite the matter still in appeal with DEQE. However, Mr. Makuch
noted that DEQE would have problems with the detention basin proposed, since
it is poorly designed and might not function. In addition, it is located
within the edge of a vegetated wetland. The size is adequate but would
probably not detain water, since a detention basin can only function properly
if the inlet and outlet are at different elevations.
Discussion took place about the possibility of requesting testing in the
area for septic system contaminants and potential pollutants, to ensure that
the wetlands will not be negatively impacted. No decision was taken at this
time. Orders were written as follows:
1. Work shall be done per most recent plans presented at hearing on 11/24186.
2. The drainage ditch from Bonney Lane to easterly property line shall be
cleaned, properly graded and rip- rapped, bottom and sides.
3. Oil /water separators and the entire drainage system shall be properly
maintained by the developer until the road is accepted by the town.
4. A plan and schedule of construction as well as cleaning procedure shall be
submitted fourteen (14) days prior to beginning of construction.
5. There shall be no stockpiling of excavated materials within 100 feet of
wetlands.
6. The stream bed shall be excavated down to gravel. The detention basin
sides shall be loamed to final grade and then seeded. A plan for
replacement of wetlands vegetation shall be presented to the Commission.
7. Appropriate siltation controls shall be in place prior to construction and
shall remain until the drainage system is functioning or until permission
to remove it is granted by the Commission or its Agent.
8. The sign required by General Condition 9 shall be visible from and next to
the road and shall not be nailed to a tree. No work shall be done until
the sign is posted.
9. Any changes to plans made by any other boards shall necessitate a review
by the Commission.
MOTION: To issue as written.
