(MANDELL - OUELLETTE; all in favor, Smith abstaining) VOTED TRANSFER OF LAND 495/140 Dick Lewis spoke about the transfer of about 88 acres from the State to the Town in the area of Routes 495 and 140. The Parcel on the north(east) side presents no access problems; the State has promised to provide access by means of a foot bridge for the other parcels. The State requires a plot plan. Greta Bohannon, who did the transfer for the Housing Authority, is familiar with the regulations and has some of the work already in hand. At least two other estimates of the cost of this preliminary work must be obtained; Dick estimates that about $700 for the parcel on the north side, and about $1600 for the other side will have to be spent from the land acquisition account. "BOILERPLATE" ORDERS OF CONDITIONS Dick Lewis presented a list of potential "Special Conditions" to be used as a reference for the writing of Orders of Conditions. Commission members were asked to prepare comments by the next Commission meeting. ASSEMBLY OF GOD /FRANEY - WEST STREET Dick Lewis updated the Commission about the continuing problem between the Assembly of God Church, the Town, and Myles Franey regarding drainage issues on West Street. The DPW has put a concrete headwall in place. The culvert was replaced by the Assembly of God Church, but the Town had to install another, because the Church ran into a gas line. 'According to Dick, the Town Manager and Town Engineer feel that the Commission may have been mistaken in allowing the Church construction to cause water to flow onto Mr. Franey's property. The Town Manager would like to set up a meeting between Commissioners, the DPW, and the Town Engineer to work things out; one solution offered would be to drain the water. Commissioners did not agree totally with town officials' assessment of these issues, noting that draining the water would also be draining a wetland. Since an important factor in the dispute revolves around the question of whether Mr. Franey's lots are buildable, Commissioners decided to look further at the property, documenting problem areas with photographs. The Commission will discuss the results of walking the site at their next meeting, on Jan. 26. TRASH -TO- ENERGY PLANT - Along with other town officials, Commissioner Ouellette will visit an operating trash -to- energy facility in Oswego, NY. CORRESPONDENCE 1. Dick will consult the Town Counsel about the status of the Cease and Desist Orders issued regarding work done in this area. Commissioners also questioned whether the original orders could be amended in light of having received new information. LIBRARY PLANS Municipal Building Committee members and Dinah Amsden, Library Director, presented plans for the new library, which _propose the relocation of a drainage ditch closer to the town's property line.
