WETLAND PROTECTION ACT HEARING
The Folkman Co. Town of Mansfield - -in the area of 610 Ware Street --
Installation of leaching catch basins and drainage pipes
Paul Folkman explained that a long- standing drainage problem in this area
has been aggravated by filling and site work done by his company. He
participated with Mr. Rhind and Mr. Campo in devising a plan to improve
drainage in the area. Mr. Folkman has offered machine time and labour; the
Town will supply materials. The plan proposes a leaching system comprised of
two leaching basins, and perforated pvc discharge pipes, set in stone, to a
portion of the remaining drainage ditch. Mr. Folkman requested that the
hearing not be closed, because key abutters to the project, whose permission
is required in order to carry out the work, were unable to attend. Work would
take place over a period of two to three days.
Mr. Bob Bradford, of 21 Wind Chime Drive, asked about plans to restore the
drainage ditch between lots on Wind Chime. Mr. Folkman answered that plans
only applied to the area from lot 25 down, the ones which were disturbed by
the Folkman Co. Mr. Brendon Kylie, also of Wind Chime Drive, advocated
cleaning the ditch out, since it currently is clogged. Mr. Folkman stated
that increasing the size of the project would have to be negotiated between
the Town and himself. Mr. Tony D'Urbano proposed running the pipe in the
opposite direction, as he, too, was at one time promised action by the Town;
this suggestion, he maintained, would solve two drainage problems at once.
Mr. Folkman, Dick Lewis, and John Rhind will pursue the various options and
will have additional answers by the next meeting. Mr. D'Urbano asked whether
any soil tests have been done to see if the proposed leaching system will
function. Mr. Folkman answered that they had not, and that in fact the soil
was "not too good" in the area and might not function. Mr. John Harrington of
630 Ware St. suggested that he doesn't see any ditch behind his property, but
that water pools at the corner of his lot; Mr. Folkman answered that DEQE has
also requested that the ditch be better defined.
MOTION: To continue the hearing to October 19.
(O'NEILL- OUELLETTE; all in favor) VOTED
ASSEMBLY OF GOD - SE211 -156
Rev. Hans Theerman appeared before the Commission in response to a letter
from Dick Lewis. He presented a timetable for completing the project.
Chairman Sweet reiterated that the detention basin should be functioning
before the completion of the paving and finishing work. Rev. Theerman
explained that Dunn Engineering will do an as -built plan to ascertain whether
the system was operable;' he stated that the engineers had assured him in May
1986 that that it would function given the work done by the Town.
Commissioner Mandell felt that abutters should be notified when new plans are
discussed. Commissioner Ouellette suggested checking with Town Counsel about
the need for a new hearing and an Amended Order of Conditions.

MONDAY, SEPTEMBER 28, 1987 PAGE THREE
Rev, Theerman explained that the Town had originally intervened in the
iproject, saying that they would take care of Air. Franey's drainage problem if
the Church would put in a pipe. However, the work met with difficulty in the
form of a gas line, The work done by the Town was not reviewed by the
Commission,
Dick Lewis explained that the Town officials and the Commission need to
see Dunn Engineering's as -built before anything else is done, since it is not
obvious or certain that the basin is correctly designed and constructed. Dick
will stay on top of this situation; the Commission wants to review the new
plan /as -built at its next meeting on Oct. 19.

MOTION: To accept the minutes of Sept. 21 with corrections (not including

REQUESTS FOR CERTIFICATES OF COMPLIANCE- -File SE211 -134
A release of lots 13 and 15 has been requested, Ralph Maloon has
indicated that grading and seeding will be done, but it has not been done
yet. The Commission requested that Dick inform the applicant that the
Certificate will not be issued until the work is done,
RELEASE ISSUED TO CONDYNE, File SE211 -146
It appears that the as -built supplied by Condyne for the Certificate of
Compliance issued in April 1987 may not have been accurate. The whole project
has in fact not been built, but the certificate released the entire project.
Dick will call Ralph Maloon and the project engineer to clarify this matter,
MOTION: To ask Dick Lewis to request of Town Counsel and of DEQE the
appropriate avenues to pursue regarding problems with an engineer's
plans,
