Barr, Graham, Mande Al Ouellette The meeting was called to order at 8:18 p.m. ' 15 WETLAND PROTECTION ACT HEARING t Applicant: Walmark Corporation `q',A [,, ? , Location of Project: 18, 22, 26, 30, 38, 42 and 46 Potash Road (Lots 5 -12) Purpose of Project:,. Construction of single ,.family ,dwellings, site construction, yard grading ;within the 100 foot discretionary buffer zone The Order of Conditions issued in 1985 under file SE211 -140 for Van Koert Farms requested the developer to return should, any work on particular lots encroach upon wetlands or the 100 foot buffer zone., Mr. Parmentier of Dunn Engineering presented plans showing the location of the buffer zone relative to proposed houses and lots. Mr. Parmentier has flagged the wetlands <, perimeter. Siltation controls and /or fences are proposed downslope of any activity on lots 6, 7, 8 and 9; no work is being proposed within the buffer zone on lot 11, but it also is being protected because of its proximity to the buffer zone. The lots are approximately 600 feet away, from town wells. The 100 year flood line, according to Mr. Parmentier, is approximately the same as the wetlands perimeter. The edge of the buffer zone is around elevation 1251; some house lots are shown at elevation 150 -160`, indicating steep slopes. With a view towards establishing a green belt along the river, Chairman Sweet and Commissioner Graham asked if the wet area could be deeded to the town,, ensuring that it would be better protected than if owned by individual homeowners who might not be fully aware of the restrictions on wetlands. However, Mr. Parmentier made no positive response to this suggestion. Commissioner Mandell asked why houses on the lots in question were not set closer to the road, reducing the impact on the wetlands. Mr. Parmentier responded that the plans were drawn up to save as many trees as possible. Chairman Sweet closed the hearing at 8:58, noting that if at all possible the Commission would walk the site before issuing an Order of Conditions. The applicant will be notified if and when a site walk is planned. WETLAND PROTECTION ACT HEARING Applicant: Fralo Corporation Location of Project: King Arthur Way Purpose of Project: Construction of single family dwellings on lots with bordering vegetated wetland Mr. Dave Welch of Fralo Corporation requested that the hearing be continued to March 9 at 8:00 since Mr. Trowbridge could not be present. WETLAND PROTECTION ACT HEARING Applicant: The Broderick Corporation Location of Project: Between West, Williams, and Gilbert Streets Purpose of Project: Construction of roadway through existing wetland; construction of drainage outlets in existing wetland Mr. Broderick presented plans for the Forest Park subdivision, located in a water protection district in West Mansfield. There are 150 lots, 4 of which will be dedicated to open space, whether or not the Town buys them; they are buildable lots. Mr. Broderick hopes that covenants on the land and perhaps an 'IIl i MANSFIELD CONSERVATION COMM1,1ISSION MINUTES TUESDAY, FEBRUARY 17, 1987 PAGE TWO association of residents will govern environmental issues such as pesticide use. The Notice of Intent for which this hearing is held is for work on the roadway and drainage in wetlands areas. The whole project will be phased over a period of 6 -7 years. The roadway and drainage are part of Phase 1. Mr. Maloon of Rim Engineering presented pre- and post - construction calculations to' show <that the runoff will not increase. Water will be shed into wetlands for the most part. Water /oil' separators and hay bales are indicated, and the method of construction is described in the plans. A head wall shown will require that the area be pumped while concrete is poured; Dick Lewis questioned whether the functioning of the wetland would be more 'affected by the construction of this wall than the plans indicated; according to Mr. Maloon, this is the type of wall recommended by the Town Engineer. 'Hay bales will remain until the road has a base coat and until ground cover is in. One model home will be 'constructed (on 'lot 68 or 69) prior to the finishing of the base` coat. The planning board will allow trees to remain in the right of way. Wetlands have been 'flagged and numbered by Sanford Ecological Services. A compensation area of 1050 square feet is proposed for one area where the road will cross a "finger" of 'wetland." No excavation is needed; since the area is essentially the same elevation with the same contour,` it is hoped that introducing wetlands species into the area will bring the wetlands vegetation to the 50 percent criterion. Mr. 'Broderick requested that any Order of Conditions written for this property specifically address only the work included in the current Notice of Intent, i.e., the roadway and drainage. He mentioned the difficulty of 'having to return for Certificate of Compliance on each of the 150 lots, should the Orders be written to include the lots. He will develop a list of three types of 'lots:' 'those which have no wetlands, those in which construction' might impact wetlands, and those in which 'construction will 'definitely impact wetlands. He 'felt that the entire development need not be encumbered to guarantee that the job be completed in a desirable way. The idea of voluntary bonding was proposed as a way of guaranteeing that the work be done, without encumbering all of the lots as part of the Order of Conditions. The Commission will seek advice from town counsel on this idea. A site walk will be scheduled if at all possible. The hearing closed at 10:47. BYLAWS Chairman Sweet has doubts about the appeals process if the Commission drafts its own complete bylaw. If setting fees rather than strengthening the Wetlands Act regulations is the primary goal in passing a bylaw, a short version might be all that is required. Dick Lewis will return with a draft for discussion purposes. CERTIFICATE OF COMPLIANCE - Hidden Lane, SE211 -135 Dick Lewis has reviewed the completed work.' MOTION: To issue.
