DETERMINATION OF APPLICABILITY_ /K6I
Applicant: Edward, J. Tartufo
Location of Project: 79 Reservoir Street
Purpose of Project: Inatallation of a new septic system to an existing'
dwelling involving work approximately :80 -100 feet
from the edge of the Norton Reservoir.
Mr. Tartufo presented plans for a two -pump system which contained slight
modifications from the original submission, as a result of suggestions
received from DEQE. The project will be located as close to the road as
possible; pumping will be towards the front of the lot. The leach field is
back 100 feet from the bordering vegetated wetland.
MOTION: To issue a negative determination number 3: work within buffer
zone will not alter an Area Subject to Protection Under the Act.

WETLANDS PROTECTION ACT HEARING: SE211 -192
Applicant: Richard A. Silva
Location of Project: 68 Williams Street
Purpose of Project: Filling and grading for the construction of a house
and a subsurface sewage disposal system within the
100 ft. buffer zone.
The hearing opened at 8:25. Mr. Silva submitted the ,plans which he had
previously filed under SE211 -188, with the addition of marked ,wetlands ; and hay
bales shown. After this lot was denied by the Commission, Mr. Silva contacted
Dr. Jerome Carr, who flagged wetlands on the property. The plan has already
been approved by the Board of Health. The amount of filling needed will be
considerable, probably at least five feet over the leaching area. The hearing
was closed at 8:48. The site will be walked before Orders are written,
weather permitting.
WETLANDS PROTECTION ACT HEARING: SE211 -193
Applicant: Patrick J. and Eileen Walsh; Willowbrook Realty
Location of Project: Off Ware and Branch Streets -
Purpose of Project: Treetops subdivision - bordering vegetated wetland
Atty. Garen Bresnick and Mr. Ralph Maloon represented the applicants. A
drainage study and subdivision plans were presented. Much of the land uphill
from the site drains into this site, from Compo, Ispo, and from Ware Street.
About 14 acres shed into a pond on Branch Street just before Ware St. Another
area is approximately a 10 -acre wetland with a brook running through it. The
applicants were asked by the Town Engineer and the Planning Board to improve
drainage under Ware Street, with peak flows to be maintained at current levels
by controlling the size of the pipe. The plans propose filling about 4900
square feet of wetland; a "necessary road crossing" is part of that amount,
according to Mr. Maloon. This is not an isolated area. A sewer will be
passing under the railroad bed and under and through about 220 feet of
wetlands; the sewer will extend through most of the development. Hay bales
were shown on the plans. There were no manholes proposed in the wetland area,
only the pipe itself. I
MANSFIELD CONSERVATION COMMMISSION MINUTES
MONDAY, FEBRUARY 23, 1987 PAGE TWO
A pond of approximately 8 -10 feet deep, with a 5 to 1 slope, is proposed
in an area which is currently a wetland, with no compensation proposed.
Groundwater would be the source of water. The applicant noted that while he
would like to use the material removed from this area on site, the pond is not
necessary for the drainage system. There arose a question as to whether a
pond could replace a wetland area without compensation, since the two '.entities
function differently. Dick Lewis will check with DEQE.
Dick Lewis had questions as to whether the lots would be sold off for
development, noting that since 4900 square feet would have been filled in this
resource 'area, there 'would be little reason to allow later applicants to do
additional filling.
No oil /water separators are proposed because this site does not fall
within the water protection district. The hearing closed at 10:04. The site
will probably be walked on Saturday, March 6, weather permitting.
WETLANDS PROTECTION ACT HEARING:
Applicant: Robert G. Moore
Location of Project: 254 Elm Street
Purpose of Project: Septic system construction 'within 100 -feet of
wetlands and sloping banks to wetland edge.
This site was dug out in 1935 when the overpass for the railroad tracks
went in. Scott Leite advised the applicant that the septic system was
possibly too close to wetlands. Sanford Ecological Services flagged the
wetlands and suggested that the applicant file a Notice of Intent. The septic
system was redesigned and approved by the Board of Health, with leaching pits
now in front of the house. The applicant also wishes to drag the banking to
reduce the steepness of the slope. The site will be walked on March 6,
weather permitting. No abutters were present. The hearing was closed at
10:20.
DICK LEWIS - BYLAWS
Dick Lewis distributed copies of -a revised bylaw which incorporated
Commissioners' changes and revisions. Additional revisions were made.
MOTION: To accept the bylaw including the most recent changes.

TRASH TO ENERGY FACILITY - COMMISSION'S POSITION
Commissioner Ouellette, who traveled to Oswego to see a plant in
operation, commented that the size of that plant was considerably smaller than
that proposed for Mansfield and was more in line with what she would prefer.
She noted that the ash removal area, which had been constructed over a canal,
was thoroughly coated with ash. She also felt the the Canoe River site was a
problem. Dick Lewis was asked to draft a position statement to be discussed
at the next meeting.
