(OUELLETTE - `O'NEILL;'all in favor) VOTED REQUEST FOR CERTIFICATE OF 'COMPLIANCE - FILE SE211 -134 (PASCO) Dick Lewis will review these 'lots and will also develop a comprehensive list of lots which can be released by virtue of their having no wetland impact. DETERMINATION OF APPLICABILITY Thomas Klein--755 East Street, Lot 2 -- Construction of a single family house with septic system involving work within the 100 foot buffer zone. The plan presented by Mr. Klein proposed a septic system well over 100 feet from the wetlands; house will be constructed within the buffer zone. MOTION: To issue a negative determination no. 3, noting that proper siltation controls should be in place during work on the site. (OUELLETTE - O'NEILL; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - File SE211 -195: Robert C. Currivan -- Eastleigh Estates - -Rte. 106 (Mansfield /Easton line) Mr. 'John Parmentier of Dunn Engineering, James McIntyre, and Robert Currivan represented the project. Originally, an excavation had been proposed to lower the wetland; however, a detention basin has been added to the plans, located partly on lot 53 and lot 54, which eliminates the need for excavation and filling of wetlands. This 'change in plans appears on sheet no. 10, which bears a revision date of April 13, '1987 and which was submitted at this session of the hearing. Supplementary drainage calculations were also presented at the same time showing a net decrease of flow offsite./ Wetlands were flagged by Mr. Parmentier with wetland botanists. Since the land is sloped toward Easton, water will eventually empty into Easton. There is a culvert and head wall on the opposite side of 106. No oil /water separators are proposed in any area not within a water protection district. The Planning Board reserved parcel A and lot 53. Mr. Parmentier added that Lot 54 is probably not buildable. Commissioner Ouellette observed that of the 1400 feet of frontage along 106, approximately 600 feet is within a water protection district. A site walk was scheduled for April 25 at 9:00 a.m. MOTION: To continue the hearing (given Easton's involvement) until the April 29 meeting. (OUELLETTE - CAREY; all in favor) VOTED MANSFIELD CONSERVATION COMMMISSION MONDAY, APRIL 13 1987 WETLANDS PROTECTIO A MINUTES PAGE +TWO N CT HEARING - File Szau -i.yo: Home Developers, Inc. - -Maple Street, Lots :12 and 13 -- Construction of t building, water serve, and septic system within the 100 ft. buffer zone; filling 500 sq. feet of wetland for a driveway and excavating ;560 square feet for compensation area. Ralph Maloon of Rim Engineering presented revised plans (rev. date 04 -13) showing a driveway crossing 500 square feet of wetland, which will be compensated. Eighteen ft. of 12" pipe have been added. Additional wetlands were shown also. Copies will be sent to DEQE. Questions centered around the flooding problems in this area. Commissioner Graham commented that this is such a problem area that the earthen dam which is a, part of the Green Acres subdivision really should be completed before any additional construction takes place in the area. She added that emergency hay bales should be available, and that pumping would also be an appropriate measure in some cases. It was noted that the developer, doesn't want to have to complete the compensation area, because this will ,delay him.; Copies of letters from two abutters (Nan Funsch, 562, Maple St.; Laurie and Harvey Cohen, Maple St.) were read, voicing concerns about flooding problems and stating a preference that the impact of any construction be considered with regard to the entire area. Chairman Sweet and Commissioners Ouellette and Graham have seen this area; other Commissioners were urged to see it at their own convenience. The hearing was closed at 9 :30. BRANCH STREET LOT 3 Dick Lewis and Charlie Boutas will discuss plans to rectify the problem areas on this lot; a letter will be sent to Michael Skidmore, the resident of Lot 2 who complained about the problem. 1ETLANDS PROTECTION ACT HEARING - File SE211 -197: David J. Silva - -120 Ware Street, Lot B-- Land grading, to compensate for breakout grade, within the 100 ft. buffer zone. The hearing opened at 9:38. There are no wetlands on his lot, but there is a brook next door. The driveway will be 90 feet from the brook. The distance from the leaching pit to the brook is 110 feet. Hay bales are proposed to prevent siltation. The driveway paved. ,Chairman Sweet has driven by; there were no other questions. The hearing was closed at 9:48. WETLANDS PROTECTION ACT HEARING CONTINUATION - File SE211 -189• Fralo Corporation - -King Arthur ,Way -,- Construction of single family dwellings on lots with bordering vegetated wetland Revised plans dated March 18, 1987 were submitted which eliminated the wetland filling. There were no additional questions; Dick Lewis will.propose an order to ensure that street drainage won't back onto the driveway. This hearing was closed at 10:12. FLOODING CONCERNS WINTERJMAPLE STREET AREA Mr. James Owens and Mr. Kevin Cowell, residents of Winter St., appeared before the Commission to ask whether any solutions had been proposed, and to ask to review the Orders of Conditions for Austin Farms. Commissioners explained the discussions underway regarding the flooding difficulties, and reviewed the Order of Conditions for SE21I -144. MANSFIELD CONSERVATION COMMMISSION MINUTES MONDAY,, APRIL 13, 1987 PAGE THREE ORDERS OF CONDITION: File SE211 -196 - Perkins Avenue (Blandori and Dei)_ ( MOTION: To issue as discussed [see Orders, File SE211 -196.] (OUELLETTE - CAREY; all in favor) VOTED BONDING /CERTIFICATE OF COMPLIANCE FOR CAMELOT ESTATES —FILE SE211 -138 Mr. Broderick submitted a letter which proposed an escrow account of $2000 to serve as _a guarantee should a proposed wetland not revegetate within two years. His position was that this account would enable the Commission to issue a Certificate of _Compliance for the entire project. Commissioner Ouellette noted that the orders provide for an alternative compensation area, on lot 15, if the vegetation had not reestablished; if lot 15 were sold, this would not be possible. Accepting the account in lieu of maintaining control via the Order of .Conditions might then leave the Commission with the responsibility of replicating a wetland, possibly with not enough funds to do so. There was a concensus that the issue needed to be discussed further with Mr. Broderick. CERTIFICATE OF COMPLIANCE - FILE SE211 -134 MOTION: To issue a Certificate of Compliance pending Dick Lewis' approval after inspection. (OUELLETTE - O'NEILL; all in favor) VOTED CORRESPONDENCE 1. Letter from John Bolster dated April 6 requesting that the Commission use its emergency powers to drain the wetlands at the back end of 245 Winter Street. Commissioners have dealt with this problem in conjunction with other town officials, but noted that it was unclear that the situation actually constituted an "emergency" as defined in the regulations. Carey, Graham, Mandell, 'O'Neill, Ouellette, Smith The meeting was called to order at 7 :35 p.m. CHANGES TO FOREST PARK PLANS - File SE211 -191 Mr. Broderick appeared before the Commission with amended plans (dated 3- 18 -87). Changes included lowering a' roadway which crosses a wetland by an average of two feet (using a 6" pipe and adding another pair of catch basins) and side sloping to eliminate 'a retaining wall. The 'slopes will be seeded with 5 lbs. /1000 sq. ft. stabilizing mix, as well as additional wetlands species. The difference in elevation between the existing and proposed area would be a maximum of four feet, according to Mr. Broderick. 'There would be a total of 3920 square feet of filling in this area of the project. One other area of fill has been reduced by proposing a`small retaining wall, to be of rock and large boulders. Filling for this filing amounts to 4,550 square feet. flM4r,AjV%q -to (4I. 'Bros Itk.t M The Town Engineer, Mr. Campo, and Ms. Flynn, Planning Board Chair, have approved these modifications. The revised plans have been sent to DEQE. An Amended Order of Conditions will be issued referencing the revised plans. WETLANDS PROTECTION ACT HEARING - File SE211 -195 Robert C. Currivan - Eastleigh Estates - Rc Easton town line The hearing was opened at 8:05. MOTION: To continue the hearing until April request. (0'NEILL - OUELLETTE; all in favor) GREIF BROTHERS - Changes in plans, File SE211 -175 106 at the Mansfield and 13 per the applicant's VOTED Jim Robinson, representing Greif Brothers, described a change in the plans originally filed. The applicant wishes to construct in -floor trenches to drain water from the manufacturing area, with three traps to pick up paper debris. According to Mr. Robinson, sodium silicate residue would be minimal. Trailers will be steam cleaned inside the building. The consensus was that the changes made would be minimal and would not require a new hearing. DETERMINATION OF APPLICABILITY: Earl Paul Zecher - 1819 West Street; construction of garage and outside stairs. Mr. Michael Mathias represented Mr. Zecher, who wishes to construct a garage and a new stairway. The property abuts Bungay Lake, and there is a retaining wall in place at the rear of the building. Construction disturbance will be limited; there is no place to put hay bales. Ground will be disturbed for a couple of weeks. NOTION: To issue a Negative Determination No. 3, stipulating that the excess material be protected and that any disturbance of the retaining wall will necessitate a return before the Commission.
