MANSFIELD CONSERVATION COMMISSION PAC, MONDAY JULY 6 1987 AI \ ' PAGE ONE
Members Present: Chairman Sweet, Comms itianddll1 O'Neill, Q gllette, Smith
The meeting was called to order at 8:04 p.m. § >
DETERMINATION OF APPLICABILITY:
Carl Nelson - -68 Spring Street -- Installation of fence along property lines
Mr. rNelson has begun to install a chain link fence up to the pond at the
edge of his property, with an ultimate intention of building a house down
where the dam is. This determination is only requested for the fence,
Questions asked were: What determines the ':,edge of the pond; why is the
fence to be put up before the house is built (';to fence in a dog ",); how long
will the project take ( "next week or so "); are any siltation 'controls proposed
('?not needed '); why had Mr, Nelson not 'come in for review before abutters
brought it to Dick Lewis' attention ( "did not consider the impact
'significant';).
Shirley McPhee, 69 Spring St., characterized the project as an
"unneighborly thing to do." Paul Ethier, Union St., feels the fence will keep
him from reaching the pond, access he has had the past 22 years. Edgar
DeViney, 131 Union St., requested that Mr. Nelson have the area surveyed as
there is disagreement about who owns what land.:
Mr. Nelson presented no plans showing the project or its location. [Later
that evening he returned with a plan showing the lot lines.] Until the
determination is :made, no work may be done within 100 feet of wetlands. Dick
Lewis will take a look at the site.
MOTION: That the determination not be made until after the receipt of a
plan, 'stamped by an engineer, on which the Commission can base
its decision.

WETLAND PROTECTION ACT HEARING - =File SE211 -203
Michael W. C. Emerson -- School Street -- Private roadway leading to six house
lots with septic ;systems
Mr. Emerson and Mr. Paul Holian have applied to construct a roadway
crossing wetlands. Sanford Ecological Services is in the process of flagging
the wetlands; the wetlands under review at this hearing have been flagged and
the boundaries will not change, according to Mr. Emerson. The road will be a
private driveway which will -loop around,' touching all ,six lots, in order to
minimize crossing of wetlands and create a more attractive subdivision ;'
construction will require filling 900 square !feet of wetlands. Mr. Emerson
also proposed to deed a portion of land to the Commission, on a lot 'which
backs up ,onto Hodges Brook (Zone A, FEMA).
Questions centered around whether other options for access to the lots
exist; and where compensation would be made for the 900 square feet of filled
wetlands. Mr. ;Emerson indicated that crossing at the proposed location was
considered preferable to crossing a stream, because there is a ";lesser` level"
of vegetative wetland there.'
Mr. Emerson stated that no Form A's will be issued until an Order of
Conditions has been received.

buildable.
The Commission requested the following additional information: location
of culvert(s) and stream(s), (location of compensation area, proposed siltation
controls, a cross section of the roadway crossing, and details about any
drainage,;, systems if hot top ,driveways are proposed. The site will be walked
at 6:00 in the evening of the 27th of July.

WETLAND PROTECTION ACT HEARING: SE211 -205
Walmark Corporation - -Fruit Street, Nathan Road, Jefferson Road -- Hallett
Crossing II
Mr. James Dunn, of Dunn Engineering, presented revised plans including
filling an area for a drain installation and crossing a wetland. Compensatory
storage and an equal area of - vegetated wetland were proposed in an area of
similar elevation, with groundwater levels hydraulically contiguous with the
area to be filled. Mr. Dunn stated that the .combined total area to be filled
is under the 5000 square foot ,limit. Siltation devices would be in place
prior to any construction. 'Preparation of the compensation/ storage area would
':.not affect the buildability of the lot. Mr. Dunn stated that the plan
presented was the ",best design for the subdivision to allow the utilities.';
According to Mr., Dunn, : wetlands ,below and on Ware Street will be 'impacted,
therefore benefitting areas outside the subdivision as well, resulting in a
decrease of peak flow offsite. Jefferson Drive, which will require trenching
of 640 feet, will be restored after the drainage area is installed. Oil /water
separators are not required, so none are proposed.
In response to a question from Dick Lewis about exploring patterns which
do not involve ,so much ,filling, Mr. 'Dunn responded that ; ',we've explored. them
all,'; maintaining that other options would lead to difficulties with the
elevation of the sewer pipe, alignment configurations, center /line curvature
standards, and ;a, confusing configuration of road ,patterns; he added that they
wouldn't have frontage on certain lots, and only would be able to get lots at
the resulting cul -de -sac.
The current filing, does not include any request for approvals of house
lots or ,driveways. The 4,561 square feet of fill is based on a:35'
construction section and doesn't include the footings, nor does it include the
640 feet to be disturbed a during the installation of the drainage area. ;He
stated that no machinery will go beyond the 35 feet.` 'Drainage /rip rap area
will be installed beyond the 35 feet. Dick Lewis requested a cross - section
detail of the retaining wall.
Commissioner Mandell asked whether the Planning Board gave any statement
in writing regarding alternatives. : Mr. Dunn answered that they would not do
that, but that they have approved this plan. The applicant stated that these
are the plans to be acted upon.
MOTION: To continue the hearing to 9:00 on July 27.

NEW BUSINESS:
J.A. RECYCLING - -Work seems to be ongoing within 100 feet of a wetland.
Dick will check on this.
COMMISSION AUTHORITY OVER FULTON POND- -The Board of Selectmen have asked
whether the Commission has any authority in this area; in researching the
question, Commissioner Ouellette has found that the deed to Fulton Pond names
the Town of Mansfield, as opposed to that for Sweet's Pond which names the
Conservation Commission. Therefore, the Commission's response to the Board of
Selectmen will be a memo drafted by Dick thanking the Board of Selectmen for
the opportunity to offer input, and supporting them in any reasonable effort
to control problems at Fulton Pond.
BALCOM RIDGE -- Commissioner Ouellette will attend the Planning Board
meetings to keep informed about changes in subdivision plans which come about
as a result of higher than anticipated levels of groundwater and possible
channelized flow on the property.
