Abutters presented a letter addressed to the Commission, Board of Health,, Town Manager, Building Inspector, and DEQE, expressing their concerns regarding the proposed fence. Mr. DeViney also presented pictures attesting to filling of a canal located on Mr. Nelson's property, and asked for some response to neighbors' concerns that filling had taken place within 50 feet of the pond, and that asphalt, tree branches and stumps had been included in fill used on the property. Abutters also maintained that Mr. Nelson continued to work on the fence within the buffer zone, despite the Commission's directions that work not be done in this area. The Commision will request Mr. Nelson's presence at the August 17 meeting, at which Atime it can address the issue of the fill used and ;,possibly request a series of test borings. MOTION: To continue the hearing to August 17 at _7:35, and to send a letter to Mr. Nelson stating that no further work may be done within 100 feet of the pond or river, as instructed at the July 6 meeting. (O'NEILL- OUELLETTE; all in favor) VOTED WETLAND PROTECTION ACT HEARING - SE211 -206 Bertram and Barbara Cook, 420 Gilbert St., proposed aquaculture pond Mr. Cook submitted a plan drawn by the Department of Agriculture, with lot lines superimposed. The plan proposes 41,006 cubic yards of excavation to create a 2 -acre pond on a 10.5 -acre site. Some work will occur within the 100 -year flood plain. As the area is excavated, material will be removed immediately, except for humus and loam to be stockpiled in one corner. Pumping may be necessary. No work will be done beyond the tree line shown on the plan. Siltation controls can be ,placed between the tree .line and the excavation. The top of the pond elevation will be 97 ft.; the water, table will determine the depth. In response to a question by Mr. Joseph Corliss, 115 Central St., Mr. Cook stated that he will raise and sell shiners. Mr. Corliss requested clarification regarding the town meeting's vote against new ponds in relation to this proposal. It was explained that the vote applied to new ponds designed to handle drainage for _subdivisions. The •hearing, was closed at 8:.29. The site will be walked on August 10 at 6:00 p.m. LETTER OF EXCLUSION - The Order, of Conditions issued to Sandra Franey for file SE211 -185 was filed under the _incorrect book and page, based on information supplied by Mrs. Franey. MOTION: To open the hearing for Emerson (School St.), File SE211 -203) and continue until after the hearing scheduled for 9:30, since Mr.` Emerson was not yet present. (OUELLETTE- O'NEILL; all in favor) VOTED WETLAND PROTECTION ACT HEARING CONTINUATION: 'SE211 -205 Walmark Corporation -- Hallett Crossing II Mr. James Dunn summarized information presented at the July 6 meeting, stating that the "present application 'would require filling of 4500 sq. . feet. ", The crossing of' the ' wetlands is calculated on the basis of a retaining wall on each side which would limit the crossing between the walls to 35 feet. A- detention basin behind the roadway is an integral part of runoff management. The area would act as a detention basin to attenuate storm flows; the design also allows for sewer on a gravity basis. 'Mr. Dunn raised the possibility of moving the road through a narrow neck (roughly a 50 -ft.' change), stating that it doesn't make the sewer non- viable, but the length' of road would be increased by 30 -40 feet, resulting in destruction of about 1700 square feet of non- wetland vegetation. 'There would be ''a savings of about 500 ft. of wetland crossing.` [Comm. Carey entered at this point.] If the road in question were to loop with Emerson, a change which Mr. Dunn termed "quite severe," an additional 400 linear feet of roadway would be required,' as would a pump station for the sewer and possibly an additional detention basin somewhere in the buffer 'zone. Commissioner' Ouellette noted that the current design would cause more water to flow on to the Jefferson Rd. side of the filled area, although all compensation is being done on the other side of Nathan Rd., with no additional storage 'being created to handle additional runoff from the (roads. Mr.; Broderick stated that an overflow pipe could answer this concern. Commissioner Ouellette had questions regarding the elevations of the roadway with regard to the elevations in peak 'flow calculations, noting that the finished grade on the roadway is shown as 125.27, while the elevation for peak flow is listed as 126.1.' Mr. Dunn explained that the 126.1 elevation applied to Area A of the plan, where the elevation at the center of the road is shown at 127.5; the 125.27 finished grade occurs within Area B2. MANSFIELD CONSERVATION COMMMISSION 'i MONDAY, JULY 27, 1987 MINUTES PAGE THREE Commissioner Ouellette asked about the footing on the retention wall. The (' elevation at the base was shown at 117 ft. Two test holes in the area revealed silty sand with some stones at 2.5 feet below the surface in one spot, and loose to fine sand at 24 inches in the other. Footings would go down about four feet. In conclusion, Mr. Dunn stated that he recommended no changes to the plan presented. Dick Lewis asked if he had looked at moving Emerson Rd. with a view toward calculating how far a gravity sewer would work. Commissioner Ouellette asked if he had considered separating the sewer from the roadway. Commissioner Carey asked if they would lose house lots if the went with the longer roadway as explained above, moving the road 50 ft, over. Mr, Dunn said that if anything, it might add lots. Dick Lewis asked again whether there was no way to gravity feed from the intersection between Jefferson and Nathan. Mr. Dunn replied, ';I can't answer that;" this possibility was not investigated. Dick stated that the Commission had made it clear that it wants to minimize wetland impact, and that it was his belief that the Commission had not received the alternatives it sought. The applicants wish to proceed on the basis of the plans presented. Mr. Broderick asked if the Commission would like help with the Order of Conditions. Chairman Sweet responded that the meeting will be open, but that they were not seeking such input. The hearing was closed at 9:50, with Orders to be written on August 17. WETLAND PROTECTION ACT HEARING: Keith Development Corp. -- Connors Avenue (proposed road near Oakland ( St. /Francis Ave.) -- Roadway construction over bordering vegetated wetlands Mr. Phil Corbett of Keith Development and Mr. Charles Gale of Gale Engineering explained that Connors Avenue is currently a paper street; the project proposes to build the street to reach back land and is therefore filed as a limited project with no compensation area proposed for the 1700 square feet to be filled. Commissioner Ouellette asked if the wetlands delineation line shown represented the original wetlands delineation submitted for the Village at Mansfield Depot (File SE211 -182), or the revised one which the Commission had agreed to at that time. Mr. Corbett stated that the original line submitted had been used; "that is the line agreed to by the wetlands botanist." Commissioner Ouellette had reservations regarding the accuracy of the wetlands delineation as well as the limited project status of this filing. In response, Mr. Gale stated that "There is no area proposed for replication because there is none that works well," later adding that they "could compensate if asked to." The site lies within the Water Protection District. MOTION: To continue the hearing until the DEQE number is assigned. (O'NEILL- CAREY; all in favor) VOTED The site will be walked at 7:15 on August 10.
