(OUELLETTE - MANDELL; all in favor) VOTED NEW BUSINESS: Commissioner Ouellette suggested that the Commission consider requesting a copy of the Environmental Impact report required by the Planning Board as a part of any Notice of Intent filings. She also reported that at a recent conference she learned that accepting a plan during the Request for Determination of Applicability process sets the wetlands boundaries according to that plan, regardless of whether there are discrepancies between the plan and the commission's view of the wetlands. NOTION: To meet on November 16th. (OUELLETTE - GRADY; all in favor) VOTED WITCH POND Dick Lewis reported that this filing presents major problems. The Notice of Intent is for the initial phase of an access road. He will put together a comprehensive list of questions to be asked at the hearing. The wetlands delineation was done by John Parmentier; Dick feels the commisson should require a professional botanist's flagging, to be shown on the plans. In addition, the computation of altered wetland areas does not take into account cutting and filling for the compensation/ storage area or the full limit of excavation. Increases in these computations would trip the 14EPA process. Plans do not show any replication. Dick urged that the Commission should make an official determination that replication is required, with a replication plan submitted as part of the filing. Regarding the limited project status of the filing, Dick feels that proof of all attempts to gain other access should be documented for the commission. Finally, Dick recommended seeking professional advice from a consultant, at a cost of $50 /hr. MOTION: To hire such consultant. (MANDELL - SMITH; all in favor) VOTED MOTION: To go into executive discussion for the purpose of discussing the pending lawsuit'with ABC Trust.
