(O'NEILL r OUELLETTE; all in favor) VOTED Little League Contract Town Counsel Dwyer has reviewed the draft and has recommended that the Conservation Commission include at the top of page 3 a stipulation that "the applicant agrees to secure liability insurance in the minimum amount of $100,000 and furnish proof thereof." There appears to be no problem with a non - profit organization leasing the land, although the concensus was that paragraph 3, .regarding sub- letting the facility, should be deleted. There was some question as to whether the property should be locked. A copy of the proposed contract, with these changes, will be sent to Little League officials for their reactions. WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -220- Witch Pond Estates II'- Neponset Associates Mr. Charles Corkin represented the ,project, reiterating that the' sole purpose of the wetland crossing` is to ;gain access to upland. The plan proposes a narrower road than the Planning Board usually requires, and it has not as yet been accepted. Negotiations with Foxboro 'continue regarding emergency access;' a written denial of access Foxboro to the subdivision is apart of the original filing. According to Mr. Corkin, the plans submitted show alterations of 31,000 square feet of wetlands (computed to the edge of the hay bales). The replacement area is about 37,000 square feet. Compensation for flood storage is in the same area as the replication area. The 100 year flood is at !'155.77 (USGS ). ` In response to> questions b P q Y E Dick Lewis, Mr. Parmentier said that the amount of groundwater which would exist in the basins has been figured into the 'calculations. [Commissioner i Smith arrived at this point.] A 1.5:1 sideslope is shown on the plan, to reduce the impact on wetlands. Dick Lewis has concerns about the lack of information regarding impact of the project on water quantity and water ' quality, since the area shown is a recharge area for Foxboro, Mansfield, and Attleboro wells. Mr. Corkin maintained that the project had been designed for minimum impact. In response to comments from Comm. Mandell, he explained that certain alternatives were not reasonable from a cost point of view. The applicant will apply for an Army ;Corps of Engineers permit after an Order has been issued. Sanford Ecological` Services has delineated the wetlands." The center line of the roadway, the 'detention /retention basins and :outlets, and the replication area perimeters, have been staked. The site will be walked on Sat., April 9, at '9 :00 a.m. Commissioner Ouellette asked whether Foxboro would allow access to the land if the applicant were building one house, noting that if the answer were ' yes, the project might not qualify as a`limited project, Mr. Corkin stated that.the applicant doesn't have the answer to that question. The letter of denial from Foxboro specifically refers to a subdivision ;'plan. MOTION: To continue the hearing to 8 :10 on April 11. (O'NEILL - DAVISON; all in favor) ( VOTED WETLAND PROTECTION ACT HEARING -- Morgan Associates Ltd., off Williams St, (Pine Wood Estates), ;Construction of Sterling Road and Woodside Drive, with associated utilities, drainage culverts Leon J. Buck, representing Morgan Associates, explained that compensation of 1350 "square ft, has been provided to offset wetlands filling for the roadway. The plans have been approved by the Planning Board. Dick Lewis noted that the alteration at the road crossing is 1200 square ft., but there is also an additional alteration south of station 4 and at the drainage outfall which should be taken into account in the calculations to ensure adequate replacement area. In addition, on p. '19 of the Environmental Impact Statement, drainage calculations were based on the 25 -year storm;';DEQE regulations require 10; and 100 -year storm calculations. The applicant responded that additional calculations had been submitted; Dick mentioned the possibility of having to go to a detention basin, which might require sufficient design change, to trigger Planning Board review. In addition, lot drainage has been designed to stay on the lots (p. 20 of the EIS), but the site topography would indicate that the flow of the water would be off some of the lots. Dick also mentioned that the corrugated metal pipe, which dates from the late sixties /early, seventies should probably be replaced with concrete pipes while this work is being done. The site will be walked.on an individual :basis, MOTION: To continue to April 4 at 9:30. Ron Hornung, Mike Trowbridge, and Ed Broderick explained that some houses will be constructed within the buffer zone, and some will be just outside it. The lots have been physically numbered on site. The wetlands were flagged by 'Sanford Ecological Services; Dr. Carr !tested the soil types, which were confirmed by the Soil Conservation Service. In response to Dick Lewis' questions about the extent of the proposed clearing around houses for seeding /loaming, back yards, etc., the applicant stated that back yards will MONDAY, MARCH 28, 1988 PAGE THREE rarely have to be graded more than 30 feet.
