WETLAND PROTECTION ACT ;HEARING - 88211 -248
Tifdan Development -242 Williams 'Street -- Construction of house, grading,
paving within buffer zone
l This hearing was re- opened, because Bert Cook did not approve of the
revision which the original plan had undergone. Access must be through the
frontage of the lot. Consequently, the current plan calls for filling of
approximately 360 square feet of wetlands, according to the applicant. Dr.
Carr flagged the wetlands in October 1986. [Comm. Mandell arrived.]
Neighbor J. Goldman stated that in his opinion a lot of filling of
wetlands has already taken place, and that he had seen a bulldozer within
water. ;Several area residents, including Walter Mann of 292 Williams St.,,
were present to voice their objections and concerns about the area.; The
replication area is approximately 1650 square feet, partially because of
previous filling.
Dick Lewis commented that the driveway should be bermed on one side, and
that there are deficiencies in the wetlands replication plan, including the
fact that the replacement area should be contiguous with the existing wet
area. Dick Lewis wants to look at the property'; again, before_ deciding on this
filing. The commission will walk the site at (8:45 o:n Sat., ?April 30. Mr.
Benoit will not allow abutters on his property.
MOTION. To continue the hearin g to 11 at 9 :00 ;

- 'Questions still remain as to whether the 24 ft, road width and the
1.5:1 side slopes will be acceptable to the Planning Board. Dick Lewis and
the commissioners recognized that the applicant: has made a good faith effort
to satisfy information requirements, but concerns remained about setting a
precedent for such a large amount of disturbance, about impact on water
quality, and about the !overall wetlands impact of the project. The
preliminary c oncensus reached by
the commission was to deny
the project, using
its discretionary
power on the basis of its unresolved concerns. It was noted
that such denial will probably automatically tri gg er an additional review
process by DEQE when the applicant appeals. No vote was taken.
