He explained that he hadn't realized the work would require a permit. The commission explained its two possible courses of action: (1) to request that a Notice of Intent be filed, or c(2) to issue an Enforcement Order. Commissioners explained that the performance standards for "land under water body" as defined under the Wetlands Protection Act would have to be net, or the ,gravel would have to be removed. Mr. White will confer with Dick Lewis. The commission will walk the site at 8:00 a.m., 'Dec. 3. WETLAND PROTECTION ACT HEARING: SE211 -277 I I PO USA INC.--Branch treet, lots 3 nd 4-- Proposed houses, grading, and driveways to be constructed within the 100 -foot buffer zone of bordering vegetated wetlands. Mr. Robert Collern, of 'Hutchinson- Trowbridge, presented plans (dated October 19, 1988) for two houses (to be severed) within the buffer zone. The sewer line is also within the buffer zone. Hay bales were proposed along the edge of wetlands, which were flagged by Hutchinson- Trowbridge. 'Dick Lewis [not present at this meeting] has indicated that he may have questions about the wetlands boundaries. The area is not in a FIMA- designated 100 year flood plain. Commissioners requested staking of lot lines, foundation corners, extent of filling, and center line of driveways. 'Commissioners expressed some concerns over the driveway /drainage ,pitch, and also questioned ,how the proposed work fit into the overall plans for extending the sewer line dorm Branch Street. The site will be walked at 8:45 a.m., Dec. 3. MOTION: To continue the hearing to 8:15 on December 12. Mr. Folkman explained that Dick Lewis had not approved of the plan under consideration, because filling is proposed. Mr. Folkman explained that "there are ways to salvage the 400 square feet, no doubt about it." Explaining that he does not yet have a buyer for the proposed ,house, 'and that the plan is for a very popular style, he commented that the present plan is a "worst case ", and that it is possible he ,won't have to fill. 'However, his view was that this ,amount of filling is allowed under the law, and he is requesting permission to do so. Other options have been considered impractical or aesthetically inappropriate. The site is in the groundwater protection overlay zone, and Comm. Rhoads requested dry wells for the roof leaders, at least on the upland side. Comm. Ouellette requested that the house location be staked. The site will be walked December 10, at 8:00 a.m. MOTION: To continue the hearing to 8:30 Dec. 12.
