CORRESPONDENCE:
1. Information from the Natural Heritage and Endangered Species Program
stating that Oct. 137 maps are still valid for Mansfield, and including
information regarding the certification of vernal pools.
2. Information from Natural Resource Trust in Easton regarding an extension
course to be given at Wheaton, on "land use" issues, focusing on lands
within the Canoe River watershed. Dick Lewis will attend, and possibly
former Commissioner Deborah Graham.
3. Notification of Feb. 12 wine /cheese reception /IEP report on Canoe River
aquifer.
Comm. Rhoads suggested co- sponsoring articles incorporating the IEP
recommendations regarding the Canoe River aquifer; he also suggested that
perhaps the Conservation Commission should recommend to the Planning Board
that zoning be strengthened with regard to water protection.
4. Letter from residents of Wind Chime development regarding completion of
pond.

WETLANDS PROTECTION ACT HEARING - SE211 -280
The Folkman Company--19 Clementine Dri e (Fuller Estates) -- Construction of
house, garage, septic system, and grading within the buffer zone of a
bordering vegetated wetland.
The applicant was not present. The site is within the water protection
zone and dry wells for recharge should be considered. The extent of grading
should be checked, as should alteration of the 166 contour behind the house.
The site will be walked on Jan. 12 at 12:00 p.m., and on Jan. 14 at 8:00 a.m.
140TION: To continue to January 23 at 9:30 p.m.

ISPO USA INC. -- Branch Street, lots 3 and 4
Wetlands have been delineated by Dr. Carr. The limit of grading, dry
wells, a new wetland line have been shown on newly submitted plans; these
should be checked on site. Commissioner Rhoads suggested some storage

compensation, because the "hummocky" ar g is prone to flooding. Lot lines have
been changed. Mr. Trowbridge will either do a Request for Determination for
lots 5 and 6, or will file an amended Notice of Intent to include the new
lots. Construction of the sewer will probably also come under Conservation
Commission jurisdiction, since at least part of it is within the buffer zone.
The site will be walked on Jan. 12 at 12:30 p.m. and on Sat., Jan. 14, at
8:30 a.m.
140TION: To continue the hearing to 9:45, Jan. 23, 1989.

WETLAND PROTECTION ACT HEARING CONTINUATION - SE211 -272
Bird Road
Comm. Rhoads again raised the issue of cascade grates, and the fact that
flows have not been balanced on site. No drain easements are shown around any
outfalls; they are needed for maintenance purposes. A set of basins should be
included at station 250, because too much water is shedding toward the Maple
St. intersection; drainage issues should be resolved.
MOTION: To continue the hearing to Feb. 13 at 7:45.

WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -281
United States Postal Service - -Giles Place
A site walk was held. Some wetlands had inadvertently been filled; fill
will be removed and siltation controls will be pulled back also. The drainage
scheme has been finalized, as a series of catchbasins with a series of
pre -cast leaching chambers. The system handles a 25 -year storm. Computations
address the 100 -year storm and indicate that volume will overtop the curb;
post - development runoff reaching the wetlands will be less than
pre - development. The plans ( "Drainage Structure Plan ", dated 1 -9 -89) and
calcuations submitted will be filed with DEQE. Chairman Ouellette requested
that the limit of work line be flagged.
MOTION: To continue until DEQE has received the new plans.
(0'NEILL - not seconded)
MOTION: To close the hearing.

REQUEST FOR DETERMINATION OF APPLICABILITY:
Lifecare Associates - Cobbler's Corner
Ted Kelley, project director for Mansfield Lifecare Associates, and Steve
Chapman of Fay, Spofford, Thorndike Engineering were present. Site walks have
been held. The applicant is requested that the Commission define the areas of
its jurisdiction, with regard to FEMA and the Wetlands Protection Act, on the
site described in the Request for Determination. Mr. Chapman stated that the

applicant and engineers have accepted the FEMA delineations and have plotted
them on the map presented to the commission. Additional spot grades were
taken and noted on the plan. Bordering vegetated wetland, isolated land
subject to flooding, land under water, and the 100 -year flood plain have been
noted on the map submitted with a letter dated Jan. 6, 1989.
Dick Lewis took the position that the raceway, although manmade, does
involve "bank" considerations; DEQE supports him in this viewpoint. Comm.
Rhoads agreed, noting that regulating a man -made structure would be different
from regulating a natural bank.
The unnamed brook in the southwest corner of the property has not been
studied at all. Comm. Rhoads wondered if it would be significant with regard
to the 100 year flood (with potential for wildlife habitat impact). The
commission will want to see this area in more detail if construction is
planned here.
Abutters and local residents were present; questions were asked by:
Carole Andrews, 211 Willow St.; David Farrington, 211 Willow St.; Vincent
Botti, 395 Willow St., representing "Citizens for Responsible Development of
Willow St. "; Stephen Cox, 373 Willow St.; James Lazzara, 132 Willow St.;
Patricia Lestan, 133 Willow St.; Dan Driscoll, Franklin St.; Mary Ann Botti,
395 Willow St. A great deal of concern was voiced regarding Willow St. as a
Scenic Way and the impact of the proposed Lifecare facility on the
neighborhood.
( These residents had expected to see a plan showing the proposed buildings;
Comm. O'Neill objected to the omission of buildings from the plans. It was
explained that the applicant was requesting the Conservation Commission's
determination of -jurisdiction over the wetlands, land under water, and
100 -year flood plain for this site. Buildings will then be planned with
regard to the resource areas determined at this hearing, after which a Notice
of Intent will be filed.
MOTION: To continue this hearing until further information is submitted.

Comm. Rhoads suggested that there is an isolated land subject to flooding,
as noted on the plan, and that performance standards must be adhered to. The
Rumford River and sluiceway constitutes land under water, as do associated
channels, culverts, and the unnamed brook entering from the southwest. The
raceway does have a manmade "bank." The plan has not delineated between land
under water body, bank, and bordering vegetated wetlands; banks are not
delineated on the plan. Any banks for water courses would have to be shown as
regulatable area. With regard to bordering vegetated wetland, problem areas
are: flag 35, flag 158 on the unnamed brook, and 109 in the floodplain. The
commission may require further study of the the unnamed brook, since it wasn't
included in the calculations for the plan under consideration. In addition,
the buffer zone must be delineated, as defined in the Act.
