It was noted that Ch. 43C of MGL provides for consolidation of municipal departments; the town manager believes that position of comm. devt. director dues not violate town charter. Comm. O'Neill's concerns are over losing the right/ability to appoint __sown agent. Budget _- _rtes have been resolved since a meeting with the fincom. Regarding Dick's. position, Comm. Rhoads Proposed a compromise job description which allows input from the commission and town manager. Specific changes include: title (Environmental and Conservation Planner); statement of commission's authority in selecting candidate; indication that agent will be supervised by the commission with input from the town manager; listing of responsibilities by priority; reference to a memo of understanding with the town manager regarding number of hours to be spent in planning activities. WETLANDS PROTECTION ACT HEARING CONTINUATION -- SE211 -272 Bird Road Ralph Naloon and Town Engineer Bob Swanson presented new plans showing cascade grates and -easements; the pitch of the road has been changed on all but the last page. Comm. Rhoads asked about legal wording of easements. The town engineer will keep a watchful eye on easement situation. Filling/compensation shown in one are may constitute an alteration which might not revegetate as wetland. Comm. Owens would prefer that then intersection pick up the entire drainage off Winter St. MOTION: to close hearing (O'Neill - Davison; all in favor) VOTED AETLANDS PROTECTION ACT HEARING CONTINUATION - -SE211 -283 Balcom Ridge Estates II Karen Dupont, Commonwealth Engineers, and Nicholas Harris were present for hearing. Questions resulting from site walk included: (1) the possibility of stakes being in wrong place or mislabeled; as stakes exist in the field, there is no room for compensation areas as proposed. (2) Comm. Rhoads noted that much of storm drainage is brought into existing pockets, but both 10 and 100- year storm create a backwater onto other land not owned by applicant. In depression contour A, land (including wetlands) not controlled by applicant gets inundated. A short dike would prevent water going onto lands of others and would resolve compliance with the Act; commission must resolve whether it can be comfortable with 6" to 1' more water in wetland than there now is. Some discrepancy exists between what calculations show and outfalls shown on plans. Everything that goes into the depression area has no outflow other than percolation. The applicant is agreeable to building dike as an alternative to securing an easement. The Commission requested that the road (which might serve as a natural dike) be shown on plan in area of isolated land subject to flooding. He requested balancing of flows pre and post, and that the applicant demonstrate either that they have been balanced or that the imbalance is insignificant. Dick requested that the applicant respond to Natural Heritage Program's interests and suggestions in this area. Ms. Dumont answered that the road was put through in a location where it MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, FEBRUARY 13, 1959 -- PAGE 2 would have the least impact on bvm; if road were moved to east to answer specie=_. . concern, it would impact almost double the impact. The suggestion to move the mitigation area to upland on lot 16 is more acceptable to the applicant than moving the road. Plans have been approved by Planning Board. Con Com does not have to require volume mitigation given that on area is significant to wildlife; this can be included in a finding in the Orders. Hearing will remain open so applicant can do additional surveying, etc.; Dick will prepare orders for the next meeting, Feb. 27, 9:30.
