REQUEST FOR DETERMINATION OF APPLICABILITY
Donald R. Betts, Jr.-- Southeastern side, Canoe River Bridge, Mill St. --
Removal of one tree to enable house relocation
One tree must be cut down in order to move a house. The applicant stated
that no work will be done in the river or the bank. Comm. O'Neill asked that
the applicant consider replacing the tree with a new planting; he also asked
that the tree not be taken down until the Board of 'Selectmen approved the
project. Some additional trimming will also be done, according to Planning
Board correspondence. Mr. J. Gonsalves, of Mill St., came before the Board to
express his desire that the tree be replaced and that the spillway not be
damaged.
MOTION: To issue negative determination 43 with 3 provisos: (1) a letter to
the Board of Selectmen, supporting the idea of a replacement tree as
acceptable to the tree warden; (2) a letter encouraging the safety

REQUEST FOR DETERMINATION OF APPLICABILITY
Edward Troy - -171 Ware Street - -Work in buffer zone for septic system breakout
The applicant was not present. There will be approximately 7 feet of grading
into the buffer zone, for a replacement septic system. Little chance of any
sedimentation reaching the heavily vegetated wetland area, according to Dick
Lewis. System cannot be relocated because of poor soils in other areas; there
is currently a failed system on the site. John Burns, 151 Ware St., came to
review the Plans with a view toward how the project would affect him. CComm.
Smith arrived at this point in the hearing.] No stream shows on the plan. Mr.
Burns maintains there may be a stream in the area.
MOTION: To continue to the 4 -24 -89 meeting at 9:77, on the grounds that the
information may be incomplete; there has also been no Board of
Health approval at this time.

disposed of per regulations.

DISCUSSION - Mansfield Manor Estates - SE211 -134
The applicant is requesting a change in the detention area. Ralph Maloon did
a new, SC'1 based study of the area. Flows have been calculated for 10, 25, and
100 year storms and compensated for the full amount. Cross - sections have been
provided. Chairman Ouellette asked for substantiation that the area would
replicate as a wetland, if it is to be used as compensation for the filling.
Ralph Maloon agreed to dig test holes to determine groundwater at least two
locations. Comm. O'Neill had concerns about putting additional water onto other
people's property in the "50 -acre swamp." Comm. Rhoads feels that the
calculations are in order, by and large. The Commission's consensus is that the
new plan suggested, backed by supporting data, is a better plan than the
previous one. Comm. Rhoads suggested coming up with a "punch list" of items to
give to the applicant at the next meeting of the Commission so that the process
goes smoothly. CComm. Poholek abstained from the discussion of this project.]
DISCUSSION - GREEN ACMES - SE211 -131
Originally designed detention area doesn't work, because there is ledge in
