REQUEST FOR DETERMINATION OF APPLICABILITY: Folkman & Zola Builders- -Lot 22, Sandy Hill Estates The applicant has requested a continuation. MOTION: To continue to 7 -10-89 at 8 :00. (O'Neill - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -306 DeGirolamo- -158 Gilbert St. Comm. Rhoads felt the plan was acceptable. Work proposed in addition to what has already been done: spreading loam (currently stockpiled on site), grading. Intended use of area: hay field, a couple of cows by next spring at the earliest. Applicant stated his intent to fence in tree line area with cattle fence. Dick suggested a small swale, in the approximate location of the bay bales shown on plan, to catch some of the runoff. No comments have been received from the Natural Heritage Program; Comm. Rhoads is in favor of incorporating any Natural Heritage Program comments into the order the c ommission writes. The plan presented (dated 6 -8 -89) showed a house on the MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JUNE 12, 1989 -- PAGE 2 site, with minimal work within the buffer zone. The house location would now be included in the order. RIM Engineering did the flagging. Dick would like to review the wetland line before closing the hearing. MOTION: To continue to SE211 -345 to June 19 at 7:35. (O'Neill - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -344 Dana Colby - -26 Cavan Crossing The plan has not yet been drafted because survey work has just been completed. The applicant has requested a continuation. NOTION: To continue to 6 -26 -89 at 8:47 p.m. (O'Neill - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - No file number Improvements to Fulton's Pond Park The town is the official applicant for this project, although the project has been initiated by the Lions. Mr. hlahana, 90 Oak St., represented the Lions. Several abutters (Paul Burke, Tim Gears et al.) were present. Plan made by Ed Jameson. The proposed parking lot will be stone dust, not paved. Louis Garland, 128 Highland, commented on the plans. Mr. hlahana described the proposal to clean debris from brook and to replace the foot bridge (about 5 -6 feet wide). Lions Prepared to spend $20,000 (over four years) plus all the labor. With the exception of the parking lot, all the work is upgrading/ maintaining existing facilities. Many members of the Lions felt that the parking area is undesirable for a variety of reasons. CComm. Poholek arrived at this point.? Dick's observations: (1) Cleaning out of the river bank, sandbagging it, doing one side and then the other would be a one to two day operation which would have to be done in very dry season. (2) In order to clean out pond area, some blocking would have to occur, and some pumping. (3) Wood chipping on the banks is undesirable in a high water situation; Dick requested that low ground cover be used in place of wood chips as much as possible. Wood chips will not be placed down to the water line. Vegetation will take over eventually. Perhaps stone dust pathway could be moved in to accommodate more Planting as well. Dick would like to walk with Ed Jameson to get a more specific idea of planting along banks etc. The project includes plans to fill in a "pocket" which is a regulatable area. Some work will be done by the town on the dam. Comm. O'Neill advocated removing the parking area, Particularly since Mr. Garland noted that most of the members were not in favor of the parking lot. Comm. Owens commented that if the parking lot does go in, he would like to see much more detail, elevations, etc. The Lions would rather not go into such engineering detail. Mssrs. Mahana and Garland have stated that the parking lot can be reproved. Comm. Rhoads commended the Lions for (1) their Plan to improve the area, and (2) for their willingness to eliminate the parking lot. Comm. Rhoads voiced his concerns with regulatable areas which may be filled; he would like to walk the area to see how the wetland areas are functioning. Chairman Ouellette would like to meet with Dick and members of the Lions and Mr. Jameson, to go over the Orders to ensure understanding of the procedures. Chairman Ouellette would like to receive information about how the MANSFIELD CONSERVATION COMMISSION NINUIES MONDAY, JUNE 12, 1989 -- PAGE 3 power will get to the island; she also requested any information about possible fencing. The commission also expressed a desire to meet with Mr. Jameson in order to clear up some of the questions. The site will be walked on Sat., 7.39 a.m., June 17. MOTION: To continue to July 19 at 8:15 p.m. (Rhoads - Owens; all in favor) VOTED RIVERNOOD ESTATES CONSTRUCTION SEQUENCE - SE211 -292 A copy was sent out to all commissioners. The order stipulated that wort; related to replication work must be completed before other work: begins. However, a road is necessary in order to do the replication work at the far side of the site. Dick suggests that the order may have to be amended to address this issue. Chairman Ouellette stated that the intent of the condition was to ensure that the wetland -replication be done first; she suggested that paving should not be done. The applicant requested permission to cut the roadway, and then make the replication area a top priority. MOTION: To approve the construction seRuence dated 5 -24 -89 in principle, with the Stipulation that vehicular access be restricted to the point where the roadway will be constructed, that no paving will be done until after the replication is complete, and that Dick be notified of the actual limits of encroachment and limits of wort: prior to the work. (Rhoads - Owens; all in favor, CaUldwell abstaining) VOTED ORDER OF CONDITIONS - SE211 -395 Include special condition about lot 25 board of health plan. MOTION: To issue the order for SE211 -395 as drafted by the agent with additional condition above for lot 25. (Rhoads - CaUldwell; all in favor) VOTED BIRD ROAD (MR. HENRY RETTNAN): Certified letter sent to Mr. Rettman specified a response deadline of 6-7 -89; the commission has heard nothing. NOTION: To authorize Dick to meet with Town Counsel in conjunction with the Board of Health to determine action to be taken. (Rhoads - Owens; all in favor, CaUldwell abstaining) VOTED PROPOSED DEQE FEE STRUCTURES - Commissioners agreed that there are too many grey areas and administrative headaches involved in the proposal as it stands. SE211 -134 Letter from Lamborghini indicates that Pasco has no right to go onto the property; Comm. Owens suggests that some language in the P & S may survive the deed, but Pasco has the obligation to prove that they have the right. Pasco has access problems with regard to the work that has been proposed. In light of the difficulties, another solution must be devised. Dick: noted that anything the commission writes based on the current proposals before the commission will probably be appealed. Planning Board voted to rescind the bond. In order to MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JUNE 12, 1984 — PAGE 4 move things along, Dick recommends ordering the applicant Inspector feet ll lot 38A (and at the same time, sendngaletterotoPthetRuildinaJJ Inspector calling his attention to the wetlands line and the potential deficiency of buildable land on 38A), and addressing the drainage compensation separately. Carom. Rhoads will look further at the Project with a view to the storm drainage issues. If the Commission doesn't act quickly, this get tied u. for two years or more, Pasco will be incomplete. issue could gone, and work will he MOTION: To write the Building Inspector suggesting that lot 38A appears to have a sizeable amount re of wetlands which should cause careful view of the lot before a building permit is (Rhoads - O'Neill; all in favor, Poholek; d, abstain issssue ue The meeting adjourned at 11:3 DOTED Approved by: M /Pf OCt2I—QotL Date to town clerk: / /-no C- -TL1YYlQ_AL
