On a site inspection, one area appeared to be an area of groundwater breakout; he will be talking with Scott Leita about the area. Comm. Rhoads repeated that a Swale should be included in the orders. He also cited three conditions for such wort: to be permitted under agricultural provisions of the regulations: (1) no change in existing topography or water levels; (2) all fertilizers must be used according to standards; (3) erosion and siltation of adjacent water bodies and wetlands must be prevented. Commissioners mentioned approving the project with a six - month 'review condition so that Dick could periodically check the progress /condition of the project. NOTION: To close the hearing. (Rhoads - O'Neilli all in favor) VOTED Hearing Continuation on Request for Amended Order of Conditions, SE211 -134 - Mansfield Manor Estates, Fruit Street A new plan (revisions not dated) and new supporting calculations were presented by Ralph Maloon and Mr. Pasqualino. This plan is proposed as both wetlands compensation and flood storage compensation. Total fill and alteration approximately 6400 square feet. An area on the other side of the Rack Ray Brook has been proposed which "meets the numbers ". Access has been granted verbally by Jess Realty Trust; access will also be through a sewer easement, and the railroad bed. Dick mentioned the need for a detailed construction sequence particularly as this area can't be seen from the road, as well as the need for long -term maintenance of the connecting channel so the hydraulic connection doesn't disappear over time._ Comm. Cauldwell asked whether the channel will act as a "drain" for the wetlands? A berm or clay sideslopes might be a solution. A letter stating that the site for this compensation area was included in the original filing was requested (including the book and page of the property), so it can be included in the amended order. A locus was requested; Ralph Maloon also stated he.would be supplying greater detail (test holes, planting and construction schedules, etc.). The commission would want additional detail regarding the entrance of the brook: to the channel. Residents present at this hearing included: Mr. Steve Hirsch, who commended Pasco for devising a plan that doesn't impact the residents' back yards; Dave Longendorfer, 10 Danielle Lane, who asked to review the plan; Steve Smith, 44 Angelina Drive, who asked how people are going to reach this area, and whether his easement will be affected. (At this time the applicant is proposing to access the area from the other side of the brook.) Easement issue: Commissioners concurred that easements would be appropriate for both access to the area and access around the area itself, for MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JUNE 19, 1989 -- PAGE 2 Purposes of periodic town maintenance, particularly of the channel. If the channel were raised to just slightly below the 10 -year storm level, as a compromise, the trench might not have to be as deep. Comm. Rhoads: two channels might be better in terms of maintenance and hydraulics. The commissioners also suggested that improving the design from a maintenance point Of view might be desirable, although Comm. Rhoads observed that perhaps an improved design might actually impact more wetland; the commission suggested that Ralph stay in touch as he revises the plans. The channel area as currently Proposed is calculated at approximately 1500 square feet. Dick requested a plan that shows the numbered wetland flags. Dick Lewis again advised the applicant to discuss the modified plan with the Planning Director as soon as possible, especially to expedite the work during the driest part of the summer. MOTION: To continue to 6:30 p.m. site walk and meeting at 9:15 on 6- 26 -89. (O'Neill - Smith; all in favor) VOTED FULTON76 POND SITE WALK: Commissioners observed a type of material which seemed oily, near the pipe; the bank was heavily soaked with the material as well. Origin unknown, though it looked as if it were seeping through the ground. Chairman Ouellette Will follow up with the town engineer, since there will be maintenance on the dam. Comm. Rhoads feels that the Lions should not be given carte blanche for improvements, but rather in designated areas, given that one area is regulatable. Nand cleaning channels, for example, would not be a problem. Consensus is that wood chipping will be a problem. Include wording that enables the Lions to work with Dick, with an upper limit in the order for alteration. Certain areas can be designated to remain natural. CERTIFICATE OF COMPLIANCE: SE211 -195. Requesting releases for upland lots. One stormwater detention basin is in, one is not. MOTION: To issue a Certificate of Compliance from SE211 -195 for the listed lots, and state in a cover letter that no more lots will be released until the roads have been completed and the second stormwater detention is completed, stabilized, and operational. 77, 67, 68, 46 -42 descending, 1 -10, 25, 26, 27, 29, 31, 32, 33, 34., 36, 37, 38, 39, 40, 41, 69, 70, 71, 72, 49, 73. (Rhoads - Smith; all in favor) VOTED CUTTING ON MILL ST. ON CONSERVATION LAND: Permission has been asked by an abutter to cut on the land.
