(Owens - O'Neill; all in favor, Smith abstaining) VOTED REQUEST FOR DETERMINATION OF APPLICABILITY - Alan Madden - -780 Ware St.-- Repair of septic system within buffer zone Dick Lewis has been on site with Phil Beatty; the plan for replacement of the existing failed system has been submitted to the Board of Health. It is estimated that work will take place over 2 -3 days. The failed system is currently having an impact on the wetlands. Hay bales will be installed. MOTION: To issue a negative #3 determination, provided that the plan has been approved by the Board of Health, and that no material be stored on site. (O'Neill - 014et7s; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211- Harrington & Matto - -lots 2, 3, 6, 12, Riverwood -- Homes, septic systems, driveways, grading within buffer zone Bob Colleran from Hutchins- TrVwbridge Associates represented the applicant. Abutters have been notified. No ffiffilng is anticipated. Siltation fence proposed for both sides of street. Septic systems have not yet been approved by Board of Health. Limit of clearing shown on plan. The Commission and Dick requested that the configuration on lot 2 be changed so as to avoid wetlands as much as possible. The wetlands protection act /regulations were described briefly for abutters Joanne Manero of Glen Street, and Jim LOUsararian. Roof leaders are shown on the plan. Lots can be staked this week. Site walk will take place on Saturday, July 29 at 7 :30 a.m. MOTION: To continue the hearing to the site walk and to 8 -24 -89 at 8:45. (Cauldwell - O'Neill; all in favor) VOTED MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JULY 24, 1989 -- PAGE 2 WETLANDS PROTECTION ACT HEARING - SE211 -311 Jess Realty Trust -- Eastman St. lot 25, Map 41-- subdivision roadway, utilities, detention Abutters have been notified. Mr. Folkman represented the applicant. DEOE noted that rare species should be checked. Ralph Maloon described the plans for this 29 -lot subdivision off of Route 106. [Commissioner Rhoads arrived at this point (8:49)]. Road drainage will go into a detention area in the southeast corner of the site and outlets into the wetland in Eastland Estates (Shannon Lane). Several neighbors have groundwater problems in the area, so water is not being put into the ground. Dick asked that the missing drainage calculations be supplied to the commission, and also asked for a detail of the topography to the edge of wetlands. Mr. Maloon clarified that the detention basin will be impervious, with clay; the outlet will be the control device. Dick reminded him that a test hole must be dug in the area of the basin. The wetlands line used is the same one for Eastland Estates a couple of years ago. The subdivision is within the Water Protection District. Comm. O'Neill asked whether the small hole (less than a quarter -acre foot storage) was hydraulically connected to any wetland areas; Mr. Maloon responded that it was isolated. Comm. O'Neill asked that the area be flagged. Upon request from Mr. & Mrs. Cahill, 1024 East St. (abutters), Mr. Maloon described the detention area. Their cellar has been flooded three times in 12 years. Groundwater table is extremely high. Two lots immediately to the right of Mr. Cahill's property have been extensively studied and were under DEOE jurisdiction. He feels that the slightest miscalculation would negatively impact his property. He pointed out also that loss of trees to the subdivision would change the ability of the ground to take up surface water. Comm. Ouellette responded that those concerns would be better addressed once the Commission has had a chance to review the drainage calculations. Commissioners suggested trying to get the driveways etc. on the front lots to be pitched toward the streets, since it is a problem area. The site will be walked after staking of center line of road, detention area, rip -rap channel, and the depression, August 12 at 7:30 a.m. at the East Mansfield common. MOTION: To continue the hearing to 8 -14 -89 at 9:15 p.m. ('Rhoads - Cauldwell; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -310 Patrick & Eileen Walsh -- Hickory Lane map 34, parcels 106 & 107 - -re- subdivision of land requiring additional drainage into wetlands Mr. Garen Bresnick represented the applicant, who proposes to re- subdivide some of the parcel governed by a previous order (SE21l -193). Abutters have been notified. Calculations for original subdivision were done by the rational method, and only the new detention area has been calculated using the SCS method. No changes proposed in the original detention structures. Drainage calculations were submitted and will be reviewed by the commission. Two additional lots will result. Balancing of discharge rates originally provided by an existing large wetland. Comm. Rhoads feels that the digging of the trenches for sewers may begin altering groundwater. The Board will walk the site on 7 -29 -89 after Riverwood (around 8:45 a.m.). MOTION: To continue to the site walk and then to 8 -14 -99 at 9.4S p,v. (O'Neill - Cauldwell; all in favor) VOTED MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JULY 24, 1989 -- PAGE 3 WETLANDS PROTECTION ACT HEARING - SE211 -309 Bonwood Co. /Jess Realty- -Maple Street -- Subdivision including wetlands filling and construction within the buffer zone Abutters have been notified. Dick Lewis has written a letter to the Planning Board regarding this project. Ralph Maloon and Paul Folkman representing the applicant. Plans show a single road, 12 lots, wetland crossing, detention area, compensation area. Planning Board concurred with Dick's suggestion for straight retaining walls which narrowed the wetland crossing area. Mr. Maloon presented new preliminary plans (undated, no revision dates). Dick has encouraged the applicant to eliminate the berming in the wetland area, either by getting the water in the ground or creating another basin, perhaps a wet basin. Mr. Folkman stated his opposition to taking down trees to create such a basin. It would appear to Dick, given the culvert near the stream, that alteration of more than 50 feet of bank would happen, requiring wildlife habitat evaluation. Comm. Owens expressed concerns about how much area would be filled, given the large amount of filling which has already taken place for Austin Farms. Mr. Maloon stated that filling would total about 1800 sq. ft. for the crossing, and another 1500 sq. ft. in a second area. Comm. Rhoads feels that the applicant should provide for the record why he is under the 5000 sq. ft. limit, given that one applicant is also involved in Austin Farms. Comm. Rhoads has not had a chance to review the drainage calculations. He also asked about wildlife habitat as it probably falls within the 100 -year flood; he requested that the applicant address this issue for the record. Compensation for Form A lots on Maple Street will be included in this filing; discussions are underway with Dick Lewis on this issue. Chairman Ouellette would like some specific details to be submitted. Abutter Margie McShane, 14 Fredric Lane, has wetlands in her back yard and was were told that nothing could be built behind their lot. Dick explained a bit about wetlands protection. Tom McShane feels that the wetlands in this area have been segmented. Standing water accumulates in his back yard. He expressed strong feeling that the extensive alteration of wetlands in this area would impact most of the resource areas protected by the act. The plan is not in its final stages; when final plans have been presented many of these issues must be addressed. Chairman Ouellette asked that the 100 - year flood line be shown on the plan, and asked that the EIS be submitted. Abutter Anna Marie Monks, Fredric Lane (lot 12), also expressed concerns, some of which she chose to raise at a later hearing, given the lateness of the hour. Thomas Hamilton, 819 Maple St., sent letter raising five areas of concern. He has also taped the Natural Heritage Program. MOTION: To continue to 8 -28 -89 at 8 :00 p.m. (0'Neill - Rhoads; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -308 185 Mill St. Phil Corbett, Ralph Maloon and Paul Folkman were present to address questions raised at the last meeting. Mr. Maloon has taken elevation shots on Mill St. FEMA has said that the pipes pass the 100 -year storm. Water would have to reach 109.3 to crest the road, which it does not do according to FEMA. Moving septic system is acceptable to Mr. Folkman, if it would provide extra storage ;1NIs willing to have language in the Order mandating a return to the Board with a modified Board of Health plan. The Commission is looking for volume for storage, not square footage. MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JULY 24, 1989 -- PAGE 4 Mr. Amsden and Mr. Robinson, abutters, asked Mr. Corbett why he didn't indicate to abutters initially what his plans for this lot were. Mr. Corbett stated that the house became available after Sandy Hill was well underway; and that when they bought the house, they had not yet decided whether to renovate the existing house. Mr. Robinson's driveway had three feet of water in the last heavy rain from the Sandy Hill Development. The Sandy Hill catch basins aren't collecting water because the finish coat isn't down. Mr. Corbett has committed to putting the finish coat on the area contributing to Mr. Robinson's problem. Comm. Cauldwell asked whether the hay bales have been staked yet. Mr. Folkman did not think they had. Comm. Cauldwell observed that a drainage ditch /pipe along the uphill side of Mill St. was completed without benefit of hay bales. Mr. Corbett stated that he would cooperate fully with any suggestions made by Dick Lewis in terms of alleviating any negative impacts occurring. MOTION: To _meet at 7.30 on July 31, (Rhoads - Owens; all in favor) VOTED MOTION: To continue to 7 -31 -39 at 7:45 A,m, (Cauldwell - Rhoads; all in favor) VOTED ORDER OF CONDITIONS, SE211 -307, FULTON'S FOND.
