A temporary berm, sidewalk, streetlights, etc, are in. He feels his part of the work will be done, as presented to the Planning Hoard, by next week.. Flans dated 11 -3 -89 were presented. He feels that the previous problem resulted from velocity because curbing wasn't installed. The commission asked for a wetlands evaluation and recommendations for plantings. Mr. Ronvie is going to put some plants in when he does the planting for another job. Comm. Rhoads reminded Mr. Ronvie that the commission and its agent are not in the business of doing the wetlands evaluations. Comm. Rhoads felt a six -month and one -year inspection would be necessary to evaluate the conditions after planting. The commission's consensus was that Mr. Ronvie should proceed with the planting in the interests of getting something planted. Mr. Ronvie asked for a year -long extension for the project. One drainage outlet within 100 feet of the wetlands is all that remains of the work under commission jurisdiction, in addition to the repair of damage from the road washout. Mr. Ronvie agrees to setting a deadline for all the wetlands work to be done, if he and the commission can agree on a fair date. Nine or ten lots will have to be filed in the future; Mr. Ronvie is talking only about roadways at this point. Hick Lewis proposed 6- 30 -90, to which Mr. Ronvie agreed. Mr. Ronvie will send a letter for the record detailing the points to which he agreed. Comm. Rhoads raised three possibilities: to extend order as is, extend order with amendments, or let it lapse and require a new filing; Comm. Ouellette sees a fourth possibility, an enforcement order (which could not be filed at the registry). Comm. Rhoads sees a need to talk about plantings and inspections, and evaluation of the wetlands that were destroyed by the landslide. Dick recommends issuing an amended order with additional conditions. MOTION. To extend the Order of Conditions, with amendments, to 11 -1 -90, with wetlands at end of Donald 411en Drive subject to evaluation by agent agreeable to the Commission (with written report) within six and twelve wonths of the first planting; with work between lots 16 and 17 completed by 6 -30 -89 as agreed to by the applicant. (.Rhoads - O'Neill, all in favor, Smith abstaining) VOTED AUSTIN FARMS [Comm. Owens took a place in the audience, abstaining from voting.] Letter from commission dated 0 -29 -89 asked that: wetlands replication be completed by 9 -15, with all wetlands to be stabilized by 10 -15; silt and debris to be removed with further sedimentation controlled. [Comm. O'Neill left meeting, 9:29.1 Mr. Ronvie has employed Mainline Construction Co. to take care of all the drainage/erosion/roadway issues; they have been working for the past several weeks. Wetlands replication on lot 17 might be better located, according to meeting with Sanford and Mr. Lewis; excavation has been done for the replication on lot 33. Next week at the latest it will be planted. While the replication for lot 33 is being done, Dick would like to discuss with Mr. Sanford moving the replication on lot 17. Whatever the cost estimate of replication for lot 17, Mr. Ronvie will turn over a passbook. account to the commission, if Commission will agree to a fair spring date. Mr. Ronvie doesn't believe it possible to do the replication for lot 17 before winter. Comm. Rhoads suggested that commissioners might want to see the site, since there is a rather long checklist of items. Mr. Ronvie asked for a temporary extension, time to prove his good intentions. Chairman Ouellette feels filter fabric might be necessary in some areas. Mr. Ronvie understands that within 30 days if he doesn't perform, he will be facing an adversarial board. i MONDAY, NOVEMBER E, 1989 -- PACE 3 MOTION: To grant an extension permit to 12 -1 -89, referencing the 8 -29 -89 letter for conditions which must be met, excepting replication on lot 17 and excepting final seeding.
