WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -287 Ivf C. C.
Donwood Co. - 42 Fredric Lane, lot 18
The hearing was continued to 5 -7 -90 at 8:00.
SELECTIVE CUTTING PROPOSAL
Michael Luke, proprietor of L & T Logging, proposes to have trees marked
for selective cutting (this is currently being done in Easton). Mr. Luke would
cut and remove the wood, using two pairs of oxen, at no cost to the town; the
wood would be his to sell. He proposes marking 10 or 15 acres and having the
commission review the marking before any cutting is done. [Comm. Rhoads
arrived.3 Mr. Luke is in the, process of getting liability insurance. Comm.
Rhoads stated that this sounded like an ideal way to begin management of some of
the Conservation Commission parcels. The other commissioners agreed.
Before going forth, Comm. Rhoads felt a hearing would be in order, to
inform the public and officials. Dick and Mr. Luke can begin to walk the
parcels to develop a sense of what the cutting priorities would be, and Dick
can seek assistance from Bristol County forestry people; in the meantime, the
Commission will decide a on ground rules under which the Conservation Commission
wishes to operate., GnoL Y7l( M. G. (. %n relaa`/on 101"d4Sne.

question was never touched, because the Conservation Commission was concerned
about draining the wetland if the pipe size were increased. The compensatory
lot to go on lot 1. has been redesigned and will be installed this season, as
requested. Commission wants proof that the orders for the various parcels on
East Street are not in conflict and need no amendment, including documentation
that the pipe size is appropriate.

as wetlands by Sanford. In one area the notation is potentially misleading;
Dick will check with Sanford representatives and report back to the commission.
CERTIFICATION OF EMERGENCY CONDITION AT MILL STREET PROPERTY
The site was declared, after consultation with four commissioners, as an
emergency area in order that the drainage easement could be attended to by the
DPW. New replacement piping had been installed last year, and had caused a
large (14 -16 feet deep) gulley which created a hazardous situation on town
property. Dick requested confirmation of these actions by a vote of the
commission. Documentation must be provided to DEP. Dick drafted a document
which meets the requirements of the act.
MOTION: That the commission ratify the earlier emergency action.

indicated that he will file.
COPY OF LETTER FROM DICK TO BOB SWANSON re problems in Maple Park area.
Chairman Powers is disappointed at the lack of immediate response to
concerns about protecting areas subject to the act. She suggested directing
a copy of Dick's memo and a letter to Board of Selectmen apprising them of the
situation, emphasizing the importance of a quick response. If the situation is
remedied immediately, the letter need not go. The commission would like
an explanation of what is going on out there, in case a filing is necessary.
