CERTIFICATE OF COMPLIANCE, LOT 6, WHITETAIL ACRES - SE211 -269
The lot is outside of the buffer zone. Comm. Rhoads asked whether a cover
letter should accompany the certificate detailing the maximum number of lots which
would be released before drainage work is complete.
MOTION: To issue a partial certificate for lot 6, with cover letter urging the
applicant to complete the storm drain system.

Mr. Folkman explained that Sanford had made additional suggestions and had re-
flagged wetlands. The bank will be cut in only two places, creating an island of
upland trees, in the attempt to create a replication area of 5000 sq. feet. Comm.
Rhoads felt that the concept makes sense, and the applicant was so advised. The

house would be moved back further, with the septic system in front of the house.
Dick felt it was most important with this plan to make sure that replication work
gets folly into groundwater. The applicant will proceed with planning according to l
the discussion.

MAPLE ST. LOT (SARR0:
Mr. Folkman explained that a screened -in porch will be built on this lot, with
one footing in the buffer zone. No yard re- grading. Old footing will be hauled off
site. Current structure will not be enlarged, but closed in. Comm. Cauldwell noted
that more impervious surface would result. The consensus was that while the project
is likely to have minor impact, review is triggered under the regulations. A request
will be filed, and the site will be walked at 6:40 on 5 -14cZl,

,WETLANDS PROTECTION ACT HEARING CONTINUATION:
Bonwood /Jess Realty Trust - Kelli Green - SE211 -309
Mr. Folkman represented Banwood and Jess Realty, Sanford Engineering
f representatives were present to answer questions on wildlife habitat and water
quality issues. Letters from the commission dated last fall were used as the basis
for additional information submitted. Mr. Maloon reviewed the civil engineering
issues. The road has been designed close to the existing grade. Detention is about
1 1/2 feet over groundwater. This will require a waiver of some sort from the
Planning board. The applicant will have to return when the issue is resolved. The
commission asked about the amount of recharge possible, if retention is used rather
than detention. Mr. Maloon stated that if detention is used, the Planning Board has
a minimum of 3 1/2 feet over groundwater. Comm. Rhoads noted that lot 9 appears to
be very tight in order to comply with Title V regulations and town regulations, and
that the commission would need to see proof that those areas would work. Given the
tight nature of the lots, Comm. Rhoads asked whether the applicant could consider
returning with a shorter road system, thus reducing all impacts to wetlands, even if
a waiver from Planning Board regulations regarding length of ctrl -de -sacs were
necessary.
The Sanford representative explained ,that trying to preserve trees will be
difficult, since the area has to be lowered by two feet. Chairman Powers suggested
that clear cutting is to be avoided if possible. Comm. Rhoads explained that if the
,species is consistent with wetland areas (i.e., red maple), then an effort can be
(made to save it (hummock, etc.); but if the species is not a wetlands indicator or
wetlands tolerant, the commision doesn't mandate that it be saved. The Sanford
r`Qpresentative also expressed an opinion that a trickle channel may not be a good
idea because water contact with the plants in the basin will be reduced. Comm.
Rhoads raised water quality issues regarding the basis for some of the calculations
performed. Curb miles of roadway have not been considered. Sanford maintains that
refoval of nitrogen will be done by wetland vegetation. The basis for the ie" /year
fort dowsing (nitrogen) is Logan Airport figures for precipitation. These are
jttdment calls, based on the soils - selection process should be tied into the test
pits on the site. Mention was made of a potential special condition limiting lawn
size. Comm. Rhoads would like to see determination of current background level of
nitrogen, and how it will change. Total amount of filling for the subdivision: 1450
sq. ft. Dick Lewis pointed out that runoff from lawn areas and back yards has not
been addretsed in specific fashion. Runoff from back yards into wetlands has not
been taken into account with regard to nitrate loading. There was a problem with

Density in close proximity to wetlands is the issue. Lot 2 is unbuildable at
this time due to the amount of wetland present. Lot 10 also appears to be
unbuildable, and no construction is currently proposed there. (The Unbuildable
nature of these lots could change if the area is severed.) The commission asked
whether the new lots have been recalculated, given the changes in wetlands lines.
The plans must be changed to reflect the new wetlands calculations. The commission
j raised the possibility of a special condition stating that no more than 5000 sq. feet
of filling for the entire subdivision would be allowed. Folkman stated that his
reaction would be clarified upon consultation with his attorney. Unpaved driveways
as a special condition would not be acceptable to the developer. A drain area in the
slope of the driveway might be more acceptable. Thomas Hamilton, 815 Maple St., last
summer wrote the commission pointing out that no paved driveway was allowed at 819
Maple St., and suggesting that the same protection should be afforded to wetlands in
1 this new subdivision. The applicant requested an extension to after the Planning
J Board meeting.

David Duhaime- -131 York Rd.
The plan reviewed this evening was revised 5 -7 -90. The pit has been changed to
a trench and reserve area. A stone filled trench is shown placed at the end of the
driveway for runoff. Site walks showed a discrepancy of about 20 -30 feet between
site and plans,'with slopes steeper than depicted. Potential erosion /sedimentation
problems possible. A 30 foot back yard would be acceptable to the Duhaimes. Comm.
Rhoads feels the issue is one of construction performance standards. The project
will require double row of hay bales, well staked, and should be monitored on a
regular basis.

NEW BUSINESS:

Dick hasn't yet looked at it. He will report on the 14th.

will be forwarded to the solid waste committee and board of health.
- -A letter from Sanford, Corkin et al.: adjudicatory hearing decisions going back
to 1983 have been compiled and are available for purchase. Dick would recommendation
buying decisions from 1988 to present, as it would provide a better overview about
what DEP is or is not supporting. (875 for members, $95 for non - members.) The
commission approved.
j - -Green Acres, SE21l -131: re amended order based upon relocation of some of
compensatory storage area. The applicant was required to submit a wetland
replication plan by 4 -30; Dr. Carr's report has been submitted. Using the
compensation area as wetland replication for entire project is a problem for
commissioners; Dick will pull the file and review.
- -MACC advocating no net loss of wetlands. Looking for support for that policy.
Lists of things to avoid, minimize, mitigate. Dick will draft appropriate response
with appropriate copies to appropriate parties.
- -D. Graham has spoken to Dick regarding "areas of critical environmental concern"
designation. A speaker on Canoe River Aquifer indicated willingness to speak at a
commission and /or joint meeting with other town boards for support for nomination for
such designation. Advantages to designation - grant money, etc. Committee has
already voted to submit the designation. June 6, selectmen's meeting, would be a
possible time for such a meeting. Dick will try to schedule.
- -Dick walked Sweet's Pond, BMX track, etc. with Tom O'Leary as a follow -up to
discussion regarding use of oxen. Tom is of the opinion that he could work both
those sites and manage the sites using selective thinning on a no -cost basis to the
town. White pine would be desirable for him, since he furnishes wood chips for
composting. Dick has to check with town counsel regarding bidding process etc. He
is an accredited forester. Dick will draft letter. Chairman Powers felt that a
3 public forum would be in order regardless of what town counsel says. Should the town
profit from it in order to put the funds back into the land? 1
-- LIBRARY /DUILDING COMMITTEE. Mr. McCaffrie et al. want copies of discussion in
the minutes: Cbmm. Cauldwell will supply names of those who want it.
-- LANCHANSKI. Planning Board is about to pull its bond. Dick will draft a
letter, giving time frames and deadlines. He was advised to cc the Planning'Board.
