(O'Neill - Owens; all in favor) VOTED TOM MCDONALD, RE ENFORCEMENT ORDER FOR EAST ST. PROPERTY Mr. McDonald was present to express his consternation about the Enforcement order requiring him to remove a car, etc. from property which he does not own; he leases the property. One of the tenants renting the house left the automobile. Ero McDonald owns the property. The oil tank was left after a' Beauty Shop on the site was torn down. The property owner partitioned the property necessitating the removal of the oil tanks in question. Two drums of motor oil for Mr. McDonald's truck are currently stored in an old truck body on the site. Comm. Owens feels that whoever has possession and control of the property (i.e., Mr. McDonald) is responsible for removal of the debris. Chairman Powers suggested leaving this order in place and issuing an Enforcement Order to Ero McDonald as well, leaving their attorneys to determine who is responsible. MOTION: To issue an Enforce »tent Order to Ero McDonald, with an extension granted to Mr. McDonald so that the dates of the two Enforcement Orders will be the sauce. MOTION:_ To continue to 11 -13 -90 at 8:00 P.M. ` fO'Nei11 - Cauldwell; all in favor? VOTED REQUEST FOR DETERMINATION OF APPLICABILITY - Town of Mansfield- -East St. landfill "site -- Establishment of leaf composting facility In his capacity as Environmental Planner, Dick Lewis explained the plans for a leaf composting facility. The corner points of the site are about 50 feet from the edge of wetlands. Space,is required for front end loaders. The proposal is to operate site from October 6 to the first weekend in November. Lorusso will be bringing in additional sand and gravel mix to create a pad for composting, and to create a slope (away from wetland area). Material for pad must be a fine line between permeable and impermeable - to avoid sheet flow but also do prevent leachate from compost pile from going into groundwater. Jerry St. Hilaire is putting together an operations manual for the facility. Volunteers will assist town personnel in manning the operation, monitoring what comes in. The primary responsibility for site operation will be shared among Swanson, St. Hilaire and Lewis. [Comm. Rhoads arrived.] Comm. O'Neill takes exception to the fact that the town began preparing the site, site within 100 ft. of a wetland, without consulting the Conservation Commission. Right now the slope is towards the wetlands. Dick Lewis pointed out that debris was supposed to have been cleaned up under the Order of Conditions for capping the landfill. Comm. O'Neill feels that site should be cleaned up before anything further is \ done. Comm. Smith agrees that rubbish should have been cleaned up before the capping procedure. Chairman Powers asked what stabilization measures will be taken to avoid siltation if equipment goes off the pad, to avoid erosion, etc. Dick feels berming is a possibility on the southerly side, with the easterly side being stabilized with hay bales, soil. No plan for impervious surface MANSFIELD'CONSERVATION COMMISSION MINUTES MONDAY, SEPTEMBER 24,` 1990 -- PAGE 2 within 100 feet of wetlands.'. The original order for the landfill capping proposed taking surface debris and clearing it and did not take into account the extent of debris under the surfac'e." "Two issues are involved: (1) the landfill capping order must be complied with and amended if necessary; (2) a decision must be ,rendered for the rda currently under consideration. [Comm. >•Owensleft the meeting at this time.] Before the composting pad can be laid down, commission needs assurance that some of the materials currently there will not impact water quality- and that the debris will be'removed -to ensure that area will stabilize and slope appropriately.` Before this project'can•go ahead, the landfill capping project must be completed appropriately.,' The commission must find out if it is part of Lorusso's' contract to remove that rubbish.: Comm. -Rhoads suggested neg. Great Woods (John Drew Co.) made an arrangement with the state to MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, SEPTEMBER 24, 1990 -- PAGE 3 pay for engineering and permitting the improvements; the state will pay for construction). The road will be widened from two to four lanes, including the bridge over Rumford River. Some wetland areas will be filled, as well as parts of 100 -year flood plain, with impacts on river bank and land under water. The current thinking is to replicate in the vicinity, one -for -one. The wetland edge was flagged by John Crowe associates and verified by Dick Lewis. Commission still needs to walk the site. About 16000 square feet of wetlands are proposed to be filled by the project. Site will be walked on 10 -6 -90 at 7:30 a.m. MOTION: To continue to 10 -6 -90 field walk and then to 10 -9 -90 at 5 :15. To handle additional flows from adjacent land, leaching catch basins have been added to the rear of site; in case of a large overflow, the width of riprap was increased the entire length of 15 ft, 10 ft. out from the weir; to prevent the pond from drawing down wetlands there will be an impervious sandy clay core at center of detention basin; (the maximum headwater figure should read 165, not 155); natural growth will be preserved, the outside loamed and seeded with grass mixture. MOTION: To close the hearing. (Cauldwell - Owens; all in favor, O'Neill abstaining) VOTED STEVEN WRIGHT /WIND CHIME DRIVE Mr. Wright had a discussion with Elizabeth Kouloheras who told him that the Conservation Commission should enforce its Enforcement Order on the Superseding Order for the property. Dick walked site last Thursday with Mr. Wright; issues raised: lack of vegetative stabilization; outlet swale: portion of berm has been breached. The abutters also don't like drainage swale, but it was shown on the original plan. '.The steepness of slope on the easterly side is going to remain. Dick asked 'whether the abutters would consider writing letter stating their satisfaction_.if' the breach were fixed, wildflower mix were seeded, etc. Selectmen want a report back. Owens suggested the report come from Marilyn.. The Enforcement Order has essentially been complied with. Commissioners suggested a letter to DEP asking them to reiterate what Mr. Wright has reported, to send a plan so the Conservation Commission can enforce the order, and to notify the Conservation Commission of the status of the project. Comm. Rhoads offered a 7 -point letter reviewing the situation and making recommendations. MOTION: To send Conw). Rhoads' letter to Board of Selectmen as discussed, with a copy to DEP.
