Consideration should be given to replacing trees on the other side of the road, to help maintain the character of the road. The commission can indicate its opinion in a memo to the Planning Board regarding the scenic way hearing; the commission has no other objections. Dick recommended sending a memo to the Board of Selectmen stating a preference that the work to be done from the Bird Rd. side in order to avoid working within buffer tone. MOTION: To send a memo to selectmen indicating the commission's preference to have the pole line brought up from the Bird Rd. side of the site (explaining Commi4yon jurisdiction within the buffer :one); and also indicating the commission's desire to exercise responsibilities as defined in town charter section 5 -8 (p. 10), by advocating tree replacement on the opposite side of the road in order to preserve its scenic character. CC the Planning Board. (Rhoads - Cauldwell; all in -favor) VOTED In approximately the same location, New England Telephone proposes to install an additional 6 -8 poles. The consensus of the commission is that New England Telephone does riot meet the criteria to be exempted from filing a Request for Determination. SE211 -320 (Elementary School) s 1J.- Rq.dmith left the meeting for the duration of this discussion.] C P + Contracta+s asled about changing the timing of the culvert crossing. Two water lines and sewer line have been relocated, and additional information has been provided in response to letter sent in January requesting additional detail about the culvert crossing. Backup pumps will be on site. There will be 3" pumps on both sides of the area to be drained. The crossing will take about 1 1f2 weeks. There will be a beehive leaching pit, into which the discharge from the pumps will be directed. A detail of the box culvert was also presented. 240 ft. of stream will tie temporarily altered. Piping is all within the construction footprint. Two issues: (1).Does the commission accept this method of crossing; (2) Is t)-se timing satisfactory? There is r+e currently no snow cover, so spring melt`ng will not be an issue. The state representative in charge of issuing the water quality certificate suggested that going beyond the middle of March might be a problem. Dick recommended that the commission accept the amendment as a modification of the plan which is an insubstantial change with regard to the wetland; and give permission to do work at this time. Compliance to date has been good. Sewer work on the road which was not included in original plan will be done at same time and should be reviewed by the commission. MOTION: To accept the revisions to plan, and to grant permission for work to proceed as soon as possible. (Rhoads - Cauldwell; all in favor) VOTED [Comm. Smith returned to the meeting.] MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, FEBRUARY 25, 1990 -- PAGE 2 WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -309 Keli Green subdivision f Ralph Maloon presented a new plan (rev. date 2- 21 -91). Since previous hearing the plan has been reviewed by the Planning Board and Engineering Dept., .who wanted greater height for groundwater recharge area. Lot lines have been . added. According to Dick, new plans answer questions raised. Mr. Maloon doesn't anticipate any further changes from the Planning Board. Engineering is awaiting high groundwater mark in April. Comm. Rhoads has reviewed the storm drain calculations and suggested that the infiltration rate needs review /confirmation. Some performance standard could be established in the Order to substantiate the infilration rate. All house lots will have to come back for review, except possibly lot 4. Comm. Owens, noting that the public has raised the issue of segmentation before, asked whether that issue has that been addressed. The applicant maintains that the area previously altered in Austin Farms was owned by Bonwood Company, and that this wetland crossing is on property owned by Jess Realty Trust. Dick feels that special conditions of the Order should also address this particular issue. MOTION: To close the hearing. (Rhoads - Cauldwell; all in favor, Owens abstaining) VOTED Regarding the compensation area for three Form A Maple St, lots (which was shown on the plan), Dick recommends issuing an Enforcement Order mandating that the work be done within one year (this construction season) compensating for filling which occurred at 245 Winter St. and 795 and 807 Maple St. MOTION: So moved. (Cauldwell - Rhoads; all in favor) VOTED - WETLANDS PROTECTION ACT HEARING - National Development Associates -- Grading P, construction of parking areas, retaining walls, drainage within 100 ft. of wetlands - -9 -19 Hampshire St. (lots 2 -3) Gene Reilley, National Devt. Assoc., Duncan Wood, GZA. File Number has not yet been officially received by the commission. Abutters have been notified. Aerial photograph presented. Proposal includes mirror image 2 -story building, half office, Half light manufacturing. Loading in the rear of each half of building. The work within the buffer zone includes a retaining wall and parking area. One corner of the existing building (to be demolished) is within the 100 ft. buffer; none of the new building is. The purpose of the wall is to raise the back end of parking lot, to create low point so water can be directed and stored. Existing erosion controls on site will be replaced and /or restored. Void subsurface storage system, using rocks. When the entire system is full, water will back-up into two lower catch basins. An existing riprap pad will be used as discharge point. Dick: the wetland line has not shifted. The concern raised at a site plan meeting was that the need for an no oil /water separator, due to the truck traffic at loading docks, etc. Me. Reilley agreed to address this issue. The commission felt that it is appropriate for the commission members to walk this site on their own. The applicant requested an Order at the next meeting if at all possible.' - MOTION: To continue to 3 -11 -91 at 8:00. //- (O'Neill - Owens; all in favor, Smith abstaining) VOTED (Comm. Cauldwell left for the duration.of the following hearing.] MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, FEBRUARY 25, 1990 -- PAGE 3 REQUEST FOR DETERMINATION OF APPLICABILITY Stuart Sweet -- Installation of single - family home septic system piping and pump within wetlands buffer zone--1805 West St. Mr. Sweet explained that the project involved replacement of a cesspool currently between house and lake. There are no options for a gravity 'type System; a pump system is only alternative. Board of Health will wait to hear from DEP before approving it. The project will take 2 -3 days. The plan was done by Karl Drown. Excavated material will be removed immediately. The old cesspool will remain as is for the time being. MOTION: To close hearing. (O'Neill - Poholek; all in favor) VOTED MOTION: To issue a Neg. # #3 determination, with the agent being informed when work is to commence, and an approved Board of Health plan submitted. (O'Neill - Poholek; all in favor) VOTED [Comm. CaUldwell returned to the meeting.] REQUEST FOR DETERMINATION OF APPLICABILITY Folkman/Zola Builders Inc. - -House & grading within wetlands buffer zone- - lot 5, Rosewood Court (Maple St.) Mr. Folkman and Mr. Zola were present. The wetland flags were located by Dr. Carr. A septic system is proposed in front of the house. The house is shown 70 ft. from the wetlands. The applicant submitted a letter, read into the record, agreeing to dry well, as -built plan, and monitoring by the agent; the garage has been removed, driveway relocated, and the hay bale line extended in accordance with the agent's requests. The lot was staked today; Dick looked at about 4:00 this afternoon. Dick's concern is that one wetland area was more extensive than shown, and he recommended that the commission take a look. Comms. Owens and Poholek felt that work is extensive enough to warrant a NOI. Comms. O'Neill, Rhoads, CaUldwell, Smith, Powers felt RDA is sufficient, but only if wetland line doesn't change as a result of site walk, to be held at 7:00 a.m. on 3 -4 -91. MOTION: To continue to 3 -11 at 8:15. (O'Neill - Poholek; all in favor) VOTED SE211 -251 - REVISION REQUESTED The applicant requested permission to modify the order to accommodate a future attached garage, by pulling the house forward and changing the grading, using a drop wall. The corner will be about 10 feet from wetlands. If the commission agrees to this concept, the applicant will return with more detailed grading plan. The limit of clearing line will also change. Mr. Folkman requested a partial release from 211 -144 and a partial release from lot 21 SE211 -288 (with loaming and seeding still to be done). MOTION: To release lot 21 from SE211 -144 (but not from SE211 -288, because of wort? remaining). (Cauldwell - Rhoads; all in favor, Owens not present) VOTED CERTIFICATE OF COMPLIANCE - SE211 -191 Mr. Broderick submitted a report on the replication area (by Drown Environmental Services) as requested, stating that it functions as designed. MOTION: To issue Certificate of Compliance for SE211 -191.
