be done. Therefore Dick. recommends holding off issuing the Certificate until
next week. He will update the commission on 5 -6.
BUDGET: The final budget proposed represents a total decrease from last year.of
about $1600, which Bick. feels will allow the commission to function
appropriately.
WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -349
Lot 7, Riverwood Estates.
A field walk took place on 4 -27. The line which was accepted was
essentially the line submitted on the original plan dated 4 -22 (the rev. plan
dated 4 -29 and submitted at this meeting showed the same line, and incorporated
additional features such as clay barrier). Mssrs. Trowbridge and Wright were
present at the meeting. They and the commission agreed that the new plan
reflects what was agreed to on the site walk. It was noted that the septic
system could not be sited in front, so house could not be moved back on plan.
Dick mentioned the possibility of a dry well for a swimming pool.
MOTION- To close the hearingg -
(Rhoads - O'Neill; all in favor) VOTED
REPLICATION AREA FOR RIVERWOOD ESTATES;
Comm. Rhoads feels a corrective measure is necessary to bring the area back:
up to proper grade, because at the moment it is clearly over - excavated.
Steve Wright stated that he had submitted an ERC report about the
replication area in support of Certificate request, which was accepted by the
commission. It was explained to Mr. Wright that the commission took the report
as a sign of good faith that progress was being made, not that the area was
acceptable or complete. The area has been monitored by ERC. The commission's
consensus is that it is necessary to show that the 'replication area is C
equivalent in function to the wetland that was lost. The burden of proof is on
Mr. Wright and his botanist to convince the board of this. Chairman Powers has
concerns 'regarding the detention area on lot 9 vis -a -vis street acceptance. The
developer still holds the title to lot 13, so the 'replication area work can be
done.
WETLANDS PROTECTION ACT HEARING - SE211 -352- -Sohn Riccio- -Essex St., lot 42 --
Construction of Fawn Lane and associated drainage structures within the
buffer zone.
James Dunn represented Mr. Riccio. The NOI includes the same NOI filed
under SE211 -224. Purpose: To construct roadway, associated drainage, and house
on lot 3 off of the roadway (part of Essex Heights subdivision). The area was
flagged in 1987. Construction on lot 3 has been added. Storage of 100 -year-
storm has been allowed for in a basin which acts as both a retention and
detention basin, as proposed and approved by the con com and p. b. in 1987.
Siltation controls are shown farther from wetlands than on original plan.
Chairman Powers asked whether this NOI included removal of old ice -house
foundation, debris, etc. as specified by the original Order of Conditions.
Mr. Dunn was not aware of the ice -house foundation. Comm. Rhoads would like to
review drainage calculations and test hole data. This subdivision lies within
the Water Protection District. Dry wells will be required for roof drains. The
siltation control line is the limit of clearing line also.
Abutters were present. Anne Cirillo, 100 Essex St., had questions about
street drainage; Mr. Dunn explained the catch basin system shown on the plan.
Dick will verify the wetland line, and the commission will then decide whether
there is a need to review the site. Revised plan dated 4 -13 -91 on sheet 1.
MONDAY, APRIL 29, 1991 -- PAGE 3
MOTION: To continue the hearing to 5-6- -91 at 7:20 at the H.S. cafeteria.

STREET ACCEPTANCES:
RIVERWOOD - Chairman Powers has no problem sending a letter to the Planning
Hoard stating that Commission concerns Have been addressed, as long as the
replication area is the only issue outstanding. Eastbrook Estates also needs
review, as does Green Acres. Dick has been monitoring that project closely.
Remaining lots will need to be re-filed.
Street acceptance review will be scheduled the meeting of 5 -13 right before
town meeting.
ORDER OF CONDITIONS - SE211 -251.
Add finding that all work shown falls outside of delineated or calculated
100-year flood line.

stormwater management area is complete.
