(O'Neill - PohoIek; all in favor) VOTED MOTION: To accept the minutes of 3 -6 -91. (O'Neill - Poholek;; all in favor) VOTED MOTION: To accept the minutes of 5 -13 -91 and 3- 20 - -91. (O'Neill - Rhoads; all in favor) VOTED RONALD BUCK Mr'. Buck addressed the commission regarding the longstanding construction issues at Bristol Farms. In speaking to the person in the Attorney General's office who is in charge of settling the issues, he learned that the owner is still Malcom Post and that the project may well receive permission to go forward as originally proposed with no restoration /replication for the alleged pond filling. Chairman Powers asked about the Army Corps of Engineers involvement. The order recently reinstated by the Mansfield Conservation Commission permitted street /drainage work only. Comm. Rhoads suggested writing a letter indicating the commission's concern that orders under appeal should be resolved taking into consideration that a wetland resource and flood storage capacity was destroyed and stating its support of full mitigatory measures. Chairman Powers agreed, adding that a letter should be sent to the Army Corps as well, inquiring into the status of the original violation. Dick will review the file on the status of the commission's RDA ruling on this site. MOTION. To send such letter of concern with cc to DEP, Rrmy Corps, EPR representatives, Mr. Buck, Connie Pietrafetta, 8d. of Selectmen, Mr. and Mrs. Brian Smith and other concerned neighbors. (O'Neill - Rhoads; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -346 Hatheway & Patterson Co., Inc. - -15 County St.-- Installation of concrete wall along Rumford River bank Mr. William E. Haynes, general manager, Hatheway & Patterson, gave an overview of the project. In 1972 oil,was reported seeping into Rumford River from the Hatheway & Patterson site. Along the bank, there was one area of significant seepage, and remedial actions were undertaken and have continued. In heavy rains, some areas of soil still seep oil; DEP directed that something be done to alleviate the problem. Keystone Engineering has undertaken extensive studies, etc. and designed a remedial system including replacing area of riverbank with concrete wall, with barriers, and reconstructing landscaping to stabilize riverbank. The plans have been approved by the state, and are now before the Conservation Commission as required by the WPA. The area of wetland remains basically the same; the flood volume is increased slightly. The proposed concrete wall is about 4 ft. high and 100 ft. long. They will be altering more than 50 ft. of bank, but in looking at the bank, Dick doesn't feel there is any significant wildlife potential. The removed soils will be analyzed and then a method of disposal will be decided accordingly. Comm. Rhoads suggested that some sort of water-handling plan will be needed during construction; the site will reveal what is needed. The applicant has applied for the necessary Corps permit; uncertain whether Ch. 91 Waterways permit will be required. Abutters have been notified. The commission needs a stamped plan for its records. Steve Gannon, Highland Ave., was present to find out about the project. Site will be walked 6 -15 at 8 :00 a.m. MOTION, To continue to 6 -17 -91 with site ua1A at 6 -15 at 8 :00 a.n+. (VIlleill - °oholek; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -357 East Coast Devt. Corp. - -Lot 21, 19 Ian Keats Drive - - Single family dwelling, grading within 100 feet of wetlands Abutters have been notified. Ralph Maloon represented the applicant. The project involves a single lot within Sandy Hill Estates. Hay bales, buffer zone line, dry wells are shown on plan. Wetlands line same as that shown on original subdivision plan. Dick feels things look in order. This lot was part of the original gravel pit area. Chairman Powers noted that an old test hole near the edge of the vegetation should be filled and covered. The applicant must still submit an approved septic system plan. MOTION: To close the hearing, (Rhoads - OlHeill; all in favor, Smith abstaining) VOTED MOTION; To issue the order of conditions as amended. (O'Neill - Rhoads; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -35r John & Martha Smith - -Smith Road toff Tremont St.) -- Roadway construction for Hodges Brook Estates within 100 ft. of wetlands Ralph Maloon presented for the applicant: Comm. Smith removed himself from the board for the duration of this_. hearing. The drainage plan has been.approved by the Planning Board. Plans have not yet been revised as a result of the discrepancies noted on the site walk, although revisions were drawn on the plan shown at'the hearing. The project is on sewer; 20 lots are proposed. Some lots will have to come back for review before house construction. Comm. Rhoads suggested that the commission reserve the right to review the wetlands line for any future individual lot filings. He also stated that the drainage talcs appear to be accurate. No alteration of wetland resource areas. Strict performance must be required for storm drainage, which is very close to wetlands. The commission walked the site 6 -1 -91. Dick will review the area and will check that there are appropriate siltation controls. Dick feels some overexcavation in the detention area may be necessary, to make sure the material remaining is appropriate. - Tudy Martone (sp ^), 5 Trowbridge Lane (not abutter), asked whether there will there have to be a 21E test done on the property; the commission instructed her that that is between Mr. Smith and potential buyers. The filling observed and referred to in site walk report is only within buffer zone area. She also asked whether there are plans to alleviate difficulties on Tremont St. (e.g. in winter, etc.) and was told that this is a Planning Board consideration. Denise Newell, 176 Tremont St., asked-how drainage pipes etc. will affect their yard, since many of the people fronting on Tremont St. have wet cellars; Comm. Rhoads explained that many of these problems are more likely to result from groundwater problems rather than surface runoff problems. This filing is for subdivision roadway and drainage system only. Burt Newell, 176 Tremont St. informed the commission that some years ago a twelve foot ditch was dug to draw down groundwater and alleviate cellar problems; he asked what will happen when the ditch is filled in and houses are put into that area (just south of Gladys Crisp, on an angle toward Tedeschi). Comm. Rhoads suggested that Dick see if he can find any signs of such ditch. Marianne D - - -, 104 Tremont St., asked about the potential negative impacts to the wetlands and asked that the orders include a recommendation that caution be exercised during development of the house lots to ensure that water sheds onto Smith St., and not back towards Tremont St. lots which already have wet basements. Flood plain dOCUmentatiOn /jU5tification \- must be submitted to the commission. Approved flood plain needs to be shown on MONDAY, JUNE 3, 1991 -- PAGE 3 this.site. Smith returned to the table.] WETLANDS PROTECTION ACT HEARING - SE211 -354 John & Carol Hurley -- -274 Fruit St. -- Addition to existing building (for vehicle and equipment storage) within 100 ft. of wetlands Ralph Maloon and John Hurley were present. Most of the lot is in the buffer zone. Dick and some commissioners have reviewed the site individually. Comm. Rhoads asked if there were any flexibility in location of the building to get some natural green space before wetland, because the siltation line is very close. Chairman Powers noticed one area of sweet_ pepperbush which should be checked by Dick. She also asked that the plan show where the tree line is. Comm. Rhoads suggested that the order could include a special condition asking plan to come back with final details about handling drainage, with hay bale line pulled in, and any other changes resulting from the site plan review. MOTION; To close the public hearing. (Rhoads - O'Neill; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -355 MAC Homes, Inc. - -10 Ephriam Dr. - Lot 13 -- Construction of house/septic system /related grading within 100 ft. of wetlands Ralph Maloon presented for the applicant, who was also present. Order of conditions on this lot had expired (SE211 -247 ). Same plan, essentially, as before. All class A soils, so no dry wells shown. Wetland line is consistent with original filing, according to Dick. Chairman Powers asked about the elevations of driveway and top of stone trench; the driveway will be pitched toward trench.
