(O'Neill - Smith; all in favor) VOTED MANSFIELD OIL - The commission has received a response to its request for additional information; Zoning Board of Appeals issued variance for construction of shed /garage; Dick will provide further information to the commission before next meeting. REQUEST FOR DETERMINATION OF APPLICABILITY - Roy MacDonald - 53 Mill St. - Two - story addition to existing house within buffer zone According to Dick, this is a pretty level site and there isn't much difference between the inside and outside of the buffer zone in the area of the proposed project. Two mini - conditions: any changes made by board of health or byuilding inspector should be brought to the attention of the commission; address siltation around treed area. MOTION: To close the hearing. (O'Neill - Cauldwell; all in favor) VOTED MOTION: To issue Meg. #3 determination with two conditions above. (O'Neill - Cauldwell; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -346 - Hatheway Z Patterson Thomas MacDonald (.Vice President, Hatheway & Patterson5 was present and submitted stamped plans showing river elevations. Two sheets dated 11 -16 -90 were submitted; the detail sheets, dated 7- 26 -90, were submitted with the NOI. MOTION: To close the hearing. (Cauldwell - O'Neill; all in favor) VOTED MOTION: To issue the orders as written by Dick'. (Cauldwell - Smith; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -356 - Hodges Brook Estates Due to the lack of a quorum, the hearing was continued to 8:30. [Comm. Rhoads arrived.] [Comm. Smith left the room.] The hearing was re- opened. Mr. Maloon represented the applicant. A new plan showed the revised wetland line and the 100 -year flood plain. Dick asked whether there was a way to replace the Swale with a pipe to save some of the trees; Ralph feels that installing a pipe might be just as problematic with regard to the trees. After this explanation, Dick concurred. The commission requested a written justification regarding the true flood plain in that area, to be submitted prior to construction of the detention basin. Otherwise, the commission would have to abide by the FEMA study, which would impact the detention area calculations. Lots 1 -7 could be graded so as to drain towards Smith Road. Dick has included this in the finding for the Orders. Dick reviewed the property looking for the swale mentioned by the abutters; he found no areas of depression, etc. Chairman Powers asked about the types of soils found in the area. MOTION; To close the hearing= (Cauldwell - Rhoads; all in favor) VOTED MANSFIELD CONSERVATION The hearing was closed with the understanding that should additional flood plain information reveal the necessity for changes, the hearing would -be re- advertised at the applicant's expense and re- opened. [Comm. Poholek. arrived.] CI, WETLANDS PROTECTION ACT HEARING - SE211 -358 - Stephen T. Barker - 15 Victoria Lane, lot 94 - House, grading, within 100 ft. of wetlands Mr. Joseph Barker represented the applicant. The abutters have been notified. Siltation fence proposed. Dick has reviewed site; the lack, of wetlands flags as problematic. One problem area: along lot 94/93 property line, old cart path ruAning from Victoria to Lancashire; topography was done through aerial method, which may not be completely accurate under some circumstances. Around flag 116, the wetland line on plan is not accurate, along swale between two lots. The change probably wouldn't impact the house proposal or dry wells - for roof gutters, but silt fence line should probably be shifted. The commission preferred to review the line again after flagging and before closing the hearing. Comm. Rhoads feels a limit of clearing should be shown on plan, and lawn should be limited to 7500 ft. in order to reduce the use of fertilizers in recharge area. The driveway area on the plan is graded so that water will drain off the side and towards the back; Comm. Cauldwell suggested an infiltration trench with crushed stone to catch driveway runoff. Roald Rolfs, li Victoria Lane, lot 95, asked which direction the water will run off in, and also asked whether the lawn limitation conflicts with the covenants for Forest Park. Mary Lou Porte, 11 Victoria Lane, asked whether the lawn could be extended at a later date even if the lawn size is restricted at this time. The commission explained that any alteration in the buffer zone would require a new filing.- MOTION- To Continue the hearing to 6 -24 -91 at 3:20. (Cauldwall - O'Neill, all in favor) VOTED CComm. Smith re- entered the meeting.] WETLANDS PROTECTION ACT HEARING - Cabot Partners - 21 Oxford Rd./171 Forbes Blvd. -- Modification to existing parking lot requires re- aligning stream/drainage channel [Comm. Rhoads left the meeting.] Bruce Tyson of TGG Land Planning represented the applicant. Bob Mainones of Norwood Engineering and John Rockwood from Sanford Ecological Services were also present. Abutters have been notified. A file number has not been received. In its response sheet, DEP commented that the applicant must show no net increase in peak flow between original stream and relocated stream. Gary Mak.uch indicated that he could find nothing wrong with the filing; the information which was lacking according to DEP was clearly included in the filing, and he was going to recommend that a file number be issued. The origin of the project involves a land swap to clear up some confusing property lines; there area new property lines for 21 Oxford Rd. and 171 Forbes Boulevard. The project proposes to divert a stream to the back side of new parking area, down into a culvert, and back out to rejoin a channel. Regarding the amount transformed from pavement to green and vice - versa: about 3500 sq. ft. more green space will be created. Sequence of ' operations with regard to the stream relocation (which must take place before any construction of the parking area): (1) coffer dam with hay bales and silt fence while new ditch is constructed; (2) excavation; (3) rip rap; (4) pool will be created; (5) ditch will be excavated; (6) topsoil and sodding in the zone of the swale; (7) the construction of the parking lots. Filling: 1050 sq. ft. of bank and land under- water; 1880 =_.q. ft. wetland; 250 lineal feet of stream; 3050 sq. ft. of replacement bvw. shown on the plan. Immediate temporary impact MONDAY, JUNE 17, 1991 -- PAGE 3 to over 1780 sq. ft. bvw.; as well as 2350 sq. ft. of deeper, more herbaceous wetland; the applicant requested consideration as limited project for the improvement of wetland in the pool area (1780 sq. ft. area). Report listed wetlands species to be planted. (2930 sq. ft. of total filling) Dick referred the NOI to engineering dept. for review; they suggested geotechnical fabric in drainage ditch area, and also recommended going from 1.5" to 2" of binder course. Construction sequence is appropriate. Comm. Smith: how much time will the plants have to get established before area is opened up. No more than 2 weeks. Pumped water will be put back into the brook that exists right now, at the point it would normally get to. Comm. Smith expressed concerns about the velocity increase, with regard to the pipe (as opposed to open channel). Crushed stone check dam will be used. Most probably the pump situation will last a day, two at most. hick could be notified when this aspect of the project will be done. Boston Scientific, 135 Forbes Blvd., Bob McIntyre, abutter came to review the plans etc. MOTION; To continue hearing to 6 -24 -91 at 8 :30. lC:auldwell - O'Nei11, all in favor? VOTED WETLANDS PROTECTION ACT HEARING - SE211 -359 - Brookdale Corp. - -27 Jacob Dr. - -lot 7-- House, septic system, grading within 100 ft, of wetlands Ralph Maloon for Hutchins - Trowbridge presented for the applicant. Wetlands and buffer- zone line shown on plan. Dry well shown on plan. 75 ft. at closest point to wetlands. Abutters have been notified. Approved by Board of Health. House corners and hay bale line are staked. Dick took a look; everything checked out. Wetland flags are up, staked specifically for this house. The limit of clearing on the southerly side will continue between 156 and 158 contours. Mr. Baker, Brookdale Corp., was told that the commission would like to reduce lawn size as much as possible. Comm. CaUldwell advised continuing hay bale line another 20 -40 feet to pass the area where the dry well excavation will be. MOTION. To close the hearing. (01HPill - C'auldUEll; all in favor, Smith abstaining) VOTED MOTION; To issue the orders as written by the agent and modified_ t( +'Neil! - fauldwell; all in favor, Smith ahstaii7ing? VOTED [Comm. Rhoads returned.] WETLANDS PROTECTION ACT HEARING - SE211 -360 - Zola Family Trust- -596 Maple St., Lot 2 -- House, septic system, grading within 100 feet of wetlands Ralph Maloon represented the applicant. The project, on the northerly side of Maple St. between Jennifer and Bird Rd., is a house almost entirely within the buffer zone, with the leaching field /septic system almost entirely outside it; the driveway will pitch toward Maple St. Dick looked at the lot Friday before it was staked; he would like to verify the wetland line after staking. Dry wells are, shown on the plan. Andrea Bonda, 578 Maple St., was present to express conceAis about potential impact to the private wells along that part of Maple St. The applicant has secured Board of Health approval but has not addressed the interest of the Act as it relates to private water supply. Approximate square footage of lawn area requested for the continuation of the hearing next week; the commission noted it has been requiring a limitation of 7500 sq. ft. NOTION: To continue to 6 -24 at 8 :45 p.m. (O'Neill - G'auldwell; all in favor? VOTED WETLANDS PROTECTION ACT HEARING - SE211 -361 - Starlin Inc. - 85 Mill St. - Stockpiling fill within 100 ft. of wetlands during house construction ION MINUTES Abutters have been notified. Mr. Maloon of RIM represented the applicant; he feels the flood plain map is incorrect with regard to this property and cited his calculations to substantiate his opinion. Dick„ hay bales are on site, though not entirely consistent with those shown on plan. Chairman Powers asked r what is proposed for buffer zone once pile is removed; she was told the area \ i would be graded and sloped toward the buffer zone. This should be shown on plan, along with proposesd elevations after pile is removed. The pile location on plan is not accurate; real location should be shown, as should finished grades around pile, and stab i1izationffinishing measures. Richard Kenney, abutter across the street, has a problem with water on front lawn during heavy rain and asked how he will be affected. NOTION, To continue the hearing to 0 -114 -91 at 9 :10. iCauldwell - O'Neill; all in favor) VOTED ORDER OF CONDITIONS - SE211 -356 (Hodges Brook Estates) MOTION, To issue as written and M)endr -L (O'Neill - Rhoads; all in favor) VOTED CONSERVATION COMMISSION BYLAU DISCUSSION: Dick's memo dated -29 proposed that an ad hoc committee 'review /rewrite a bylaw and propose it for either special town meeting in October, or spring. The commission felt that it might well be difficult and time - consuming to get a committee representing all the various boards and interest together. It was proposed to circulate a draft of the bylaw to all concerned parties, and let them know when it will be discussed, as a way of getting input. After input is solicited, the commission can then decide what changes are needed and can hold public hearings. The meeting adjourned at 11:45. Approved by:LV_ U&MMVIviate to town clerk: \_ 1pf
