REOUEST FOR DETERMINATION OF APPLICABILITY Earl P. Zecher- -1519 West St.-- Construction of 9' x 12' storage shed, within 100 ft. of wetlands [Comm. Cauldwell removed himself from the meeting for this hearing.] Dick has reviewed the site and the plans. Mr. and Mrs. Zecher were present. This is a scaled -down version of a project formerly before the commission as a determination; the project was never commenced. The house is approximately 20 ft. away from the lake. Dick feels there is not much chance of anything migrating, since the work will take place in a tightly contained area. In answer to Chairman Powers' question, the applicant stated that no chemicals would be used in the greenhouse addition. MOTION: To close the hearing (Owens - Poholek; ali in favor) VOTED MOTION: To issue a negative 83 determination. (Owens - Poholek; all in favor) VOTED [Comm. CaUldwell removed himself from the meeting for the duration of,this hearing.] Mrs. McCarter was present at the hearing. An addition of a family ' room, a deck, a two -car garage and study is shown on the plan. Only the family room and deck is proposed for this year; the garage and study will probably be constructed next year. A variance will be necessary for work to proceed._ The garage will be outside of the buffer zone. Mrs. McCarter was advised to report any changes resulting from the variance hearing process. NOTION: To close the hearing, (Owens - Aoholek; all in favor) VOTED_ MOTION: To issue a negative #3 determination, CPohblek - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -363 D & E Inc. - -Lot 9, 1111 Green Acres Dr. -- Driveway /dwelling /grading within 100 ft, of wetlands Mr. Ralph Maloon represented the applicant. The project involves the last lot on the right -hand side of Green Acres drive. A 100 -year flood plain line is shown on the plan. The driveway, which sheds to the street, and a small portion of the house are in the buffer zone. Dry wells are shown for the roof water. Chairman Powers asked what the limit of clearing would be. The larger pile shown (about 10 ft. high) will be used on site to backfill the foundation. The area between the hay bales and wetlands is currently proposed to be left as is, according to Mr. Maloon; Dick and the commission will take a look to determine what vegetation would best go there. George Nelson, abutter on Maple St., asked to look at the plan.. Ed Baldevin, 7 Green Acres Dr., also reviewed plan and voiced his concern that his basement was flooded in the 50 -year storm back in 1987. The areas discussed by the abutters are outside of the buffer zone and therefore outside of Commission jurisdiction. Mr. Baldevin doesn't feel the wetlands replication has been completed and also asked whether any study of the area been made to verify that the storage capacity has been replaced. Comm. Rhoads has reviewed the changed calcs and has found them to he in order; according to Dick, the replication has been completed. Mr. Maloon stated that the applicant intends to do no work in the area of the road /cart path. Dick asked that the applicant stake the lot line between lot 9 and lot 15 to help delineate the flood plain and separation of lots, removal of road, etc. Mr. Maloon was asked to add the cartpath to the plan, - -- Site - walk: - -7- 20-91 at 7:30 a m.- --- -- ----- - - - -- - - -`- NOTION: To continue the hearing to site walk and 7-29 -91 at 8:05. There are three wetlands on site; the two in the southeast corner and southwest corner are not being disturbed. The large wetland on the northerly side of the site abuts the Treetops subdivision. Flow will be reduced to the two small wetlands areas: A large detention area, will store water horizontally rather than vertically (won't go over 1 ft. in 100 -year storm). An existing finger of j wetland at the rear of lot 15 will be disturbed as well, to join, new.ditch with existing ditch. An area of about 400 sq. ft. will be altered though it will. remain wetland. According to Mr. Maloon, stone riprap will go to the edge of `. MANSFIELD CONSERVATION .COMMISSION ,MINUTES MONDAY, JULY"15, J991 -- PAGE 3 the wetland but will not alter wetland. The site is sewered. The applicant requested a continuation to August 26; and requested that Dick start figuring out replication requirements for planning board. The applicant also requested that the Commission review the'wetland` line on site. Dick has informed the planning`board.in response to their request for conservation input that as a result of "overzealous grading" in the area of lot 14, approx. 800 -1000 sq. ft. of wetland was filled (see correspondence dated April 11, 1959). Dick will check out the line this week and review the record regarding this site. He recommended that replication work be included in the orders. Restoration may restrict activity on lot 14 and impact roadway layout. A revised plan should show where alteration took place. The area was flagged approximately six months ago; Mr. Maloon was asked to provide an exact date. The excavated Swale of concern to DEP on its response form will probably revert to wetland after time. Comm. Cauldwell noted that regardless of whether this project begins, the restoration must be done in a timely way; to ensure this, time frames should be included in the Order of Conditions. Sim Kirk, 571 Ware St., asked questions about erosion around the proposed detention area, which he abuts. Al Colmenaro, 569 Ware St., was also present. Site walk: 7 -20 -91 at 8:00 a.m. MOTION: To continue the hearing to the site walk and to the meeting at 8:18 p.m, on 7 -29 -9i to review site walk /wetland line and then to 8 -26 at 8:00. Ralph Maloon represented the applicant. Lot 49: Most of the house and most of the leaching field lie within the buffer zone. The hay bale line is the limit of clearing; the driveway sheds to street; dry well shown for roof water; everything has been staked. Dick: Regarding limitation of lawn area, a revised plan should indicate the limit and should show the wood chip /groundcover areas beyond the limit of lawn. The tree line on plan is inaccurate. Comm. Cauldwell and Chairman Powers observed large holes /trenches (in some cases 40 -50ft. long, 20 ft. wide), with material piled up next to them.. Mr. Maloon was unaware of their existence but will look into it. [Comm. Poholek left the meeting.] Lot 50: Most of the house and a small portion of the leaching system is withiW the buffer zone; hay bales are the limit of construction; dry well for roof water; driveway sheds to street. Lot 51: Entire house, whole back portion of lot is within the buffer zone. Also - missing 7500 sq. ft. lawn limit statement on plan. A note on plan says that the 100 year flood zone is at 113.5; Chairman Powers asked that that be shown as a line on the plan. MOTION. To continue the hearing to the site walk and 7 -29 -91 at 9:10.
