AS TIME ALLOWS: MINUTES ORDERS OF CONDITIONS C:ERTIFIC:ATES OF COMPLIANCE MONDAY, JULY 29, 1991 -- PAGE 1 Members Present: Chairman Powers, Commissioners O'Neill, Owens, Poholek, Smith The meeting was called to order at 7:30 p.m. CERTIFICATES OF COMPLIANCE: SE211 -269: Whitetail Acres, lot 2. A letter dated 10 -89 from the commission stated that the drainage work was not completed and that releases would not be granted for over 507 of the lots. Riprap, curbing, and other issues remain undone. Dick recommended denial with a letter of explanation to School St. Realty Trust and its representative. MOTION: To deity the request for a Certificate of Compliance for the reasons stated above, with accompanying letter of e.%,planation referencing Oct. 1989 letter. (O'Neill - Owens; all in favor) VOTED SE211 -343 and SE211 -214: Sean Dr., lot 4. Trash and debris in wetland area have been removed as requested. Dick recommends issuance full release of 214 and partial for 343. MOTION; To release lot 4 from SE211 -343 and to release SE211 -214. (Owens - O'Neill; all in favor) VOTED REQUEST FOR DETERMINATION OF APPLICABILITY William Sibilia - -10 Dean St. -- Addition of 12' x 25' deck to existing residence Project involves adding a deck to an existing cement patio on the side of house; the deck will be half on the patio and half off. Dick sees no problem with the project. MOTION: To close the hearing and issue a negative 3 determination. (Owens - O'Neill; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -369 Cabot Partners - -21 Oxford Rd. /171 Forbes Blvd. Dick has confirmed the issuance of a DEP file number; no questions were raised by DEP about the project. MOTION: To close the hearing. (O'Neill - Smith; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -363 D & E Inc. - -Lot 9, 411 Green Acres Dr. -- Driveway /dwelling /grading within 100 ft. of wetlands Maximum lawn area notation (7500 sq. ft.) added to revised plan; cart path also added. George Nelson, abutter to back of lot 9, asked whether there would be any-blasting. Mr. Maloon said no blasting was anticipated at this time, based on test holes. Leaching field to go in front of house. In case blasting will take place within the buffer zone, the commission could request that they be notified and that appropriate copies of the permit etc. be submitted. MOTION: To close the hearing. (O'Neill - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -362 Philip Beatty - -Ware St.-- Proposed detention area, roadway, utility, grading for Deerfield subdivision within 100 ft. of wetlands Areas filled in 1989 have revegetated with wetland species (sweet pepperbush is predominant), cattails, grasses. Dick wouldn't recommend doing any excavation, but perhaps some planting is called for; he noted that there have been slight changes in the wetland line compared with that depicted on the plan. He agrees with the comments resulting from the Commission's site walk. Chairman. Powers feels another site walk is in order, because the area is of a complex nature and not easily evaluated. A site walk will be scheduled at the next meeting, 8 -12. MOTION. To continue the hearing to 8.00 on 8-26. r (01HEill - OwEns; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -3G8: Zola Family Trust - -12 Bird Rd. (Lot 7) -- Single family house, driveway, grading within 100 ft. of wetlands Ralph Maloon represented the applicant. Abutters have been notified. Revised plan dated 7- 29 -91. Dry wells shown. Lawn limitation note, proposed Hay bales included. Leaching system is outside the buffer zone. No ledge has been encountered at this point, so no blasting is anticipated. William Graham, 796 Maple St., asked how many homes would be built in this area. He was informed that this filing is for one home only. Mr. Maloon responded that there are many owners of property in the area. He was advised to check with Planning Dept. or Assessor's office to see what lots Have been created on Bird Rd. He also asked how drainage from this lot will affect Mr. Graham's well; he was told that the drainage will be away from his house. Comm. O'Neill reminded applicant to come before the commission for review if any blasting is needed within buffer zone. MOTION. To close the hearing, (O'Neill - Smith; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -3G7 East Coast Devt. - -15 Jonathan Rd. (Lot 11) -- Dwelling, septic, grading within 100 ft. of wetlands (Sandy Hill Estates). Mr. Maloon represented the applicant on behalf of Hutchins- Trowbridge. Revised plan dated 7 -29 -91 show=_. 40'X. of the leaching system in buffer area, along with most of house. Lawn area limitation note, hay bales, dry wells all noted on the plan. Dick didn't see any real problems on the site. (At the site Comm. O'Neill found a drain manhole cover incorrectly marked "sewer "). Driveway pitches to street. Richard Mysers, abutter on lot 12, has concern about impact on his lot because area is very low. Vegetation will be removed, and he fears losing drainage capacity into wetlands which he currently has. 'James Parker, 6 Elizabeth Rd. asked about the potential impact to the area of fertilizer, etc.; he was told that the commission has asked that lawns in the subdivision be limited to 7500 sq. ft. Many lots have cleared far- more than 7500 sq. ft. of lawn area, but unless they are within the buffet- zone, the commission can do nothing. Test hole data done in March 1989. The lot is not within the 100 -year flood zone. Include in order: tree clearing be limited to lawn area shown on plan. Mr. Golding, Matthew Lane, asked whether there is a regulation about dry wells; he was told that only the grading on his lot was within the buffer zone, so no dry wells were mandated for the house. Mr. Golding asked about the requirement for boundary markers and was advised to ask the planning board. Patty Golding, 2q Matthew Lane, lot 36 pointed out that so much grading is being _ done around trees that they will die anyway, even if they are not cut down. Much frustration was expressed by several abutters with regard to the way development is being carried out in this area. MOTION; To close the hearing, (O'Neill - PoholER; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -366 MONDAY, JULY 29, 1991 -- PAGE 3 East Coast Devt. - -lots 49, 50, 51 Ian Keats Dr.- -douse /septic /grading within 100 ft. of wetlands New plan dated 7- 29 -91. 100 -year flood zone is at 113.5, according to Mr. Maloon. Either the line should be shown on the plan, or notation should state that no work is being proposed within the 100 -year flood. It does not fall on the lots in question. Comm. O'Neill: lot 50 has debris /rubbish on it, and a pile of hot top sits on lot 48. The tree line on the plan is a fairly good representation, according to Dick. Lawn limitation note shown on plan. Clearing on some lots for septic system and grading is outside lawn area; these areas will have to be wood chips, groundcover etc. rather than lawn. MOTION; To close the hearing. (Poholek - S>nith; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -365 O'Brien & Meeks - -lot 25, 35 Fieldstone Dr.-- Single family dwelling etc. within 100 ft. of wetlands Dry well for roof water is shown. House is on sewer. Proximity of corner of driveway to wetland was chief concern. Dick: marginal wetland. Driveway will be pitched toward the street. Earth berm proposed in driveway area. NOTION. To close the hearing, (O+ Neill - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -364 Robert Niemi - -340 Ware Street -- Construction of house, driveway, grading within 100 ft. of wetlands 7500 sq. ft. lawn limitation note added to revised plan dated 7- 17 -91. Rather than the driveway pitched toward street as shown, the commission preferred a swale to southerly side of driveway to take the driveway runoff. NOTrON: To close the hearing. (Owens - O'Neill; all in favor) VOTED REQUEST FOR DETERMINATION OF APPLICABILITY John Crowe Assoc. Inc.- -Great Woods Performing Arts Center property (Map 16, lots 11,4,3) - -To determine resource areas prior to expansion of parking lot Kate Thompson from John Crowe Associates and Rayna Rubin from the John Drew Company represented the applicant. Great Woods proposes to add seating and a parking area for approx. 1700 cars. Area for expansion is adjacent to and north of existing parking area. Currently EIR is being prepared. Two wetland areas to be reviewed. Bordering vegetated wetland to north was flagged by John Crowe Associates. Walked with Dick informally in June or late May; then had it surveyed. Wetland edge is in a transitional state. 5 transects done; Documentation submitted 7- 29 -91. New England Institute of Environmental Studies program was used to substantiate wetland edges with data submitted from 5 transect areas. Goal is to not alter any wetlands, although no plans have been finalised. Second area: drainage Swale located close to Route 140; maintenance road to be widened to secondary access road. Drainage swale, which exists currently feeds to a culvert and then to a detention basin, may be altered slightly; the applicant's opinion is that the drainage Swale is not a protected resource area; reasons are detailed in cover letter. Consequently that area is not flagged. (Dick. pointed Out that it does have some value in terms of taking up pollution from parking lot and does have wetland vegetation.) The applicant does not intend to alter existing detention basin, which John Crowe feels is a bordering MANSFIELD CONSERVATION COMMISSION MINUTES vegetated wetland at this point. Site walk: 8 -3 -91 7:30 a.m. If Mr. Crowe is unavailable, Dick will be notified and the walk will be rescheduled for 7:30 a.m. on 8 -10. MOTION: To continue to 8 -13 at 8 :00 with field walk as above. t0'NKII - Smith; all in favor) VOTED CERTIFICATES OF COMPLIANCE: SE211 -347 - Lot 37, 28 Matthew Lane, Sandy Hill. Dick. went out to Matthew Lane this afternoon after getting the message that this lot was done. Driveway has not yet been paved and the back yard has not yet been seeded. Locations are accurate on plan. The potential buyers, who were present at the meeting, explained to the commission that their purchase and sale agreement was written with the understanding that the landscaping and paving would be done by them, which is why that work is not yet completed. Recharge areas have been installed as stipulated, with downspouts into pvc /stone trenches, according to the potential buyers. Owners should be given a copy of order of conditions. MOTION; To issue- a partial certificate for SE211 -347 releasing conditions 3, 4, S, b, =7. 18; other conditions shall remain in effect. (Smith - Owens; all in favor) VOTED Lot 24, Forest Park. Dick hasn't seen the lot; the request was tabled. SE211 -193 - Treetops, Total fill area almost 5000 sq. ft.; 6340 sq. ft. have been replicated. According to Dick, everything is in pretty good shape, drainage, sewer line in place; roadways done to base coat but not yet accepted by town.
