(Smith - Poholek; all in favor, Cauldwell abst.) VOTED REQUEST FOR DETERMINATION OF APPLICABILITY CONTINUATION: John Crowe Assoc. Inc. - -Great Woods Performing Arts Center property (Map . 16, lots 11,4,3) - -To determine resource areas prior to expansion of parking lot The 8-3 -91 site walk was reviewed. Kate Thomson and John Crowe represented the applicant. The commission wants to reserve the 'right to review transitional areas again when NOI comes in. Regarding the swale along the northern edge of parking lot, the applicant maintained that the drainage Swale was not a protectd easce area. Given 'the OWN wetlands vegetation, Chairman Powers eques e, that the wetland vegetation be flagged. No work is proposed at this time to the swale area, however. As requested, the applicant submitted a supplemental plan and wetland vegetation information relating to the Swale. Ms. Thomson and Mr. Crowe opened discussion about what type of resource area the Swale is, maintaining that it does not qualify as intermittent stream because no connecting wetlands are upgradient of the swale, and it is not bordering any water body so is not a bordering vegetated wetland either. The question is how the area must be define for the EIR which the applicant is preparing. It was also noted that when a drainage swale fills with vegetation, it no longer fulfills its function, so such an area must be maintained. It seems reasonable to the commission in such rases to include an order extending the possibility of maintenance of such swales. Clearly the area near where parking will be is bordering vegetated wetland. Include in the determination: (1) In the opinion of the Conservation Commission, while the swale may not meet all criteria for protection under the act, due to the.fact that the drainage Swale contributes to prevention of Pollution, protection of wildlife habitat, water quality protection, and storm damage prevention, the swale area merits protection; (2) John Crowe Associates has stated no plans are proposed to alter this area. Another result of the site walk: scoring /erosion noticed in some areas; Dick. went over the site with personnel. MOTION: To close the hearing. (O'Neill - Cauldwell; all in favor) VOTED NOTION: To issue positive FYI with two caveats listed above. (Poholek - Cauldwell; all in favor) VOTED WETLANDS PROTECTION ACT HEARING: 311211 -335 (AMENDED) Torn McDonald- -945 East St.-- Construction of 20' x 30' garage (change to DEP File SE211 -335) Tom McDonald, Michael BelRossi and M. Rossi of Triangle Engineering 'represented the applicant. Abutter notification still to be submitted. Trailer to be removed, metal garage to be installed; either slab an grade with fill 8 -ft concrete wall in rear or full basement, again with 6 ft. concrete wall - owner has not yet decided. Gil truck will be kept in garage. Regarding protective measures, the commission requested a 4 -6" lip around everything except for the door. Everything should slope away from the wetland: Continue the original berm to the garage. No cleaning of truck when it is in garage. No floor drain in garage. Corner of garage approximately 20 ft. away from wetland at closest (\ point. Dick requested that corners be staked so commission and agent can review individually. Junk (truck body etc.) has been removed. MOTION: To continue to 8 -26 -91 at 3:SO (O'Neill - Cauldwell; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -3?0: Curmac Realty Trust - -South of fit. 106, near Easton /Mansfield town line- - Subdivision roadway construction within 100 ft. of wetlands_. Robert Currivan, 300 East St., Mansfield, and Mr. James Dunn of Dunn Engineering were present for the hearing. This subdivision plan was approved by the Planning Board about 1 year ago. Monahan Lane will pass through buffer zone close to wetland. This area was the subject of a Determination some time ago. A Re /Detention area (about 28,000 cubic ft. of water will be retained) also planned within buffer zone. There will be an overflow in the 100 -year storm. There will be a significant reduction in runoff conditions in the area of re /detention basin. Dick has walked the wetland line with Dunn Engineering, but would like to look at the area around basin. Commissioner Rhoads has reviewed the filing and has provided the commission with his notes. When Dick first reviewed the site plan for the planning board, Dick noted a culvert on the plan and asked what it indicated. However the next version of plan showed no culvert. Comm.. Rhoads expressed con cern;tiat ,a h ftar g the area east northeast of re /detention, there may be insufficient water going into wetland in the post - development state. The applicant needs to address this water balance issue. The basin has potential to draw down groundwater given that bottom of basin will be lower than some existing elevations of wetland. Comm. Rhoads also questioned the timing of some of the groundwater tests. More well readings for test hole 14 should be provided at a minimum. The applicant should address what happens to the tributary areas if parcel E is built. The applicant maintained that this is a Planning hoard- approved design and changing the plan might be in violation of Planning Hoard mandates. Chairman Powers explained that discrepancies between Commission and Planning Hoard requirements can usually be worked out. The applicant was asked to calculate how much flow will be diverted as a result of the roadway construction. The commission is looking for points which contribute to wetland area and for reassurance that the wetland will not be adversely impacted by this plan. The applicant professed that the criteria of the Act and regs. have been met without any additional info supplied as to the impact of the road on the wetland. Test tole data filed with the NOI was reviewed. Test hole logs were requested by Chairman Powers. Area can be staked by the end of week.. Site walk: 7:30 a.m. S- 17 -91.
