The following two hearings were advertised for the same time; since they are
essentially the same piece of property, Jess Realty was opened first and
postponed to the end of the 'first of the two hearings. (During the first
hearing, commissioners agreed that to avoid confusion both parcels should be
discussed simultaneous, since the project represents one subdivision.]
MOTION; To recess the Jess Realty Trust hearing until the and of the MRC
Homes hearing,

.Ralph Maloon represented the applicant. Abutters have been notified.
This project was approved as one subdivision by the Planning Board about six
months ago. The applicants have applied for separate orders of conditions, but
it is a single subdivision. Construction details and contours have submitted
with the filing. The northeast section will be developed by MAC Homes; the
southwest section by Jess Fealty Trust. Dick asked Mr. Maloon to delineate the
drainage system according to lots on a plan. Filling occurs along the edge of
the roadway, on lot 184 and the edge of 185. Because of the height of
groundwater, the detention area won't be dug down much; an earth berm will
surround it, about 10 -11 feet above wetland elevation. Lots 135 - 139
constitute an isolated wetland of about 6 acres which falls on both property
owners' holdings. It meets the size criterion to be regulatable, but according
to Mr. Maloon the area is too flat to hold sufficient depth of water to be
regulatable. However, there is at the moment no development proposed in these
two isolated areas. The commi =_lion may want to discuss these areas further.
At the southwest corner of site, on lots 27 -31, there is a large wetland,
placed on large 7 -acre lot; a large -retention area is adjacent to this
lot, with a graded area, one foot deep, with crushed stone. [Chairman Powers
arrived.] In answer to the question of how difficult it would be to do the
replication first: it is not near other construction, but it has been placed
near a cart road. Commissioners indicated that they don't want to see a lot of
cutting for a path in order to do the replication. Mr. Maloon stated that
another slight alteration will be dole in a wetland area, when Comm. O'Neill
observed Hay bales shown in a wetland area. He was asked to provide additional
detail regarding this alteration.
A portion of the drainage from the MAC Homes parcel will shed onto the Jess
property. Wetland filling is included in phase B. The Planning Board
conditions of approval state that completion of all roadway, drainage areas, i
etc. shall be completed within two years for each individual project. Dick
asked for lines on the phased construction sheet showing where the drainage is
going. Comm. Rhoads' review of the plans prior to this hearing revealed
that the pre - existing condition on lot 29 is not consistent with topography
shown on plan. Dick also asked whether wetland filling could be avoided
altogether if the road were moved slightly; Ralph stated that it is shown about
12 ft. from abutting properties, and neighbor=_- were concerned about proximity of
roadway at the Planning Board hearings. When asked how much water is being lost
to wetlands because of the development, Mr. Maloon 'responded that on the
northeast side, there will be greater volume and reduced peak flows, but about
the same amount of water. On the other side (southwest site), there will be
some reduction. Chairman Powers asked for a report to the Commission about
water flows and the increase or decrease of water contributing to the area pre -
and post - development (based an a one- and ten- year storm).
Abutters: John Swafford, 14 Erick Rd. The abandoned units on Erick. Rd.
still have a pending case with the state involving flooding and wetlands; to
asked whether drainage calculations took into consideration all the septic
systems etc. which will result from this large subdivision. He also asked about
the division of the project vis-a-vis the permitting process (i.e., does
approval of one half of the project mandate approval of the other). The
commission will be considering that issue.
Bob Cavelieri, 6 Erick Rd. - raised the issue of the broken culvert and
was informed that that was the subject of another hearing (see SE211 -180).
Michael Thomas, 5 Erick Rd. - requested a review in layman's terms and
asked whether the commission will have _to consider the gallons of water- which
will be put into the ground because-of all the septic systems. Septic systems \
will not result in surface flow, which is what the drainage system is planned
for. Test hole data for the site has been submitted to the commission.
MONDAY, SEPTEMBER 9, 1991 -- PAGE 3
John Corrini, Stearns Ave., a landowner abutting the property, stated that
his land is being turned dho wetlands because of the problems at Bristol Arms.

WETLANDS PROTECTION ACT HEARING: SE211 -373
Jess Realty Trust- -180 Acres between Eastman St. and Stearns Ave.- -
Subdivision road /utility construction within 100 ft. of wetlands
Ralph Maloon reviewed the issues mentioned in the previous hearing, which
also relate to this project. Comm. Cauldwell asked how much water would be in
the -retention area in a 10- year storm.
John Swafford, 10 Erick Rd. is worried about any additional water being
added to the problem area.
The Chairman of the Board of Trustees for Village 2 stated that the
association's septic system has been redone and they are still having trouble;
they have called in an engineer to address the problem. That system is only 10
feet off the property line. When they look out at the proposed retention area,
they can see water standing year - round. He asked what would happen if it silts
up. Mr. Maloon stated that there should be no problem because of the system of
catch basins with sumps, large oil /water separator, and 30,000 sq. ft. of stone.
The question was also raised as to what will Happen if people clear cut, their
back yards. Chairman Powers stated that the commission only looks at what falls
within 100 ft. of bvw, but that the Commission will look closely at this area.
David Willett, 21 Erick. Rd. voiced his concerns that anything done to clear
the area is going to dump more water down the hill onto his property and his
strong opinion that nothing else should be done to this area until what's
already there is functioning adequately.
Elizabeth Campbell, 21 Erick Rd. is concerned about loss of trees when
retention basin is created; Mr. Maloon indicated the areas where trees would be
preserved.
