MOTION: To issue a Certificate. (Owens - Powers; all in favor) VOTED SE211 -147: James Vadala, 1264 East St. There has been concern in the past over the state of Mr. Vadala's property, and an enforcement order was in place. hick. will arrange a site walk before the commission issues the certificate. SE211 -222: Eastbrook Estates. Outstanding issue was uncompleted detention basin. There is an individual order on lot G. The drainage easement lies between lots 5 and 6. A partial certificate was issued on lot 6 in late Dec. /early Jan. The detention seems to be functioning; subdivision inspector Dan Clifford seems satisfied. A full release was requested. Some grading remains on lot 6, but that is under a separate order. MOTION: To issue a full release of the subdivision. (Owens - Powers; all in favor, Poholek abstaining) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: David J. Morrison - -55 Deer Path Lane - -To construct single- family dwelling, related grading, within 100 ft. of wetlandc_. MOTION: To continue the hearing to 3 -23 -92 at 7:55. (Powers - Owens; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: Dajo Realty Trust-- Eastleigh Estates North (Route 106 )- -Road through buffer zone with culvert placed to provide drainage for final construction Wetland line has changed from original delineation, as noted on site walk. New plan will be submitted. Chairman Cauldwell read the site walk report for the audience. Commissioners and applicant concurred about how the wetlands previously shown as two separate areas are now hydrologically connected. Flagging will be added to the new plan as well. Old and new lines will both be shown on plan. Joe Rudy, 19 Cavan Crossing, asked what the impact will be on Cavan Crossing houses. Mrs. Rudy expressed concerns as well. MOTION: To continue the hearing to 3 -23 -92 at 8:02, (Owe>rs - Powers; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -379 Zola Family Realty Trust -- Rosewood Drive (off Bird Rd.) -- Grading with buffer zone during construction of 19 -lot subdivision Mr. Folkman and Ralph Maloon presented for the project. Following last meeting it was computed that the project as proposed would cause a 378" rise in overall flood elevation in the 100 -year storm: this line and the existing wetland line were marked on the plan. This new line falls outside the wetland MONDAY, MARCH 9,1992 -- PAGE 2 line impacting lot 3, lot 2, and the Dondas (of 578 Maple St., present at the meeting), also here this evening; Zola'Duilder=_ still retains ownership of lot 1. The Dondas indicated understanding of potential impact and indicated that they would accept plan as being presented to prevent any additional tree clearing. Comm. Poholek noted that former commissioner John Rhoads deemed the calculations adequate. The talcs have also been reviewed by the Engineering Dept. The "adequate" assessment indicates that the requirements of the Wetlands Protection Act to balance the flows have been met. Mr. Rhoads also indicated that the town should be granted adequate storm drain easements. Applicant is amenable to doing an easement box around the head wall and pipe. Can be put in the Order of Conditions. On the site walk a number of questions were raised about the Swale and its functioning. Data distributed to commissioners for one to one hundred year storms. Comm. Poholek: Water overflowed the road in 1987, according to Steve Fonda, 578 Maple St. Calculations say it won't overflow, but calculations are t based on an unclogged pipe, with no debris. [Comm. Powers left the hearing.? Planning a detention basin will be difficult without impacting wetland, M'w %i which involves trenching in the swamp. Chairman Cauldwell suggested the idea of YAQ malting a wider Swale with a pervious bottom (stone instead of grass). Dick eV,bvs Lewis observed that you then lose the benefit of the grass Swale in terms of P hcu pollutant uptake and filtering effects. He suggested a middle ground: working ¢p 4e within the same confines of the drainage easement, creating a sedimentation pool eurtext- instead of a linear 20 feet of rip rap - an uptake swamp for the swamp_(.;) Mr. Folkman felt that what is proposed was more State of the art, but they are willing to consider /plan for other ideas to 'reduce direct discharge. Comm. Owens would like to see some additional work around the Swale area. Wants to see additional planning from the applicant. Dick. would want to see certain grasses planted. Could be specified in orders. Comm. gave applicant the go -ahead to pursue the solutions suggested tonight rattier than plan another detention area. Easements will be required regarding water trespass -on abutters lots. Easements should be shown on plans and also be in a form which is a recordable document that will stay with the deed. MOTION; To continue the hearinq-to 3 -23 -92 at 8,20. (01Neill - Forbes; all in favor, Smith, Powers abstaining) VOTED [Comm. Powers returned to the meeting.] REQUEST FOR DETERMINATION OF APPLICABILITY Hutchins - Trowbridge Assoc. -- Katherine Ct. subdivision (off Old Farm Rd.) -- Grading within 100 -ft. buffer zone and isolated land subject to flooding Ralph Maloon 'represented the applicant. The plan was done originally by Fay Colony. An isolated wetland is shown on the plan. A drainage'study states that the area doesn't hold a quarter acre foot and is therefore not a protectable resource. Grading for roadway will be at least 75 ft. from the other wetland on the.=_-ite. . Comm. Poholek asked why the applicant didn't file before work began. Dick. doesn't know; he had notified them earlier. Comm. Powers: Wetland line can be confirmed later- on the site walk for the individual lot.filings. Gale O'Donnell, Old Farm Rd. Mr. O'Donnell informed the commission that a similar plan had previously been rejected by one of the town boards. He has concerns that so many of the back yards and cellars already in the area are wet. He believes his cellar is below the waterline, as are those of most of the houses. -Mr. Maloon stated his belief that this is the first time this particular parcel has come before any town boards; it was separate from and surrounded by the parcels which did come before boards and failed pert tests.
