Dr. (Owens - Powers; all in favor) VOTED SE211 -155: (Shamrock Estates) Wetland work involved drainage from a subdivision; no wetland work took place on lot 6 itself. Unknown whether the drainage work has been done. Comm. Powers. thinks that the Planning Board rescinded the subdivision order. Bank has taken over project and is asking for release of lot 6 only; no drainage work is located on this lot. Dick was instructed to check on the status of the subdivision roadway. [Comm. Smith arrived.] WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -374 MAC Homes, Inc. -- Between Eastman St. and Stearns Ave. -- Subdivision road/Utility construction within 100 ft. of wetlands; 2200 sq. feet wetland filling WETLANDS PROTECTION ACT HEARING CONTINUATION: SE211 -373 Jess Realty Trust - -180 Acres between Eastman St. and Stearns Ave.- - Subdivision road /utility construction within 100 ft. of wetlands The applicants have requested continuations to September. O'Neill reminded members that the commission should walk the site as specified in no. 3. Regarding No. 4: nothing has been done about parking problem. This is an enforcement issue; the contract langauge is appropriate, but the parties need reminding. Add reference "as provided in Exhibit B" to plan reference of Agreement, MOTION: To accept the lease as presented and discussed. (Owens - Forbes; all in favor) VOTED MOTION: To reconsider the previous motion, tabling the issue until LL can come in to discuss all plans. (Powers - O'Neill; all in favor) VOTED [Comm. Powers left meeting.] WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -385 j Home Developers Inc.- -Lot 1, Jennifer Drive -- House, grading within wetlands buffer zone WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -386 Home Developers Inc.- -Lots 2, 3, 4, Jennifer Drive -- Houses, grading within wetlands buffer zone Ralph Maloon represented the applicant; Mr. Boutas was also present. The plans under consideration were discussed with various_- commission members in the field; three compensation areas are proposed on new plan for lot 1 (totaling about 15,000 sq. ft.). About 100 sq. ft. have been allowed for the extension of pipe as well. [Comm. Powers returned.] No gutters are proposed for house. li note about an existing well has been put on plan. Grading lines have been added. The wetland line shown on this plan is different than that shown on the seven -or eight -year -old plan approved by the Planning Hoard. There is now no access to lot 4 without crossing wetlands. Mr. Maloon said lot 4 could be removed from plan. Comm. Owens_ - doesn't want any misunderstanding about lot 4. Dick suggested that a special finding could address lot 4. Comm. Owens raised the issue of vehicles located on the site from which he saw evidence of oil or other fluid leaking, ten or so feet away from a wetland; the same is also true of a bulldozer at the end of the nil de sac. Mr. BOUtas wants to finish the job before removing the vehicles. He was advised to put something under the trucks to absorb the oil. The applicant was asked for copy of the approved Planning Board plan; however, that plan doesn't show driveways. Comm. Forbes feels lot 4 should be noted as not considered for this hearing. The plan will be changed to reflect that this filing impacts lots 2 and 3 only. Dirk noted that in a letter MANSFIELD CONSERVATION COMMISSION MINUTES MONDAY, JUNE 22, 1992 -- PAGE 3 sent to Mr. Boutas, he had 'raised the issue about 'refuse in truck whichS J be 'removed. n Dick also again raised the issue of requiring a wetland replication Plan before hearing was closed. Since over 15,000 sq. ft. of replication is proposed, the commission should see more detail; the consensus was to require plan ahead of time. Regarding the question of water shedding from driveway near property line: stone infiltration trench will be necessary. M•r. Routas proposed stone dust driveway rather than'paving it. Driveway shedding question applies to lots 2 and 3 as well. The compensation for filling on lots 2 and 3 is not being done entirely on lots 2 and 3. Filling will take place under one order, compensation under another; therefore the Orders of Conditions must be linked together. MOTION: To continue the hearings to 7 -27 -92 for SE211 -385 and 336 at 8 :00 and 8:01 respectively. (O'Neill - Forbes; all in favor) VOTED WETLANDS PROTECTION ACT HEARING CONTINUATION - SE211 -393 Brook.dale Corporation --Lot 1, Bicentennial Way -- Single family dwelling within 100 ft. of wetlands Mr. Baker "represented the applicant. A new plan was submitted showing the elevations, as requested at the previous hearing. A special finding should recognize that the elevations are according to an assumed benchmark, correct in relation to the adjacent Bicentennial Court. MOTION: To close the hearing. MONDAY, JUNE 22, 1992 -- PAGE 4 MOTION: To close both hearings. (Powers_. - Forbes; all in favor, Smith abst.) VOTED MOTION: To issue a negative N3 determination for both requests, with Commission or its agent to be notified when work is to be done. (O'Neill - Owens; all in favor, Smith abst.) VOTED REQUEST FOR DETERMINATION OF APPLICABILITY Francis Bires - -iGG Dean St. -- Constriction of stone driveway within wetlands buffer zone The applicant, was not present. Stone dust driveway proposed for an area directly bordering wetland. Construction of house under superseding order, after being denied by local Conservation Commission. The stone dust driveway was on the original plan approved by DEP, but was never installed. Chairman Cauldwell's concern is based on the fact that the driveway turnaround shown is not in place, and that area is filled with wetlands vegetation. Another- concern is that grading will have to be done. MOTION: To continue the hearing to 7 -13 -92 at 3:00. (Owens - Powers; all in favor) VOTED WETLANDS PROTECTION ACT HEARING - SE211 -395 DMG Engineering - -Lot 20, Bird Rd. -- Construction of single family house within 100 ft. of wetlands Bill Gottwald, of DMG Engineering, represented the applicant. O'Neill reminded the commission of its policy to limit lawn area to 7500 sq. ft. in such areas. Kevin Grant, resident in area, had no concerns after seeing plans. MOTION: To close the hearing. (Owens - O'Neill; all in favor) VOTED MOTION: To issue orders with addition of lawn limitation and dry wells for 'roof leaders.
